A.
Property boundary fences may be constructed on a common property line, provided that a written agreement, contract, or covenant between the property owners acknowledging joint ownership and a maintenance arrangement accompanies the application for a construction of fence permit. A property boundary fence may not be constructed within two (2) feet of a common property line without such an agreement. Further, any adjoining fence constructed subsequently must also be located at least two (2) feet from the property line. All fences so constructed shall meet the following requirements:
1.
Fences shall not exceed eight (8) feet in height.
2.
Fences shall not be constructed out of barbed wire or razor wire.
3.
Fences constructed along any street line or other public way shall maintain sight distance at all street intersections as contained in the Bismarck City Code.
4.
Fences constructed along any street line or other public way shall be constructed at least two (2) feet from the property line.
5.
A ten dollar ($10.00) application fee shall be submitted with any application for construction of a fence permit under this Section.
