Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use in the township.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in R.S. 39:4-138, any other New Jersey statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY-NO PARKING signs are displayed. The chief of police or, in his absence, the ranking officer is authorized to declare an emergency and to direct the posting of EMERGENCY-NO PARKING signs when weather conditions, accidents, fires or other emergent situation, dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the EMERGENCY-NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV on any day (except Sundays and public holidays) upon any streets or parts of streets described in Schedule IV of Chapter 7A.

a. 
Where an application has been filed under Section 13-1006 (Special Use Permits) for a large planned event or a notice has been received by the township under Section 3-12 et seq. (Special Equestrian and Golf Events), the Chief of Police, or, in his absence, the ranking officer, is authorized to place TEMPORARY - NO PARKING signs at locations deemed necessary in his or his designee's reasonable discretion, to protect the safety of the general public. Notification that the TEMPORARY - NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
All of the regulations set forth herein relating to the regulation of parking and traffic during planned events shall apply to the following county roads: (1) Washington Valley Road; (2) Pottersville Road; (3) Lamington Road; (4) Rattlesnake Bridge Road; and (5) Burnt Mills Road.

In the event of a snowfall, which results in the public streets, highways or thoroughfares to be covered by snow where snow plowing and/or de-icing is necessary, it shall be unlawful for any vehicle to be parked on any public street, highway or thoroughfare in the Township of Bedminster. This parking restriction shall remain in effect after the snow has ceased until the roadways have been cleared of snow to the extent that parking will not interfere with the normal flow of traffic. Vehicles in violation may be subject to a summons and towed away at the owner's expense. Signage denoting this parking prohibition shall be placed along all public streets, highways or thoroughfares which enter the township, at its entrance point into the township, and at other designated areas as determined by the chief of police or the principal public works manager.

a. 
No person shall park a vehicle at any time upon any real property owned by the Township of Bedminster, except within a designated parking space in identified parking areas, or within specified locations pursuant to special permission granted by the governing body of the Township of Bedminster, or its designee, with notice to the Township Police Department.
b. 
No person shall park a vehicle at any time within any designated parking space upon any real property owned by the Township of Bedminster which is identified as reserved for use by the Township Police Department, Fire Department, or township employees, unless otherwise authorized by the township.
c. 
In addition to being subject to the penalties provided in this chapter, any vehicle parked in violation of this subsection shall be deemed a nuisance and menace to the safe and proper regulation of traffic, the health and safety of citizens, and the protection of adjacent buildings and structures, and any police officer may order the removal of such vehicle to be towed at the owner's sole expense, with such reasonable costs of removal and storage being required to be paid before regaining possession of the vehicle.

Vehicles over the registered gross weight indicated are hereby excluded from the streets or parts of streets described in Schedule V of Chapter 7A, except for the pickup and delivery of materials on such streets.

Regulatory and warning signs shall be erected and maintained to effect the gross weight restriction set forth above. These signs shall be erected and maintained by the principal public works manager on the recommendation of the township engineer in consultation with the chief of police and in accordance with a map to be prepared by said township engineer.

Pursuant to the provisions of R.S. 39:4-140, the streets or parts of streets described in Schedule VII of Chapter 7A are hereby designated as Through Streets. STOP signs shall be installed on the near right side of each street intersecting the Through Street except where YIELD signs having sides thirty-six (36") inches in length are provided for in the designations.

The streets or parts of streets described in Schedule XVII and Schedule XVIIa of Chapter 7A shall have the speed limits designated in such schedules.
Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits as authorized by the Department of Transportation.

Pursuant to Chapter 227 of the Public Laws of 1983 (N.J.S.A. 40:48-2.46) fire lanes are hereby established upon those portions of the parking yards and parking places or parts thereof which are open to the public or to which the public is invited as described in Schedule XVIII of Chapter 7A.

No person shall park a vehicle at any time upon any portion of a fire lane established by this section.

Appropriate curb and pavement markings together with signs prohibiting parking in fire lanes shall be designated and installed in order to outline the areas where parking is prohibited. Said markings and placement of signs shall be approved by the fire protection subcode official. Signs and markings shall conform to the specifications as prescribed by the New Jersey Department of Transportation and The National Manual on Uniform Traffic Control Devices indicating "No Parking - Fire Zone." The respective owners of the premises outlined in Schedule XVIII shall assume full responsibility and expense relative to the said markings and signs and shall undertake and complete same in accordance with an approved plan within a period of 10 days from the date of written order to do so by the fire protection subcode official and shall properly maintain the same. Any owner of premises required to provide markings and signage for fire zone regulation and who shall fail to provide and maintain such markings and signage shall be subject to the penalty as set forth hereinafter.

In accordance with the provisions of N.J.S.A. 40:48-2.46 and 39:4197.5, no person shall park any vehicle in a handicapped designated parking stall in the locations referred to in Schedule XIX of Chapter 7A of the Revised General Ordinances of the Township of Bedminster, 1984, as heretofore supplemented and amended, unless the said vehicle displays the official state handicapped license plate or has affixed thereto the special identification certificate or insignia issued by the New Jersey Division of Motor Vehicles pursuant to Title 39 of the Revised Statutes of New Jersey and also unless such vehicle is operated by a handicapped person or a passenger in the said vehicle is handicapped and either the operator or passenger is the holder of the said special identification certificate.
Any vehicle parked in a parking stall reserved for handicapped drivers which does not display the official state handicapped license plate or special identification certificate or insignia referred to above shall be presumed to have been parked in such a stall unlawfully.

All signage and markings for handicapped parking and the installation of the same shall conform to the specifications as prescribed by the New Jersey Department of Transportation and the National Manual on Uniform Traffic Control Devices. Any owner of premises required to provide parking stalls and signage for handicapped designated vehicles and who shall fail to provide and maintain such stalls and signage shall be subject to a penalty as set forth hereinafter.

Any vehicle parking in violation of this section shall be deemed a nuisance and menace to the safe and proper regulation of traffic, the health and safety of citizens and protection of adjacent buildings and any police officer may provide for the removal of such vehicle. Every person convicted of a violation of a provision of this section or any supplement thereto shall be subject to a penalty of $250 for the first offense and for a second or subsequent offense shall be subject to a minimum penalty of $250 and up to 90 days community service on such terms and conditions as the court may deem appropriate, or any combination thereof.

No vehicle shall be parked on the streets or parts of streets designated in Schedule XX of Chapter 7A during the hours designated in said schedule, unless:
a. 
The vehicle is owned or operated on a regular basis by a resident of that street and the vehicle displays a current residential parking permit exhibiting a clearly marked expiration date on the driver's side sun visor in such a manner as to be readily examined by a regular or auxiliary police officer; or
b. 
The vehicle falls under one of the exemptions to the permit parking requirement set forth in subsection 7-14.2.

The following vehicles shall be exempt from this parking permit section:
a. 
Contractors, service and delivery vehicles. Contractors, service and delivery vehicles bearing the name and address of a commercial business may park without a permit during the time they are rendering service to a residence within the permit parking area.
b. 
Emergency vehicles. Emergency vehicles, police vehicles, municipal vehicles and public utility vehicles may park without a permit during the time they are rendering service to a residence within the permit parking area.
c. 
Temporary permits. Vehicles having been issued a current temporary parking permit, which shall be clearly displayed on the driver's side sun visor in such a manner as to be readily examined by a regular or auxiliary police officer.

The township committee may amend Schedule XX at any time to include any streets or parts of streets primarily serving residential areas or to remove such streets or parts of streets as a designated permit parking area. Such inclusion in or removal from Schedule XX shall be approved by Ordinance #2009-025 of the township committee after an appropriate study has been performed to investigate the percentage of parking spaces utilized by nonresidents of the streets or parts of streets being considered for inclusion or removal. The township committee shall implement permit parking along any streets or parts of streets only if no other plausible or practicable parking restriction as contained in this chapter can be imposed under the circumstances to regulate the free flow of traffic along said streets or parts of streets.

An application for a resident parking permit under this section shall be made in writing on forms provided to the township police department, and shall be accompanied by a fee of $10 for the first annual permit with a five ($5.00) dollar per permit annual renewal fee to cover the costs of administering and enforcing this section. The applicant for each residence may obtain up to a maximum of two resident parking permits per household.
Resident permits shall only be granted as follows:
a. 
Persons who are residents on said street or portion thereof upon which parking is restricted by this section shall be issued a permanent permit valid for the vehicle owned or principally operated by such person. There shall be a limit of two permits which may be issued to any one household assuming valid proof of residency can be presented. At the time of application for said parking permit, the applicant must provide a valid registration for each vehicle for which a permit is sought. In addition to a valid registration, any tenant applying for a parking permit must show a current lease for a residence located on the street or portion thereof upon which parking is restricted. In no event shall a parking permit be given for a period to exceed the term of such lease.
b. 
If any permit becomes lost or destroyed, such permit shall not be replaced by the police department until the next annual permit renewal.

An application for a temporary parking permit under this section shall be made in writing on forms provided to the Township Police Department, and shall be accompanied by a fee of $2 to cover the costs of administering and enforcing this section.
a. 
Bedminster Terrace. Temporary permits for Bedminster Terrace shall only be granted as follows:
1. 
Persons who are residents on Hillside Avenue, south of its intersection with Steeplechase Lane, and on Bedminster Terrace shall be issued a temporary permit valid for a vehicle, upon filing of the required form, along with valid proof of residency, including a copy of a current lease for a residence located on said portion of Hillside Avenue or Bedminster Terrace. At the time of application for said parking permit, the applicant must affirm that the vehicle(s) are properly registered with the applicable state.
2. 
Temporary permits shall be valid for one continuous 24 hour period, which expiration shall be designated on the permit by the issuing authority.
3. 
Temporary permits shall not be issued for more than one consecutive 24-hour period.
4. 
Not more than six temporary parking permits shall be issued and valid at any time, regardless of the number of eligible residents who may hold such permits. Temporary parking permits shall be issued on a first-come, first-served basis.
5. 
In the case when all six temporary parking permits have been issued, a resident of Hillside Avenue, south of its intersection with Steeplechase Lane, and on Bedminster Terrace may privately seek a temporary transfer of a Bedminster Terrace resident permit for one continuous 24 hour period. Any such temporary transfer of a resident permit shall have attached to said permit a notice from the permit owner identifying the expiration of the 24-hour period, clearly marked in such a manner as to be readily examined by a regular or auxiliary police officer. No fee or payment shall be charged or collected by the resident permit owner for providing such temporary transfer.

a. 
No person shall:
1. 
Copy, reproduce or otherwise create a resident parking permit or visitor parking permit or temporary parking permit authorized by this section;
2. 
Create or facilitate the creation of a facsimile or counterfeit resident or temporary parking permit;
3. 
Display or use a resident or temporary parking permit knowing the same to have been copied, reproduced or otherwise created in violation of (1) and (2) above; and
4. 
Furnish false information or fraudulent documents in connection with an application for a resident or temporary parking permit.
b. 
Any person violating the provisions of this section shall be punished by a fine not to exceed $300 and/or imprisonment for not more than 10 days.

A resident parking permit or temporary parking permit does not exempt a resident from obeying all traffic rules and regulations including, but not limited to, posted "no parking" areas, distance from stop signs and fire hydrant regulations.

Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, oil fills, any grass area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.

Unless another penalty is expressly provided by New Jersey Statute or provided in the section or sections violated, a violation of any provision of this chapter, upon conviction, shall be subject to the penalties set forth in Section 1-5 of Chapter 1 of this Code.

No person or entity shall obstruct the free and lawful passage of pedestrians and vehicles on the public sidewalks, streets, highways, thoroughfares or rights-of-way within the Township of Bedminster by placing thereon any kind of permanent or temporary structure or object of any nature whatsoever, without prior approval being granted by the township.

No person or entity shall plow, shovel, throw, deposit, or otherwise place any snow or ice which has accumulated upon private property into or upon any public sidewalk, parking area, street, highway or thoroughfare, or any other public right-of-way within the Township of Bedminster, including the township's "hike and bike" trails, unless specifically granted permission by the township.

No person or entity shall blow, rake, throw, deposit, or otherwise place, or direct, instruct, or allow any other person or entity on his/her behalf, to blow, rake, throw, deposit, or otherwise place, any grass, brush, leaves, branches, landscape mulch, or the like into or upon any public sidewalk, parking area, street, highway or thoroughfare, or any other public right-of-way within the Township of Bedminster, including the township's "hike and bike" trails, unless specifically granted permission by the township.

The owner of any permanent or temporary structure or object of any nature whatsoever, including portable sports equipment and apparatus, which is deemed to be in violation of this Section 7-18, which constitutes a safety hazard in the opinion of the chief of police, or his/her designee, shall remove the same within 24 hours of receipt of written notice of such violation signed by the chief of police, or his/her designee. If any owner shall fail to remove such obstruction within the time required, he or she shall be liable under the penalties set forth in Section 1-5. In addition thereto, any such obstruction, if not removed within the time required, may be removed by the township department of public works, under the direction of the chief of police or the principal public works manager, at the sole expense of the owner.
