As used in this chapter:
CONTAINER
Shall mean metal or plastic garbage or trash can or plastic bag.
DUMPSTER-TYPE CONTAINER
Shall mean a large metal box capable of being lifted by mechanical means.
GARBAGE
Shall mean any waste animal or vegetable matter in the process of or subject to decomposition or decay incident to food use or preparation in any home, apartment, restaurant, eating establishment, store, club, school, church or other establishment, and shall include all waste or putrescible matter of any kind.
PERSON
Shall mean any individual, homeowner, tenant, store proprietor or employee, restaurant or eating establishment proprietor, manager or employee, or any school, church, club or municipal custodian or employee.
REFUSE
Shall mean all discarded waste material other than garbage, and includes tin and aluminum cans, bottles, broken glass, crockery, paper, cardboard, newspapers, ashes, weeds, leaves, Christmas trees and other rubbish, but excluding industrial and building materials.

Garbage and refuse placed on the Borough streets, roads, lanes and sidewalks for collection by the Borough garbage and refuse removal contractor shall be handled as follows:
a. 
Garbage from homes, apartments, schools, churches, clubs, stores and municipal buildings shall be placed only in watertight containers with tight-fitting lids or in plastic bags that are at least 1.5 millimeters thick. Metal or plastic cans shall have a capacity of not less than 2 1/2 gallons nor more than 20 gallons. Plastic bags shall be securely tied with metal, plastic or cord fasteners. No garbage container, plastic or metal, shall weigh more than 60 pounds when filled and shall be of a size that can be handled by one person.
b. 
Garbage from restaurants and eating establishments shall be placed only in metal cans with tight-fitting lids that shall weigh not more than 60 pounds when filled or in dumpster-type containers that can be lifted by mechanical means.
c. 
Refuse from homes, apartments, schools, churches, clubs, stores, restaurants, eating establishments and municipal buildings shall be made into bundles and securely tied; such bundles shall not weigh more than 60 pounds each.
d. 
No container shall be placed at the curbside for municipal garbage collection which contains recyclable materials as designated by ordinance or resolution of the Borough Council. Any container found to include recyclable materials may not be picked up during regular municipal garbage collection and, therefore, must be removed from the curbside by the person who placed the container at curbside.
e. 
No person shall place at curbside for municipal garbage collection more than three 30 gallon containers or a total of 90 gallons of garbage for any one household.

Any and all spilled or loose garbage and refuse on the Borough streets, sidewalks, roads and lanes not resulting from the handling or carrying by the garbage and refuse removal contractor's work crew shall be cleaned or picked up by the homeowner, apartment tenant, store proprietor or employee, church, school or municipal custodian or restaurant or eating establishment owner, manager or employee or any other person responsible for placing garbage or refuse out for collection.

No garbage or refuse shall be placed on the Borough streets, roads, lanes or sidewalks before 5:00 p.m. of the night before the scheduled collection, and all empty containers shall be removed from the streets, roads, lanes and sidewalks no later than 8:00 p.m. on the day of the collection.

No person shall discard, throw or deposit any garbage, refuse, soda and beer cans and bottles or other debris on the Borough streets, roads, lanes and sidewalks or in the Borough park or other public places.
