The short title of this chapter shall be the "Buses Ordinance"
and this chapter shall be cited and referred to for the purpose of
amendment or otherwise by such title.

The Borough defines and declares that the purpose of this chapter
is to protect the people and property of the Borough and to preserve
the safety and welfare of the Borough and its citizens by regulating
and promoting safe bus pickup and discharge from property not owned
by the Borough and otherwise, as provided by N.J.S. 39:4-197 et seq.

As used in this chapter, the following term shall have the meaning
indicated:
Any motor vehicle operated over public highways or public
places in this state for the transportation of passengers for hire
in intrastate business, specifically omnibuses as defined by Title
39 of the New Jersey Statutes, notwithstanding that such motor vehicle
may be used in interstate commerce. Nothing contained in this section
shall be construed to include any bus activity preempted by state
statute, as well as any bus activity operated by a governmental entity
or any nonprofit organization.

Pickup and discharge of passengers from a bus is strictly prohibited
from all private property within the Borough, unless the owner or
his or her agent of the private property has granted prior written
permission and filed the same with the Borough zoning office and/or
the Borough police department. Compliance with this provision does
not exempt the property owner or his or her agent from adherence to
the zoning ordinances of the Borough, including but not limited to,
site plan approval, variances and other relief as may be required
from the land use board of the Borough.

Bus pickup and discharge of passengers shall be limited to state,
county and municipal approved stops, stations, stands and curb loading
zones. All approved stops, stations, stands and/or curb loading zones
shall be posted by sign. Bus pickup and discharge of passengers at
nonposted stops, stations, stands and curb loading zones is strictly
prohibited.

A.
All persons violating or failing to comply with any of the provisions
of this chapter shall, upon conviction, be punishable by a fine of
not less than $100 and not more than $1,000; by imprisonment for a
term not to exceed 90 days or by community service of not more than
90 days; or any combination of fine, imprisonment and community service
as determined in the discretion of the municipal court judge. The
continuation of such violation for each successive day shall constitute
a separate offense, and the person or persons allowing or permitting
the continuation of the violation may be punished as provided above
for each separate offense.
B.
The violation of any provision of this chapter shall be subject to
abatement summarily by a restraining order or injunction issued by
a court of competent jurisdiction.
