The purpose of this chapter is to establish rules and regulations for the protection, care and control of the public park and playground in the Borough of Frenchtown; to regulate the conduct of persons on or within the park, or using the facilities thereof; and to provide penalties for the violation of its provisions.

The following restrictions pertaining to the use by the public of the Frenchtown Borough Parks, hereinafter referred to as the "park" are hereby established:
a. 
No littering is permitted in the park.
b. 
No horses or horseback riding is permitted in the park without a special permit.
c. 
No motorized vehicles, including minibikes, motor scooters, go-carts and motorcycles are permitted in the park except licensed motor vehicles in the parking lot unless the operator of the motor vehicle obtains a special permit.
d. 
No fires, except charcoal cooking fires in the park-provided grills may be started in the park without first obtaining a special permit.
e. 
No alcoholic beverages are allowed to be brought into the park without first obtaining a special permit from the Frenchtown Police.
f. 
No person shall willfully mark, disfigure, injure or displace any park property whatsoever.
g. 
No person shall be permitted in the park between the 1/2 hour after sunset and before sunrise without first obtaining a special permit, except that during winter months, persons may be allowed in the park for the purpose of ice skating so long as an ice rink is maintained by the Borough and shall be allowed only in accordance with regulations to be established annually by the Frenchtown Borough Common Council, and such regulations shall be posted in the Borough Hall and Borough Park.
h. 
No dogs shall be allowed in the park without a special permit, except that Seeing Eye dogs and Hearing Ear dogs shall be allowed in the park only when accompanied by the person requiring the special services of the dog.
i. 
No person using the facilities shall fail to maintain rest rooms and washrooms in a neat and sanitary condition.
j. 
No person shall throw, discharge or otherwise place or cause to be placed in the waters of any pond, stream or other body of water in any park or any tributary stream, storm sewer or drain flowing into such water any substance, matter or thing, liquid or solid, which will or may result in the pollution of the waters.
k. 
No person shall bring or dump in, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse or other trash. No such refuse or trash shall be placed in any waters in any park or left anywhere on the grounds thereof, but shall be placed in the proper receptacles where these are provided; where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere.
l. 
No person shall annoy another person or utter any profane, threatening, indecent or abusive language or act in a disorderly manner.
m. 
No bicycles shall be allowed in the park.

a. 
Smoking Prohibited. No person shall smoke or carry any lighted tobacco products in any of the parks, playgrounds or park facilities, including Old Frenchtown Field, Frenchtown Park and any other recreational area, within the Borough of Frenchtown.
b. 
Posting of Notice. The Public Works Department or his designee is authorized to post adequate notice of the juvenile smoking prohibition in conspicuous places near the entrances to the Borough of Frenchtown.
c. 
Violations and Penalties. Any person violating or failing to comply with any provision of this section shall, upon conviction thereof for first offense, be punished by a fine of not more than $50, or by community service of not more than two days; for second offense within the same calendar year, be a fine of not more than $100, or by community service of not more than five days; for a third offense within the same calendar year, by a fine of not less than $200, or by community service of not less than 10 days, or any combination of fine, imprisonment or community service determined in the discretion of the Court.

a. 
All special permits required according to the above mentioned rules shall be obtained from the Frenchtown Borough Park Commissioner or his designee. In the issuance of special permits, paramount consideration shall be given to the protection of public health, safety, morals and general welfare.
b. 
Persons using a park under a special permit shall have that permit available and be able to produce it upon request.
c. 
To reserve a recreational facility for a private party, a Certificate of Insurance as proof of current liability coverage must be provided.
d. 
A fee is required in an amount to be set from time to time by resolution of the Frenchtown Borough Council and this fee shall be payable to the Borough of Frenchtown prior to the issuance of the permit.

The Borough of Frenchtown, by and through its agents and employees shall:
a. 
In connection with their duties imposed by law, diligently enforce the provisions of this chapter.
b. 
Have the authority to eject from the park area any person or persons acting in violation of this chapter.
c. 
Have the authority to seize and confiscate any property, thing, or device in the park or used in violation of this chapter.
d. 
This chapter shall be enforced by the Borough of Frenchtown Police Department.

a. 
Except for unusual and unforeseen emergencies, parks shall be open to the public every day of the year during the designated hours. The opening and closing hours shall be posted herein for public information and shall be determined from time to time by resolution of the Borough of Frenchtown.
b. 
No person shall, on the grounds of race, color, national origin, religion, age, sex or handicap, be excluded from participation in, be denied the benefits of or be otherwise subjected to discrimination in any park facility, program or activity.
c. 
Discrimination on the basis of residence, including preferential reservation, membership or annual permit systems, is prohibited, except to the extent that reasonable differences in admission and other fees may be maintained on the basis of residence in any park.
a. 
Application for use of the facilities for special events shall be made in writing on this form to the Borough of Frenchtown.
b. 
Applications must be filed at least two weeks prior to anticipated use, except in cases of emergency.
c. 
To reserve a recreational facility, a Certificate of Insurance as proof of current liability coverage must be provided (except for individual users who shall execute a "Waiver of Liability to the Borough" in lieu of providing a Certificate), and such certificate must include:
1. 
Liability limits of $1,000,000 for each occurrence for personal injury and bodily injury/property damage.
2. 
All fees and Certificates of Insurance or "Waiver of Liability" must be submitted with this request.
a. 
The organization, individual or group using the facility assumes full legal responsibility for breakage or for damage to the property.
b. 
Each organization or group granted permission to use the facility shall provide adequate supervision and, where requested by the Borough of Frenchtown, provide names of those responsible.
c. 
All national and State laws, local ordinances, and rules of Police and Fire Departments regarding public gatherings must be strictly complied with.
d. 
The organization, individual, or group is responsible for cleaning up the area after its use, including placing refuse in the proper containers. Equipment or decorations provided by the users of the property must be removed promptly at the conclusion of their use. Forfeiture of their right to use the facility may result if this rule is not complied with.
e. 
Use of the pavilion is limited to a four hour period.
f. 
This form must be posted during the scheduled time period:
"Parking is limited, please car pool."

Any person violating any of the provisions of this chapter shall, upon conviction, be subject to the replacement or repair of the damaged property and/or shall be liable to the penalty stated in Chapter 1, Section 1-5.
