The fire limits of the City of Bismarck shall be known as: All lots or parts of lots on East Main Street and on Cedar Street of this City in blocks numbered 3, 9, 14 and 21, and block number 3, Latonius Addition to the City of Bismarck, and all lots or parts of lots fronting on West Main Street in blocks 8, 15 and 20 of this City and it shall be unlawful to construct any building, the outer walls of which shall be constructed of stone, brick or concrete within said limits.

Hereafter it shall be unlawful for any person, firm, company or corporation for any purpose, without obtaining special permission from the Mayor and Board of Aldermen, to construct, build or place, or cause to be constructed, built or placed, any edifice, building, structure or shed, the outer walls of which are in whole or in part made of wood, within that part of the City of Bismarck embraced within the fire limits as described in Section 500.010.

Whenever any person, firm, company or corporation shall design to construct, build or place any wooden building within the fire limits of the City of Bismarck, as hereinbefore described, such person, firm, company or corporation shall file with the Mayor and Board of Aldermen an application, in writing, setting forth the location, size and manner of construction of the proposed building and the purpose for which it is to be used, such application must be accompanied by the written consent of all persons owning property or residing or otherwise occupying property within the block where such building is proposed to be constructed or placed upon the filing of such written application and consent of the property owners and residents as aforesaid, the Board of Aldermen, by resolution, may authorize the construction or erection of the designed wooden building within said fire limits; provided, that the names of members voting for or against said resolution shall be entered upon the journal and the votes of a majority of all members elected to the Board of Aldermen shall be necessary for the passage.

Whenever any wooden building shall be constructed, built or placed within the fire limits of this City contrary to the provisions of this Article, it shall be the duty of the Mayor to issue an order requiring the owner, occupant, person in charge or builder thereof to cause such building to be taken down or removed outside the fire limits. If the person so notified shall refuse or neglect for the space of ten (10) days to comply with the requirements of the order issued by the Mayor as herein provided, then the Mayor shall cause such building to be taken down or removed beyond the fire limits, and the expense incident thereto may be recovered of the owner of such building by suit in any court of competent jurisdiction.

No person shall set up or use a stove or furnace, the top or any side of which shall be within two (2) feet of any part of the woodwork or the wall or partition of any building without protecting such woodwork with a metallic or other non-combustible covering so as to effectually prevent the same from catching fire from such stove or furnace; and every stove or furnace so set up shall be placed on a platform of brick or sheet-iron or other non-combustible substance, extending at least four (4) inches in every direction beyond the part of the lower plate which fronts the door of the stove or furnace.

No person shall permit a stove pipe to project or pass through the roof, wall or window of any building, nor shall any person owning or occupying a house in the City of Bismarck permit a stove pipe to run through any wooden wall or partition, unless the same shall enter a stove or brick flue, and is at least four (4) inches distant from any woodwork. All stove pipes shall enter into stone or brick chimneys or flues, and all chimneys or flues shall be built of brick, stone or other fireproof material, and shall be smoothly plastered inside from top to bottom.

The owner or occupant of any house, store, shop or other building in this City shall cause the flues or chimneys thereof to be swept or burnt out as often as may be necessary to keep the same clean; provided, that chimneys and flues shall be burnt out only in the daytime and when rain is falling, or when the roof is covered with snow.

No person shall carry or cause to be carried within any street or public place of this City, any burning coal, coals, wood or fire boards, unless the same be secured in a covered vessel made of non-combustible material.

No lighted candle or lamp shall be used in any stable, building, or other place where hay, straw, hemp, cotton, flax, rushes, shavings, gunpowder or other combustible materials are stored or lodged, unless the same is well secured in a lantern.

No person shall have, put or keep any hay, straw, cotton, hemp or wood shavings in a stack or pile without having the same securely enclosed so as to protect them from flying sparks of fire.
