All items intended for collection, disposal or donation are
to be placed on the city's right-of-way, immediately adjacent
to, but not on or obstructing public streets, alleys, lanes, fire
hydrants, sewers, catch basins, sidewalks or walkways, in a neat and
orderly manner. Items may be placed immediately in front of the property
from which it was generated and on no other location or property.
A. Collection; disposal. It is the property owner's responsibility
to arrange for the proper and prompt disposal of these items from
the appropriate disposing entity. All applicable solid waste codes
must be adhered to. Owner is fully responsible for all items and any
cleanup or pickup costs associated with said items.
B. Donations. It is the property owner's responsibility to manage
donated items, "free stuff" on a daily basis. Items cannot be left
out overnight and must be clearly marked as "free". Owner is fully
responsible for all items and any cleanup or pickup costs associated
with said items. Donated items displayed for a period not to exceed
three days.
C. Notice and cost.
(1) The written notice shall be served upon the owner, either personally
or by first-class prepaid mail, addressed to the last known address
of the owner as said address is shown on the records of the Assessor.
If the name of the owner or his last known address cannot be ascertained,
notice shall be given by posting in a conspicuous place on the adjoining
land.
(2) If the owner shall fail to comply with the notice within 24 hours,
the City shall pickup and properly dispose of identified items at
the owner's expense.
(3) Owner will be billed all costs associated with time, equipment and
disposals fees. Repeat offenders will be assessed a fine not to exceed
100% of costs to manage administrative costs.
