The general power to adopt ordinances by the Shade Tree Commission is contained in N.J.S.A. 40:64-1.

The provisions of Chapter 1 of the Revised General Ordinances of the Borough of Frenchtown in the County of Hunterdon (2000) concerning short title, definitions, construction and severability shall apply to all chapters adopted by the Shade Tree Commission.

As used in these Revised General Ordinances of the Shade Tree Commission:
PERSON
Shall mean every person, firm, association, partnership, corporation and individual.
PUBLIC HIGHWAY
Shall mean all streets, roads, roadways, public highways, parks or parkways, public alleys or public places in the Borough, except County parks, parkways and highways and State highways.
SHADE TREE
Shall mean shade and ornamental trees and shrubbery now located or which may hereafter be planted in any public highway, park or parkway in the Borough, except those located or planted on County highways, parks and parkways and State highways.
SHADE TREE COMMISSION
Shall mean the Shade Tree Commission of the Borough of Frenchtown and its duly authorized representatives.

Any person violating any of the provisions of any chapter adopted by the Shade Tree Commission shall, upon conviction thereof, pay a penalty of not less than $5, nor more than $1,500 for each offense. Complaint shall be made in the Municipal Court of the Borough or before another judicial officer having authority under the laws of the State of New Jersey.
In addition to the penalties above, violators are subject to assessments for the replacement cost of shade trees not to exceed an amount equal to $27 per square inch in trunk size measured at the base of the tree to be replaced.

Except as otherwise provided, each and every day in which a violation of any of the provisions of any chapter adopted by the Shade Tree Commission exists shall constitute a separate violation.
