The City of Bismarck, Missouri, hereby adopts the following Inflow and Infiltration Plan as outlined in the following Sections of this Chapter and as defined in the attached document: "Report Defining An Inflow/Infiltration Plan For The City Of Bismarck, Missouri," which is attached hereto and incorporated herein.[1]

Any discharge of rainwater/groundwater to the Sewage Collection System of the City of Bismarck, Missouri, via downspouts, building sewer cleanouts, basement drains, or in any other manor,[1] is hereby declared to be a public nuisance and is prohibited as provided by Section 215.010 of the Municipal Code of the City of Bismarck, Missouri. Furthermore, all documented cases of nuisance discharges into the sewage collection system shall be brought to the attention of the Board of Aldermen by the City's designated Sewer Superintendent.

The residents or property owners are entitled to "due process," including: a written notice of the alleged nuisance and the time the City has allotted for its complete abatement. Should the resident or owner decide not to abate, then they are entitled to a hearing before the Board of Aldermen for a determination of whether a nuisance does or does not exist, the abatement process and a time frame associated therewith.

The Mayor shall, or shall direct and ensure that his/her administrative assistant, establish an official inflow and infiltration file to be located and stored within the Bismarck City Hall. Said file shall contain, at a minimum, all reported sanitary sewer overflow documents, along with all reports relative to inflow and infiltration, including the annual report due and submitted to the Mayor by December 31 of each calendar year. The annual report shall include, but may not be limited to, an explanation of all remedial action taken during the preceding calendar year, identification of all ongoing remedial action and what steps are necessary to complete said repairs, and a recommendation for any additional remedial action that may be necessary during the upcoming calendar year. The focus of the report shall be for the purpose of reducing inflow and infiltration into the sewage collection system. The file shall be organized, neatly kept, and shall be available to facilitate any request made by any State or Federal regulatory agency.

The plan shall provide for inventory of the three major sections of the Community of Bismarck: West, Southeast and Northeast. The Northeast section shall be completed by December 31, 2009, and the Southeast section shall be completed by December 31, 2010. The inventory shall be done utilizing videotaping, personal inspection, and smoke-testing techniques. All manholes shall be identified, as well as lift stations, and all unsatisfactory conditions documented on a corresponding map of the section in question.

The City shall establish a minimum of five sampling stations, each located so as to ascertain an estimate of flow patterns for a given section of the collection system. Estimated flows shall be recorded after inclement weather at each station. The information shall be collected and filed with other I&I data within the main Inflow and Infiltration (I&I) file at City Hall. This data shall be used to evaluate progress, during the upcoming years of maintenance and repair activities.

The Sections, paragraphs, sentences, and clauses of this Chapter are severable, and if any section, paragraph, sentence or clause of this Chapter is declared to be unconstitutional by a court of competent jurisdiction, such unconstitutionality shall have no effect upon the remaining Sections, paragraphs, sentences and clauses of this Chapter.
