There shall be a Municipal Clerk appointed by the Mayor and
Borough Council. The term of office of the Clerk shall be three years
which shall run from the day of appointment in the year in which the
Clerk was appointed.

No person shall be appointed as Borough Clerk unless that person
shall have a Registered Municipal Clerk Certificate issued pursuant
to N.J.S.A. 40A:9-133 et seq.

The compensation for the Municipal Clerk shall be established
in the Salary Ordinance.

The Municipal Clerk shall:
a. Act as secretary of the municipal corporation and custodian of the
municipal seal and of all minutes, books, deeds, bonds, contracts,
and archival records of the municipal corporation. The Borough Council
may, however, provide by ordinance that any other specific officer
shall have custody of any specific other class of record;
b. Act as secretary to the Borough Council, prepare meeting agendas
prior to meetings of the Council, be present at all meetings of the
Council, keep a journal of the proceedings of every meeting, retain
the original copies of all ordinances and resolutions, and record
the minutes of every meeting;
c. Serve as the chief administrative officer in all elections held in
the Borough, subject to the requirements of Title 19 of the New Jersey
Statutes Annotated;
d. Serve as the chief registrar of voters in the Borough, subject to
the requirements of Title 19 of the New Jersey Statutes Annotated;
e. Serve as the administrative officer responsible for the acceptance
of applications for licenses and permits and the issuance of licenses
and permits, except where Statute or ordinance has delegated that
responsibility to some other Borough officer;
f. Serve as coordinator and records manager responsible for implementing
local archives and records retention programs as mandated pursuant
to Title 47 of the New Jersey Statutes Annotated;
g. Perform such other duties as are now or hereafter imposed by Statute,
by ordinance or by regulation.

a. Creation of Position. There is hereby created the position of Deputy
Municipal Clerk, to be appointed by the Mayor with the consent of
the Borough Council for a term of one year, commencing January 1 annually
and ending on December 31, or until a successor is appointed. Should
the office become vacant during any term it shall be filled by similar
appointment for the unexpired term.
b. Duties. The Deputy Municipal Clerk shall perform the duties of the
Municipal Clerk in the absence or disability of the Clerk. At all
other times the Deputy Clerk shall act as the assistant to the Municipal
Clerk and be under the control and charge of the Municipal Clerk and
shall perform such other duties and functions as are required by this
office or the Borough Council.
c. Compensation. The compensation of the Deputy Clerk shall be designated
by the ordinance salary.

The Governing Body has determined that the efficiency of administering
the business affairs of the Borough of Elmer can be increased by the
creation of the Office of Borough Administrator.

The Office of the Borough Administrator is hereby created.

The term of office shall be for a period of one year commencing
on January 1st and ending on December 31st.

Appointment to the Office of Borough Administrator shall be
made by the Mayor with the advice and consent of Borough Council.

The compensation of the Administrator shall be as established
in the salary ordinance.

The Administrator shall perform such tasks as shall be assigned
by the Mayor, which duties shall include, but shall not be limited
to, acting as consultant to the Borough Clerk.

There is hereby established in the Borough of Elmer, the position
of Chief Financial Officer pursuant to the mandate of N.J.S.A. 40A:9-140.1
et seq. to carry out the duties set forth under N.J.S.A. 52:27BB-26
et seq. and N.J.S.A. 40A:9-140.1.

Any person appointed to the position of Chief Financial Officer
shall meet the requirements of N.J.S.A. 40A:9-140.1 et seq., subject
to the statutory provisions for interim or temporary appointments
and for persons entitled to tenure in such position.

It shall be the duty of the Chief Financial Officer to perform
the duties of Municipal Treasurer, to attend to the proper fiscal
administration of the Borough and to keep all necessary and proper
accounts. The Chief Financial Officer shall carry out the responsibilities
set forth under N.J.S.A. 52:27-BB-1 et seq. and N.J.S.A. 40A:9-140.1
et seq.

The Chief Financial Officer shall be appointed by the Mayor
with the advice and consent of the Council. The term shall be four
years, which shall run from January 1 in the year in which the Chief
Financial Officer was appointed.

The Borough Council shall determine the compensation for the
position of Chief Financial Officer as set forth in the salary ordinance
and shall make necessary appropriations for payment of same.

a. Each Council member shall submit, in writing, a list of bills to
be paid in between meetings of the Borough Council. That list can
be a list for the fiscal year or the list can be submitted on an ad
hoc basis for bills that must be paid in between meetings. This list
must be submitted to the Chief Financial Officer of the Borough.
b. All bills to be paid must be accompanied by the appropriate voucher
which has been executed by the vendor, the Council member in charge
of said department, as well as any other officer required to sign
vouchers for the approval of payments.
c. The bill, with all supporting documentation, must then be submitted
to the Chief Financial Officer, for the purpose of certifying and
approving the payment of this bill. The Chief Financial Officer is
the approving officer for all bills to be paid by this method. Before
the approving officer can approve a payment of a bill, the Council
member requesting payment must sign the voucher for that bill.
d. The approving officer must certify that the work has been performed
or the product has been received by the Borough and, based on information
from the Chief Financial Officer, that there are proper and sufficient
funds for this payment as well as legal authorization to pay same.
e. Once the claim has been approved and the approving officer has certified
that the claim can be paid, the bill can be presented to the Chief
Financial Officer or other agent of the Borough who is drawing the
check for the payment of this claim. The checks must still be signed
by all the appropriate parties as any other claim paid by the Borough.
f. As long as the procedure set forth in this §
2-9.6 is compliant, then the Mayor and Council shall ratify the payment of these bills at its next regular meeting.

The Mayor and Borough Council shall provide for the appointment
of a Tax Assessor.
[N.J.S.A. 40A:9-148.1; New]
The Tax Assessor shall hold the Tax Assessor's Certificate provided
for in N.J.S.A. 54:1-35.25 et seq. and shall have the duty of assessing
property for the purpose of general taxation. Nothing in this section
shall affect adversely the salary or tenure rights acquired pursuant
to N.J.S.A. 54:1-35.31 or any other law. In accordance with the provisions
of N.J.S.A. 54:3-16, the Assessor, when making assessments, shall
be governed by directions by the County Tax Administrator. These directions
shall be pursuant to rules adopted by the County Tax Board.

The Mayor and Borough Council shall determine the amount of
compensation for the Tax Assessor in the salary ordinance.

The Tax Assessor shall hold office for a term of four years.
Vacancies other than due to expiration of term shall be filled by
appointment for the unexpired term.

Pursuant to N.J.S.A. 40A:9-141 et seq., the Mayor and Borough
Council shall provide for the appointment of a Tax Collector.

No person shall be appointed or reappointed as Tax Collector
unless he shall hold a Tax Collector's Certificate issued pursuant
to N.J.S.A. 40:9-145.3. Any Tax Collector appointed pursuant to this
section may obtain tenure pursuant to the provisions of N.J.S.A. 40A:9-144
or 40A:9-145. Any person who shall be reappointed Tax Collector subsequent
to having received a Tax Collector's Certificate pursuant to N.J.S.A.
40A:9-144.3 and having served as Tax Collector or who has performed
the duties of Tax Collector for not less than four consecutive years
immediately prior to such reappointment shall have acquired tenure
and shall hold his or her office during good behavior and efficiency
and shall be removed only for good cause shown and after a proper
hearing before the Director of the Division of Taxation or his designee
in accordance with the provisions of N.J.S.A. 40A:9-145.8.

The Tax Collector shall hold his office for a term of four years
from January 1 next following his appointment. Vacancies other than
due to the expiration of term shall be filled by appointment for the
unexpired term.

The Mayor and Borough Council shall determine the amount of
compensation for the Tax Collector in the salary ordinance.

In accordance with N.J.S.A. 40A:9-139 there is hereby created
by the Borough of Elmer the position of Borough Attorney.

The Borough Attorney shall be a duly licensed attorney-at-law
of the State of New Jersey.

The Borough Attorney shall be appointed by the Mayor with the
confirmation of the Borough Council, and shall hold such position
for a term of one year from January 1 of the year in which the appointment
is made.

a. The Borough Attorney shall serve as legal advisor to the Governing
Body and to the Borough officers and employees on matters pertaining
to their duties, shall represent the Borough in litigations except
where the Borough Council directs otherwise, shall draft all contracts,
ordinances or other documents needed by the Borough and shall render
such other legal services as may be required by the Borough Council.
b. It shall be the duty of the Attorney to see to the full enforcement
of all judgments or decrees rendered or entered in favor of the Borough
and of all similar interlocutory orders.
c. It shall be the duty of the Attorney to see to the completion of
all special assessment proceedings and condemnation proceedings.

All papers, documents, memorandum, and other materials relating
to prosecution or to the duties of the Borough Attorney shall be and
shall remain the property of the Borough.

The compensation for the Borough Attorney shall be established
in the salary ordinance.

The Borough Engineer shall be appointed by the Mayor with the
advice and consent of the Council. The Borough Engineer shall, prior
to his/her appointment, hold a degree in civil engineering from a
recognized school or college of engineering, be licensed in the State
of New Jersey, and be qualified by further training and experience
of at least five years in responsible engineering work.

The Borough Engineer shall:
a. Have general supervision over all matters relating to the construction,
management, maintenance and operation of the physical properties of
the Borough.
b. Direct and supervise the preparation of plans and specifications.
c. Provide for the Borough's traffic engineering needs.
d. Provided all engineering and mechanical services required by any
department, office or agency of the Borough, except the communications
systems of the Police Department and the Fire Department.
e. Supervise the construction, reconstruction, maintenance and repair
of all public streets within the limits of the Borough. The Borough
Engineer shall also regulate street openings, the construction, alteration
and repair of sidewalks, curbs and gutters, and encroachments by objects
and structures above and below public streets and sidewalks, to prevent
interference with the public use thereof and to maintain reasonable
standards of maintenance and repair. The Borough Engineer shall also
be responsible for the supervision of street cleaning and snow removal
on all Borough streets.
f. Provide for the construction, reconstruction, maintenance and repair
of sanitary and storm sewerage systems within the limits of the Borough.

The Borough Engineer shall receive the compensation as may be
fixed in the salary ordinance.

a. Position Established. The position of Emergency Management Coordinator
is hereby created pursuant to N.J.S.A. App.A.9-40.1.
b. Duties.
1. The Emergency Management Coordinator shall be responsible for the
development, coordination and activation of a municipal mutual aid
and emergency management plan; shall request, when needed, emergency
management facilities and services available from the County and State
governments, and shall perform such duties as the Governing Body may
direct.
2. Whenever, in the opinion of the Coordinator, a disaster has occurred
or is imminent in the Borough of Elmer, he shall proclaim a State
of Local Disaster Emergency within the Borough. The Emergency Management
Coordinator, in accordance with regulations promulgated by the State
Director of Emergency Management, shall be empowered to issue and
enforce such orders as may be necessary to implement and carry out
emergency management operations and to protect the health, safety
and resources of the residents of the Borough.

a. Findings. The Borough Council hereby finds and determines that it
is necessary and advisable for the efficient conduct of the affairs
of the Borough and more particularly, to facilitate the operation
of the various offices in the Borough by providing the assistance
of a deputy to the existing office and that the offices of the deputy
hereinafter designated should be created.
b. Creation of Position. There is hereby created the office of Deputy
Collector of Taxes, Treasurer, Water Collector and Water Treasurer.
c. Appointment. The Borough Council hereby appoints a Deputy Collector
of Taxes, Treasurer, Water Collector and Water Treasurer. The term
of such office shall be for one year, commencing January 1 of each
year and ending on December 31 or until his successor is appointed.
Should the office become vacant during any term, it shall be filled
by a similar appointment but for the unexpired term.

a. Findings. The Mayor and Borough Council of the Borough of Elmer have
determined that it would be in the best interests of the Borough if
there existed the office of Deputy Registrar of Vital Statistics.
b. Office Created. The office of Borough of Elmer Deputy Registrar of
Vital Statistics is hereby created.
c. Term. The term of this office shall be not more than one year.
d. The office shall be filled by appointment of the Mayor with approval
of Borough Council.

a. The position of General Maintenance is hereby created. Appointment
to the position of General Maintenance shall be made by the Mayor
with the advice and consent of Borough Council.
