[HISTORY: Adopted by the Town Board of the Town of Eureka 6-7-2005 (Ordinance 7, Chs. 1 and 2,

A. Required application fees and escrow for a permit, license, or land
use approval (such as a rezoning, variance, conditional use permit
or interim use permit) must be paid at the time of application, unless
otherwise specified by the ordinance that requires the permit, license,
or land use approval. The application for a building permit shall
be accompanied by a fee.
B. In addition, the applicant shall reimburse the Township for all attorney,
planning, and engineering costs and other professional consultant
costs incurred by the Township in reviewing and processing the application,
in inspecting the work performed and in enforcing the permits, licenses
and approvals.
C. The Township may require that applicants deposit in escrow with the
Township, together with the application fees, the sums required by
the Town Board toward payment of the attorney, planning, engineering,
and professional consultant costs. The escrow amounts shall be a credit
toward the fees for the attorney, planning, engineering, and other
professional consultant fees to be reimbursed by the applicant. All
such sums, if not already paid by the escrow, shall be paid by the
applicant within 30 days of final action on the matter by the Town
Board. If such fees are less than the escrowed amount, such escrow
will be returned to the applicant within 60 days of final action on
the matter by the Town Board. Applicants shall be permitted to withdraw
their applications at any time but shall not be entitled to a refund
of escrow funds already expended.
D. Where the estimated cost of proposed construction, erection, conversion,
alteration, or enlargement is in excess of $75,000, and in the judgment
of the Town Board it should be desirable or necessary to employ the
professional services of a registered engineer, architect, or other
qualified personnel to examine the structure under construction, then
the total amount of the fees shall be increased by the amount necessary
to pay for such professional services.
E. Any person delinquent in paying any fee or escrow authorized and
established pursuant to this chapter shall have such delinquent amount
be a lien upon their property. All such amounts which on September
1 of each year are more than 30 days past due, and having been properly
billed to the applicant, shall be deemed a delinquent account and
may be certified by the Town Clerk who shall prepare an assessment
roll each year providing for assessment of the delinquent fee or escrow
against the respective property which is the subject of the application
which generated said fee or escrow. This assessment roll shall be
delivered to the Town Board for adoption on or before September 15
of each year, and upon approval thereof the amount shall be certified
by the Town Clerk to the Auditor of Dakota County before the 15th
day of October each year. The Town, in so certifying such charges
to the County Auditor, shall specify the name of the owner of the
property, the description of the property and the amount thereof.
It shall be sufficient to use the name and property description shown
on the tax records maintained by the Dakota County Department of Property
Taxation and Records. The amount so certified shall be extended by
the Auditor on the tax roll against such property in the same manner
as other taxes. Such action is not exclusive and shall not preclude
the Town from using legal action to collect such delinquent fees or
escrows.
The following fees and escrow amounts are required and are hereby
established:
A. Mineral extraction.
(1) Initial application fee for new mineral extraction permit: $300.
(2) Escrow for initial application for new mineral extraction facility:
$7,500.
(3) Annual review fee for interim use mineral extraction facility: $150
or $6 per 1,000 cubic yards of material removed the previous calendar
year, whichever is greater.
(4) Annual review fee for preexisting nonconforming use mineral extraction
facility: $150 or $6 per 1,000 cubic yards of material removed the
previous calendar year, whichever is greater.
B. Outdoor assemblies: $100 for license to hold assembly for one day;
additional license required for each day and each location for $100
each. In addition to the license fee, the licensee is required to
file a bond with the Town Clerk in the amount of $100 per person for
the maximum number of people permitted to assemble.
C. Driveway or approach permit: $100.
D. Building permit fees: valuation based using Minnesota State Statute
§ 326B.153.

(5) Special investigation fee (for work done without permit): 100% of
building permit fee, in addition to permit and plan review fees.
(6) Renewal of building permit: 50% of the permit fee as established
in Minnesota State Statute § 326B.153, building permit fees.
G. Residential plumbing permit.
(1) Alteration: $100 + $1 state surcharge = $101.
(2) New: $100 + $1 state surcharge = $101.
(3) Sprinkler/irrigation system: $100 + $1 state surcharge = $101.
(4) Special investigation fee (for work without permit): 100% of applicable
fee, in addition to fee.
H. Residential mechanical permit.
(1) A permit is required for each heating or air-conditioning unit, including
air exchangers, in-floor heat system, gas log/fireplaces, factory
wood burning and factory fireplaces.
(2) Furnace and air conditioning are considered one unit for new home
construction only.
(3) Alteration: $100 + $1 state surcharge = $101.
(4) New: $100 + $1 state surcharge = $101.
(5) Masonry fireplaces require a regular building permit; need to submit
plans and fees based on valuation.
(6) Special investigation fee (for work without permit): 100% of applicable
fee, in addition to fee.
I. Residential maintenance permits.
(1) Roofing: $100 + $1 state surcharge = $101.
(2) Siding: $100 + $1 state surcharge = $101.
(3) Window/door replacement (same size) = $100 + $1 state surcharge =
$101.
(4) Demolition: $150 + $1 state surcharge = $151.
J. Other residential permits.
(1) Window/door replacement (change in size): valuation based using Minnesota State Statute § 326B.153, building permit fees (see Subsection
D, Building permit fees, above) + state surcharge (see Subsection
E, State surcharge above) + plan review fee: 65% of the permit fee.
(2) Permanent signs: valuation based using Minnesota State Statute § 326B.153, building permit fees (see Subsection
D, Building permit fees, above) + state surcharge (see Subsection
E, State surcharge, above) + plan review fee: 65% of the permit fee.
K. Swimming pools fee amount: for all in-ground swimming pools and for
all aboveground swimming pools designed to hold more than 5,000 gallons
of water, the fee amount shall be determined by the provisions of
§ 126-2D(2), as amended from time to time.
L. Moving building(s) into or within the Township.
(2) Permit fee: valuation based using Minnesota State Statute § 326B.153, building permit fees (see Subsection
D, Building permit fees, above).
(3) Plan review fee: 65% of the permit fee.
M. Commercial project fees include but are not limited to building,
demolition, plumbing, mechanical, fire suppression, alarms, fences/walls
over seven feet and permanent signs.
(1) Permit application/administrative fee: $50.
(2) Permit fees: valuation based using Minnesota State Statute § 326B.153, building permit fees (see Subsection
D, Building permit fees, above) + state surcharge (see Subsection
E, State surcharge, above).
(3) Plan review fee: 65% of the permit fee.
(4) Other inspections and fees: $85 per hour (minimum charge 1/2 hour).
(5) Special investigation fee (for work done without permit): 100% of
building permit fee, in addition to permit and plan review fees.
(6) Renewal of building permit: 50% of the permit fee as established
in the State Building Code.
N. Fee for inspection by Town Board or Planning Commission member connected
to a permit application or renewal: $25 per inspecting member.
O. Other inspections and fees per building official contract.
(1) Inspections outside of normal business hours, minimum two-hour charge:
$120 per hour.
(2) Reinspection fee: $85 each.
(3) Inspections for which no fee is specifically indicated, minimum 1/2-hour
charge: $85 per hour.
(4) Site inspection fee, required on all new construction:
(5) Additional plan review required by changes, additions, or revisions
to approved plans, minimum 1/2-hour charge: $85 per hour.
(6) Miscellaneous and special services, as per contract: $85 per hour.
P. Conditional use permit.
(1) Application for conditional use permit: $600 plus $1,000 escrow for
legal notices, planning, engineering, and legal services and drafting
of minutes; county filing fee: filing fee as established by Dakota
County Recorder's office.
(2) Application for amended conditional use permit: $600 plus $1,000
escrow for legal notices, planning, engineering, and legal services
and drafting of minutes; county filing fee: filing fee as established
by Dakota County Recorder's office.
(3) Review of conditional use permit: $25.
Q. Interim use permit or renewal of interim use permit (except mining):
$600 plus $1,000 escrow for legal notices, planning, engineering,
and legal services and drafting of minutes.
R. Legal nonconforming uses, lots, or structures.
(1) Application for verification of a nonconforming use, structure, or
lot: $45.
(2) Application for expansion or alteration of a nonconforming use: $600
plus $1,000 escrow for legal notices, planning, engineering, and legal
services and drafting of minutes.
S. Variance: $600 plus $500 escrow for legal notices, planning, engineering,
and legal services.
T. Amendment to Chapter
240, Zoning, application fee: $600 plus $1,000 escrow for legal notices, planning, engineering, and legal services and drafting of minutes.
U. Application fee for subdividing or platting of new land: $600 plus
$1,000 escrow for legal notices, planning, engineering, and legal
services and drafting of minutes.
V. Subdivision resulting in a simple lot split request: $45.
W. Lot of record verification: $45. The Town Board shall require escrow
of funds in the amount of $500.
X. Building right cluster/transfer.
(2) County filing fee: filing fee as established by Dakota County Recorder's
office.
Y. Right-of-way fees.
(1) Fees.

(2) Definitions. As used in this Subsection
Y, the following terms shall have the meanings indicated:
DEGRADATION
Diminution or reduction of strength, efficacy, or value.
LARGE UTILITY
Company that provides public utility service outside the
Township; pass-through utilities, such as fiber-optic cable, power
lines, communication lines, cable, buried or aboveground.
LOCAL UTILITY
Company that provides public utility service locally to the
Township residents.
OBSTRUCTION
The act of obstructing; impedes; an obstacle; impediment;
hindrance, in the road right-of-way.
Z. North Cannon watershed.
(1) North Cannon watershed permit application: $600 plus $1,000 escrow
for legal notices, planning, engineering, and legal services and drafting
of minutes.
(2) North Cannon watershed stormwater pollution prevention plan (SWPPP)
security. The minimum amount of the SWPPP security held shall be based
on $3,000 per cumulative acre of land disturbance. For projects that
discharge to special waters, the minimum SWPPP security shall be increased
to $5,000 per cumulative acre of land disturbance. The Township may
require additional SWPPP securities if needed.
AA. Special meetings.
(1) Special meeting of the Town Board: $600 plus $500 escrow for legal
notices, planning, engineering, legal services, supplies, copies,
Clerk's and/or Deputy Clerk's time for administrative duties
regarding the special meeting and drafting of minutes.
(2) Special meeting of the Planning Commission: $600 plus $500 escrow
for legal notices, planning, engineering, legal services, supplies,
copies, Clerk's and/or Deputy Clerk's time for administrative
duties regarding the special meeting and drafting of minutes.
BB. Administration fee for agricultural preserve: $45.
CC. Hangar: $50 plus building permit fees as set by the State Building
Code fee schedule as approved by the Town Board.
DD. Private kennel operator's license:
EE. Sign permit: $45 plus Building Official fees.
FF. Any escrow fund that is depleted in the process must be replaced
in equal amount prior to action on the application and any balance
due will require full payment as a condition of any approval and receipt
of payment prior to the commencement of any activity authorized in
the approval. Failure to pay all bills exceeding an escrow fund required
in this section may result in placing delinquent payments on property
taxes.
