Chapter 235: Park and Community Building Regulations

Section 235.010 Public Use Season Defined.

Peak season public use shall be defined as the period between April 1 and October 31.

Off-season public use shall be defined as the period between November 1 and March 31.

Section 235.020 Designation Of Public Use Hours.

During the peak season, public use hours at Sundale Park shall be 6:00 A.M. to 11:00 P.M. Park shall be closed to public use between the hours of 11:00 P.M. and 6:00 A.M.

During the off-season, public use hours at Sundale Park shall be 8:00 A.M. to 7:00 P.M. Park shall be closed to public use between the hours of 7:00 P.M. and 8:00 A.M.

Section 235.030 Use Restrictions.

No parking, driving or trespassing shall be allowed in Sundale Park during closed hours.

Section 235.040 Violation Of Provisions.

Any person violating any of the provisions of this Article shall be deemed guilty of an ordinance violation and punished as set out in Chapter 100, Article III, of this Code.

Section 235.050 Severability.

The Sections, paragraphs, sentences, and clauses of this Article are severable; and if any section, paragraph, sentence, or clause of this Article is declared to be unconstitutional by a court of competent jurisdiction, such unconstitutionality shall have no effect upon the remaining sections, paragraphs, sentences and clauses of this Article.

Article II Bismarck Community Building Regulations

Section 235.060 Request Procedures And Fee Schedule.

Any individual, group or party desiring to rent the Bismarck Community Building shall first fill out a "REQUEST FOR USE OF THE BISMARCK COMMUNITY BUILDING" form and a "HOLD HARMLESS AGREEMENT," copies of which are attached hereto and incorporated herein. Prior to receiving a key to the community building, the requesting individual, group or party shall first pay a fee of one hundred dollars ($100.00) for each day the community building is rented. An additional fifty dollars ($50.00) deposit shall also be required. The deposit shall be returned upon verification that the building was not damaged and was left in a clean condition.

Section 235.070 Obligations And Rules To Be Followed.

Any individual, group or party renting the community building shall observe the "Rules for Bismarck Community Building," a copy of which is attached hereto and incorporated herein.[1]

Section 235.080 Severability.
