Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Mayor and, in the event of his/her absence, disability or inability to act, then the Chief of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Mayor, and in accordance with Subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Township of Sparta are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive, provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.
c.

Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that parking will not interfere with the normal flow of traffic.

The Governing Body hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Township of Sparta, in the County of Sussex, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Township shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the county jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the county jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This section shall take effect after approval by the Commissioner of Transportation 20 days after passage and publication as prescribed by law.

Note: Below are minimum standards for bus stop length which are based on recommendations of the Institute of Transportation Engineers and Studies conducted by the Bureau of Traffic Engineering and Safety programs. These standards include minimum lengths required for Bus Stops in order that buses may leave moving traffic lanes safely, keeping in mind that buses alongside the curb must be within six inches thereof as provided by state law pursuant to N.J.S.A. 39:4-135. These minimums are as follows:
NEAR SIDE — 90 feet plus the distance from the curbline to the end of the curb return, property line or crosswalk approximately 105 feet to 120 feet. Minimum acceptable length is 105 feet.

MID-BLOCK — No intersection on either side of roadside minimum acceptable length is 135 feet.
FAR-SIDE (AFTER BUS MAKES RIGHT TURN) — Minimum acceptable length is 150 feet. An additional 45 feet of length should be provided for each additional bus expected to stop simultaneously.

In any space on public or private property appropriately marked for vehicles for the physically handicapped pursuant to P.L. 1977 c202 (C.39:4-197.5), P.L. 1975 c217 (C.52:27D-119 et seq.) or any other applicable law unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or a passenger in that vehicle. State, county, or municipal law enforcement officers shall enforce the parking restrictions on spaces appropriately marked for vehicles for the physically handicapped on both public and private property (chgd. by L1989, c201(1), eff. 6/1/90).
No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful.
Pursuant to P.L. 1989, C 201, the penalties for violations must be $100 for a first offense and for a subsequent offense must be a fine of at least $100 and up to 90 days community service on such terms and such form as the court shall deem appropriate, or any combination thereof.

The owners of the premises referred to in Subsections 7-35.3 and 7-35.4 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Sparta. The owner shall be responsible for the repair and restoration or replacement of same.

As used herein, the following terms shall have the following meanings:
CHARGING STATION
A location that is fitted with charging station equipment.
CHARGING STATION EQUIPMENT
The conductors, including ungrounded and grounded, and the electric vehicle connectors, attachment plugs, and all other fittings, devices, power outlets, charging status or apparatus installed specifically for the purpose of delivering electrical energy from the charging station to the electric vehicle.
CHARGING STATION SPACE
A dedicated, marked parking space that is fitted with charging station equipment and exclusively used for the charging of electric vehicles.
ELECTRIC SCOOTER and/or ELECTRIC MOTORCYCLE
A two-wheel or three-wheel electric vehicle that operates exclusively on electrical energy stored in the vehicle's batteries.
ELECTRIC VEHICLE
A vehicle that operates, either partially or exclusively, on electrical energy from a charging station or other electrical energy source that is stored in the vehicle's battery for propulsion purposes. "Electric vehicle" includes: a battery electric vehicle; a plug-in hybrid electrical vehicle; a neighborhood electric vehicle; and electric scooters or electric motorcycles.
NEIGHBORHOOD ELECTRIC VEHICLE
An electric vehicle that is a low-speed vehicle, built to have a top speed of 25 miles per hour and has a maximum loaded weight of 3,000 pounds.
NON-ELECTRIC VEHICLE
A vehicle that does not meet the definition of "electric vehicle" as provided herein.
PLUG-IN HYBRID ELECTRIC VEHICLE or PHEV
An electric vehicle that: contains an internal combustion engine and also allows power to be delivered to drive wheels by an electric motor; charges its battery primarily by connecting to a charging station or other electrical source not on board the vehicle; may additionally be able to sustain a battery charge using an on-board internal-combustion-driven generator; and has the ability to be propelled through the use of electricity.
The Township of Sparta has designated the following spaces:
a. 
Municipal Building Parking Lot: Two charging station spaces.
b. 
Station Park Parking Lot: Two charging station spaces.
c. 
Sparta Library Parking Lot: Two charging station spaces.
Use of the charging station spaces shall be limited and restricted as follows:
a. 
It shall be unlawful for any person to park or leave standing a vehicle in a stall or space that is designated as a charging station space unless the vehicle is an electric vehicle as defined in this section and is connected for electric charging purposes; and
b. 
Nonelectric vehicles are prohibited from parking in charging station spaces; and
c. 
Electric vehicles are authorized to park in spaces designated as charging station spaces only during the time when the vehicles are connected for electric charging purposes or up to four hours, whichever is less. When the vehicle is no longer charging, the owner or operator of the vehicle shall be required to remove the vehicle from the charging station space. If the owner or operator of the vehicle allows his or her vehicle to remain in a charging station space while the vehicle is no longer charging, then the owner or operator shall be in violation of this section.
The fee for parking and charging an electric vehicle in a charging station space is $1.50 for the first two hours and $2.50 for each hour thereafter.
For each violation of this section, the violator shall be subject to such fines and other penalties as provided in § 1-5, General Penalties, of the Revised General Ordinances of the Township of Sparta. Repeat offenders shall be subject to additional fines and other penalties as provided in § 1-5 of the Revised General Ordinances of the Township of Sparta.

In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education Property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate, or park a vehicle in violation of the regulations indicated.
a. 
Sparta High School Grounds.

18 Sparta Avenue, LLC Parking Lot.
1. 
Parking.
(a) 
All motor vehicles must park in designated areas in between the lines provided.
(b) 
No person shall park a motor vehicle for more than two hours in the parking lots located at Block 39.01, Lots 11, 12 and 15. The only exception that 18 Sparta Avenue, LLC may provide up to six parking passes to its tenants and/or employees to allow parking for more than two hours provided that such parking passes be displayed in the vehicle.
2. 
Signs. All signs, posts or other materials shall be installed in accordance with the current Manual on Uniform Traffic Control Devices, to the extent applicable, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27 as same may be applicable.
3. 
Penalties. Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this ordinance or any supplement thereto shall be liable to a penalty of not less than $50 nor more than $250 or imprisonment and/or community service for a term not exceeding 15 days or both.

The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of same.

It is the intention of these specifications to describe the requirements for the towing of abandoned, disabled, illegally parked vehicles, stolen vehicles, vehicles involved in accidents within Sparta Township, vehicles suspected of involvement in crimes located within Sparta Township, and other vehicles identified by the Sparta Township Police Department when requested by the Police Department of Sparta Township, New Jersey. Towing contractors shall be subject to the requirements of this section and the rates set forth herein.

The following words and terms, when used in this section, shall have the following meanings, unless the context clearly indicates otherwise:
ABANDONED
Any automobile which is parked without the current year's registration or license plates, as required by law, for a period of more than 48 hours or is positioned so as to constitute an obstruction of traffic.
AUTOMOBILE
A private passenger automobile of a private passenger or station wagon type that is owned or leased and is neither used as a public or livery conveyance for passengers, nor rented to others with a driver; and a motor vehicle with a pickup body, or delivery sedan, a van, or a panel truck or a camper-type vehicle used for recreational purposes owned by an individual, not customarily used in the occupation, profession or business of the owner(s).
BASIC TOWING SERVICE
The removal and transportation of an automobile at the request or call of authorized personnel or members of the Police Department as may be required when abandoned as defined herein, disabled, damaged in accidents, illegally parked, recovered after being stolen or in cases of emergency, from a highway, street, or other public or private road, or a parking area, or from a storage facility, and other services normally incident thereto, but does not include recovery of an automobile from a position beyond the right-of-way or berm, or from being impaled upon any other object within the right-of-way or berm.
CHIEF OF POLICE
The Chief of the Police Department of Sparta Township or his/her designee.
MOTOR VEHICLE ACCIDENT
An occurrence in which an automobile as defined herein comes in contact with any other object from which the automobile must be towed or removed for placement in a storage facility. This includes all situations which are accidental to one person even if caused by the intentional acts of another.
NON-BASIC TOWING SERVICES
All towing services which are not basic towing services or are not performed on automobiles as defined herein.
STORAGE SERVICES
The maximum allowable amount of storage charges to be charged per twenty-four-hour period or a fraction thereof. Each new twenty-four-hour period begins at 12:01 a.m.
TOW VEHICLE
Only those vehicles equipped with a boom or booms, winches, slings, tiltbeds, wheel lifts, or under reach equipment specifically designed by its manufacturer for the removal or transport of automobiles as defined herein.
TOWING CONTRACTOR
A licensed individual or entity placed upon the rotating list that performs towing services for Sparta Township.

Interested towing companies may submit information to provide towing services to the Sparta Township Chief of Police for consideration. Each towing contractor must be able to meet the following conditions:
a. 
All towing contractors selected to serve on a rotational basis must guarantee the availability of all services to Sparta Township seven days a week, 24 hours a day, including all holidays. In this respect, a towing contractor shall immediately respond to any type of towing emergency road service or storage call with the appropriate vehicle and/or equipment within 20 minutes after receipt of telephone notification from the Police Department's dispatcher or police officer. Unless heavy or unusual traffic conditions or inclement weather within the Township prevent a towing operator from arriving at the scene within 20 minutes, failure to respond within the time frame shall be considered a breach of this chapter. In the event that a towing operator fails to respond within 20 minutes from the time of the call, the Police Department reserves the right to contact the next available towing operator on the rotational list and utilize its services. Additionally, it must have appropriate personnel available to release a towed vehicle to its owner at a minimum of Monday through Friday, except holidays, from 8:00 a.m. to 5:00 p.m. subject to the appropriate authorization of the Sparta Township Police Department.
b. 
All towing contractors must comply with all terms of this section, including the hold harmless and insurance requirements, set forth in Subsections 7-38.11 and 7-38.12 herein.
c. 
In times of emergencies and/or natural disasters, Sparta Township reserves the right to contact other towing service operators who may not be on the rotational list.
d. 
The owner of a vehicle involved in an accident shall have the right, if he/she so desires, to designate a towing operator of his/her choice as long as public safety needs do not dictate otherwise.
e. 
Employees of the towing contractor, in responding to a call, shall request and be afforded police assistance during the course of providing towing, emergency road services or removal of abandoned or accident vehicles when such employees find it necessary to turn around, back up, tow in the opposite direction of traffic or cross the median.
f. 
A towing contractor shall not permit a vehicle to be removed from the site of a vehicular accident, the scene of a crime or any other instance or situation without the prior approval and permission of a police officer and/or superior at the scene.
g. 
Towing contractors shall agree to comply with the following requirements to be eligible for placement and inclusion on the towing contractors rotational list:
1. 
Once a towing contractor is approved for the rotational list, the approval shall not be assigned, leased, sublet, or otherwise disposed of by towing companies, except with the prior written approval of the Sparta Township Police Chief or his designee.
2. 
The towing contractor shall agree to provide upon request current lease agreements for any storage lot/facility used, and towing contractors agree to notify the Sparta Township Police Department in writing if any of the enclosed items are changed or altered. Failure to comply with this provision will result in the immediate cancellation of an agreement.
3. 
The Sparta Township Police Department will have the right to perform a background check of the towing contractor owner(s), employees, and/or officers, and the conviction of a high misdemeanor of any such principals will disqualify the towing contractor and its employees from eligibility for inclusion on a rotation wrecker list, unless waived by the Chief of Police.
4. 
The drivers' license numbers, names, dates of birth of all towing contractor drivers; the registration numbers of the towing contractor's vehicles to be used, their descriptions and functioning mechanisms (i.e., rollback, heavy duty, light wrecker, etc.) and appropriate permits (i.e., special lights) shall be provided in accordance with Title 39, Motor Vehicles and Traffic Regulation, of the New Jersey Statutes Annotated.
5. 
The Chief of Police or his/her designee may request evidence of towing contractor vehicle weights, in accordance with N.J.S.A. 39:3-84.1.
6. 
Upon inspection, vehicles will have the name, address, and telephone number of the actual business displayed on such vehicles in accordance with N.J.S.A. 39:4-46.
7. 
The towing contractor must be within legal traveling and response time of 20 minutes upon being dispatched by the Sparta Township Police Department. Exceptions for unusual traffic conditions will be recognized.
8. 
Towing contractors shall have at least one year of experience in the towing of vehicles and must abide by all requirements hereof.
9. 
Towing contractors must maintain a recordkeeping system as required by the Sparta Township Police Department and the laws of the State of New Jersey.
10. 
It shall be the responsibility of all towing contractors to provide all motorists utilizing the towing operator's services with a written schedule of fees which lists in full all fees to be charged for towing, storage and road service within Sparta Township. Towing contractors shall prepare an invoice for towing charges of each vehicle towed, consistent with the State of New Jersey fees where applicable.
11. 
Records of towing contractors pertaining to towing vehicles within Sparta Township shall be maintained and available upon request to the Sparta Township Police Department for a period of four years.
12. 
All drivers for the towing contractor shall be a minimum of 18 years of age or older.
13. 
Towing contractor agrees that Sparta Township may make periodic drivers' license checks, registration checks, background checks, and insurance checks.
14. 
Towing contractor covenants and agrees to comply with all federal laws, state laws and local ordinances governing operation of vehicles, towing of vehicles, and storage areas.
15. 
Complaints of any kind relative to service, overcharging, theft of parts, damage to towed or stored vehicles and the like shall be referred to the Chief of Police for investigation. Such complaints may be cause for imposition of penalties decided on by the Chief of Police.
16. 
The owing contractor shall accept from any owner, or his representative, methods of payment in the form of cash, certified check, money order and at least one major credit card. The contractor is not obligated to accept personal checks for payment.
17. 
Towing contractors must provide the Sparta Township Police Department a detailed listing of the equipment to be utilized for towing services in Sparta Township. The listing shall include the following information:
Type of vehicle(s), storage location for vehicle(s), and whether vehicle(s) is owned or leased. All leased and rented equipment must be permanently located at the contractor's place of business or residence if in conformity with state law, federal law and local ordinances. Each piece of equipment must meet the minimum standards set forth herein. Equipment which does not meet these minimum standards shall not be used during the term of an agreement. The towing contractor will be solely responsible for the safety, maintenance and operation of each piece of equipment utilized or required during the term of an agreement.
The classification of towing vehicles is as follows:
(a) 
Light-Duty Tow Truck - Used to tow and recover small light-duty vehicles up to 10,000 pounds.
(b) 
Medium-Duty Tow Truck - Used to tow and recover small commercial type vehicles up to 26,000 pounds or light-duty vehicles unable to be recovered with light-duty tow truck or flatbed.
(c) 
Heavy-Duty Tow Truck -
(1) 
Commercial manufactured truck with wrecker body.
(2) 
Minimum GVWR 26,001 pounds.
(3) 
Used to tow and recover commercial type vehicles over 26,001 pounds GVW or smaller vehicles unable to be recovered by other means.
(d) 
Hydraulic Flatbed Car Carrier - Commercial motor vehicle designed exclusively to transport motor vehicles by means of bodily winching motor vehicles from roadway level up onto hydraulic bed for transporting purposes.
18. 
Towing companies shall also agree to the following requirements to be considered for inclusion on the towing contractors rotational list:
(a) 
Towing contractors shall carry on or within each vehicle containers of Speedi-Dri or an acceptable absorbent substitute for spreading on and around spilled antifreeze or other automobile fluids at the scene to safeguard against slippery road conditions for police and first aid vehicles, passing vehicles and similar vehicles. The Speedi-Dri or an acceptable substitute will later be dissipated in accordance with hazardous waste disposal regulations. In the event that the towing contractor does not do so and the Township has to undertake cleanup of the spill then it will bill the towing contractor for the costs associated with same.
(b) 
Towing contractors shall be responsible for cleanup of all broken glass and debris at the scene of accidents or when called to a scene in accordance with N.J.S.A. 39:4-56.8. Each and every towing contractor vehicle will carry a broom and shovel.
(c) 
Towing contractors must ensure that all of their authorized agents agree to follow the instructions and/or orders of the police officer from the Sparta Township Police Department at towing scenes.

It shall be the Chief of Police or his/her designee's responsibility to establish a towing contractors' rotating service list. The Police Department shall call the towing operators in sequential order as set forth by the Chief or his designee so that each towing operator will be given the opportunity to respond to individual calls as received by the Township. The Police Department shall have the right to call the next towing contractor on the list should a towing contractor fail to respond to a call within 20 minutes or if the first operator called cannot be reached by telephone or advises that he/she is unable to respond. The towing contractor shall provide a valid and working afterhours contact number as well as any alternate numbers to be contacted.

a. 
When a towing company is denied being added to the rotating list by Sparta Township, the towing company may request a hearing by the service of a notice requesting a hearing. Said notice shall be served on the Sparta Township Clerk and prior to at the next regularly scheduled meeting of the governing body after the action regarding the application. A hearing date shall be set which shall be no less than seven days or more than 30 days from the date that the governing body met.
b. 
Proceedings for the suspension or revocation of a towing company from the Township rotating list shall be initiated by the service of a notice of charges proffered against the towing contractor. Said notice shall be served by the Chief of Police or his/her designee, either personally or via certified mail, return receipt requested, and shall contain a date, time and place for a hearing to be held by the governing body of Sparta Township. Said hearing shall be scheduled no less than seven days nor more than 30 days after the notice of the proposed suspension or renovation shall be served upon the towing company. The towing company shall have the right to file an answer to the notice and to appear in person, or be represented by counsel, and give testimony at the place and time fixed for the hearing.

a. 
The rates of towing contractors within Sparta Township shall be in compliance with those rates established by the Garden State Towing Association, www.gsta.org, and rates are subject to the following requirements:
1. 
The rates applicable to towing services performed under the guidelines of the State of New Jersey shall be posted in a conspicuous place, visible to the public, at the towing contractor's facilities.
2. 
Agencies engaged in towing for the Sparta Police Department shall not charge a fee in excess of the following enumerated rates. These tariffs are annually recalculated based upon a random sampling of reasonable fees utilized by commercial and municipal towing agencies. The Sparta Township Police Department has determined that the average rate per category based upon the Association's census is reasonable and is acceptable. Please regularly review these rates on www.gsta.org, as changes may be made and are as provided by the Sparta Township Police Department.

a. 
The Sparta Township Police Department will not be responsible for any charges due or owing to towing contractors except for the towing of Township vehicles, nor will it assist the towing contractors in collecting any charges. Specifically, the Township will not be responsible to reimburse towing contractors for towing services in connection with towing of vehicles which are abandoned or disabled, or from which towing contractors are unable to obtain towing service fees from vehicle owners. However, the Township will make good faith efforts to auction abandoned vehicles and other vehicles for which towing contractors have not received payment for services under any agreement consistent with appropriate state law. In the event that an auction occurs on such vehicles and money is received, the towing contractors shall be paid their towing fee for such vehicles from the proceeds of the auction, provided that the amount received at auction is equal to or greater than the towing fees due. If that is not the case, towing contractors shall receive the auction proceeds and Sparta Township shall have no obligation to pay towing contractors any difference due in accordance with N.J.S.A. 39:10A-5.
b. 
In cases where the Sparta Township Police Department mistakenly directed that a vehicle be towed or has acted on incorrect information furnished by other official sources, the towing contractor may be reimbursed by Sparta Township for minimum towing fees only, as stipulated by New Jersey statutes.
c. 
In the event the Police Department requires a vehicle involved in a crime or a fatal accident to be held for investigation, the Chief of Police may, after review of all the circumstances, require waiver of storage fees, or a portion thereof, incurred up to the date of release.

a. 
The towing contractors grant the Sparta Township Police Department the right to inspect the proposed vehicle impound area at any time chosen by the Police Department without prior notice to or acceptance by the towing contractors.
b. 
The land area used for storage of vehicles shall be paved or stoned, and the area shall facilitate reasonable towing distance.
c. 
All towing contractors are prohibited from piling stored vehicles or parking towed vehicles on public streets and sidewalks.
d. 
Sparta Township reserves the right during an emergency to designate temporary areas owned or leased by the Township for storage of disabled vehicles in said area at the direction of the Chief of Police or his designee.
e. 
The Sparta Township Police Department shall have access to any part of the impound area at any time, day or night, for the purpose of inspection and/or investigation. This shall include indoor and outdoor areas.
f. 
The storage facility must be capable of storing a minimum of 10 automobiles and one tractor and trailer. There must be at least 800 square feet available to hold vehicles impounded by the Police Department.
g. 
The storage facility must be within the limits of the Township or within a contiguous municipality so as to facilitate reasonable towing distances.
h. 
The storage facility must be fully enclosed by a sturdy fence having a minimum height of six feet with at least one lockable gate for ingress and egress.
i. 
The storage facility must be lighted from dusk until dawn.
j. 
The storage facility must be in area legally zoned for such use.
k. 
The storage facility must be available to receive vehicles 24 hours per day, 365 days per year. It must be open to the public to recover vehicles stored there on weekdays during normal business hours and for four hours on Saturdays. The applicant must specify the hours during which the facility will be open on Saturdays. The tow contractor is not required to be open to the public on Sundays.
l. 
Each application must be accompanied by proof of ownership or lease of the storage area.
m. 
The tow contractor is responsible for ensuring the proper and safe storage of all vehicles towed pursuant to this chapter. The tow contractor is liable for any damage to such vehicles while in transit or while stored at the storage facility.

In all dealings with the public in connection with an agreement, representatives of the towing contractor are expected to act in a professional manner at all times and be courteous and respectful to members of the public. While members of the public, especially those whose vehicles may have been towed or impounded, may at times resort to strong language, threats or unbecoming behavior that may be directed to the representatives of the towing contractors, such towing contractor representatives are expected to exercise restraint and shall not respond in kind, thereby causing an unfavorable reflection on their business. If such instances occur, the Sparta Township Police Department should be contacted to keep the peace and provide advice on legal proceedings, if requested.

The owner of any vehicle towed shall have the right to remove personal property belonging to him from the stored vehicle unless a "police hold" is marked on the towing form upon mutual agreement of the towing contractor and the owner of the vehicle.

a. 
Towing contractors shall be responsible for any damage occasioned to utility poles, guide wires, telephone lines, etc. damaged in their recovery of vehicles.
b. 
Towing contractors will indemnify and hold Sparta Township harmless from any and all claims for personal injury or property damage against Sparta Township arising out of the operation of any towing services or repair services performed under their respective agreements. Towing contractors will further defend Sparta Township at the expense of the towing contractors in connection with any claim, demand, suit or action brought against the Township and arising out of the operation of any towing, garage or repair services under any agreement. Said indemnification shall include but not be limited to the defense of all lawsuits relating to the towing of any vehicle by any party, the payment of any judgments relating thereto against the Town, and the cost of the suit, including investigation costs.
c. 
Each towing contractor who is on call will secure the first towed vehicle of the month that they are called out to and requires a need to store, to the gated and enclosed storage facility at 5 West Shore Trail or alternate municipal storage location as may be designated. (This does not include large vehicles, with multiple axles.) The same storage rates will apply for the Township storage facility as apply to private towing hauler storage facilities.

Each towing contractor shall provide proof of insurance to Sparta Township as follows:
a. 
Insurance coverage shall indemnify Sparta Township and the public against any loss due to injuries, accidents or damages of any character whatsoever where such damage is the result of an act of omission on the part of towing contractors, their agents or employees, in or due to the execution of the work called for under the respective agreements between Sparta Township and towing contractors.
b. 
On all liability policies required of towing contractors, Sparta Township shall be named as an additional insured, and insurance certificates shall indicate such coverage.
c. 
All insurance required shall contain a clause indicating that the Sparta Township Police Department at 65 Main Street, Sparta, New Jersey shall be notified of any changes, cancellations, etc.
d. 
Towing contractors are required to purchase and maintain comprehensive general liability insurance, comprehensive automobile liability insurance, and worker's compensation insurance with limits of not less than those set forth below. Failure to provide and continue in force such insurance as required below shall be deemed a material breach of agreement and shall result in immediate termination of any agreement for towing services.
1. 
Comprehensive general liability insurance. The limits of liability shall be not less than $500,000 for combined single limits (bodily injury and property damage) per occurrence and aggregate, including premises, operations and products/completed operations.
2. 
Automobile liability insurance. The limits of liability shall be not less than $500,000 for combined single limits (bodily injury and property damage) per occurrence. Note: Liability insurance policies shall be specifically endorsed to provide collision insurance for vehicles in tow.
3. 
Worker's compensation insurance. Statutory coverage including liability coverage with a limit of at least $100,000. Excess umbrellas in the amount of $1,000,000 giving protection in excess of $500,000; general and automobile liability coverage.

Towing contractors shall not make any repairs to any vehicles towed or removed by it provided for hereunder without receiving written authorization of the owner thereof or its authorized agent.

a. 
The Chief of Police or his designee is hereby authorized to establish reasonable rules and regulations for the supervision, inspection and safe operation of tow trucks, wreckers and other related vehicles and equipment in accordance with the standards outlined in this section. The Chief or his designee shall maintain due vigilance over all towing operators to make certain that the tow trucks and other related vehicles and equipment are maintained in a safe working condition for transporting and hauling disabled vehicles. The Chief or his designee shall have the right, at all times, to inspect all towing vehicles and related equipment which perform services pursuant to this section.
b. 
At any time should the Chief or his designee determine that the vehicles and/or equipment being used are unsafe, they shall have the power and authority to direct the immediate correction or repair of any automotive defect, malfunction or violation of motor vehicle regulations within a specified period of time to be determined by the Chief. The Chief of Police or his designee is authorized and empowered to establish and transmit from time to time to all towing operators on the rotational list, such additional rules and regulations not inconsistent with the provisions of this section as may be reasonable and necessary in carrying out the provisions of this section.
