Be it ordained by the Mayor and Council of the Borough of Woodstown,
in the County of Salem and State of New Jersey:

The placing, depositing, collection and disposition of garbage,
refuse and rubbish, including residential garbage, refuse and rubbish
within the limits of the Borough of Woodstown, New Jersey shall not
be permitted in any manner except as provided herein. No person who
is not a resident of the Borough of Woodstown shall bring into the
Borough of Woodstown, for the purpose of disposal, any substance regulated
within this article.

For the purposes of this article, the following shall serve
to define the subject matters hereof:
GARBAGE
Putrescible animal and vegetable waste resulting from the
handling, preparation, cooking and consumption of food.
REFUSE
All putrescible and nonputrescible solid waste, except recyclable materials as regulated in Chapter
74 of the Municipal Code and body and household waste processed by the Municipal Sewer Authority, including garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles or parts thereof and solid market and industrial waste.
RESIDENTIAL GARBAGE, REFUSE OR RUBBISH
Garbage, refuse or rubbish from residential activity of residences
located within the Borough of Woodstown, including multi-family dwellings,
as that term is defined in N.J.S.A. 40:66-1.2, which comply with all
recycling requirements generally applicable to all other residential
properties within the borough.

RUBBISH
Nonputrescible solid waste, excluding ashes and recyclable materials as regulated in Chapter
74, Recycling, consisting of both combustible and noncombustible waste such as paper, cardboard, tin cans, wood, glass, bedding, crockery and similar materials.

The governing body shall not be required to collect garbage,
refuse and rubbish from all locations within the Borough of Woodstown
and may distinguish between certain uses. Regardless of whether or
not the Borough of Woodstown shall elect to collect waste from certain
locations, all waste is to be suitably packaged, bagged or contained
so as not to become a nuisance or health hazard.

The receptacles for garbage, refuse and rubbish which is not
to be collected by the municipality shall be contained in a receptacle
of metal or heavy plastic, which shall be watertight with a tight-fitting
cover to prevent access by flies and vermin to the contents. A suitable
number of such receptacles shall be provided by the owner, occupant
or proprietor at each location, shall be kept covered at all times
and shall be kept clean and in such a condition as to preclude the
entry of rainwater and the escape of any noxious fumes, liquids or
overflow.

All garbage, refuse and rubbish shall be bagged and placed in
a container supplied by the Borough of Woodstown, in the event such
containers are provided pursuant to a municipal collection contract.
If such containers are provided by the municipality, then said container
shall be placed in the location to be designated by the municipality
on days specified for collection.
In the event specialized containers have not been provided by
the municipality, then all bags shall be securely tied and may be
separately contained in an appropriate receptacles which is easily
accessible to the authorized municipal collector.
For certain specific items such as large appliances, furniture,
box springs and similar items, a minimum charge of $35 will be imposed.
This fee may be increased for unusually large and heavy items at the
discretion of the Superintendent of Public Works. A separate fee for
car and truck tires will be charged as reflected below:

All garbage, refuse and rubbish shall be collected weekly. No
garbage, refuse or rubbish shall be removed or placed in a municipal
collection truck which is not contained in a bag. In the event the
municipality shall provide containers for the collection and removal
of garbage, refuse or rubbish, said bags shall be placed in the containers
as provided and placed at the site designated by resolution to be
adopted by the Mayor and Council. Said resolution shall be enforceable
as if same were part of this article.

Any person or entity, whether a contractor of the Borough of
Woodstown or otherwise, in making collections or disposing of waste,
shall cause all receptacles to be entirely emptied of their contents,
and any contents falling on the ground shall be immediately picked
up and removed. The covers of all receptacles shall be replaced after
the contents have been removed. No collection activity shall take
place at any time other than during the daytime from 6:00 a.m. through
8:00 p.m. No contractor of the Borough of Woodstown shall remove any
waste on behalf of the borough which is not properly bagged or stickered
in accordance with this article.
this article shall be interpreted in a way which is consistent
with the interest of public health and safety for the inhabitants
of the Borough of Woodstown.
Any person, firm, association or corporation violating any section
of this chapter shall, upon conviction, be subject to a fine not exceeding
$500 or imprisonment in the county jail for a term not exceeding 90
days, or both. For purposes of sentencing, each separate act shall
be considered a separate violation.

The use and placement of dumpsters in public areas is regulated
as follows:
The purpose of this article is to regulate the use and placement
of dumpsters in public areas in association with the construction,
renovation, rehabilitation and reconstruction of buildings and structures
in private areas located within the Borough of Woodstown.
No person shall place or utilize a dumpster or permit a dumpster
to be placed on or within a public area in the Borough of Woodstown
without first having obtained a permit from the Woodstown Police Department.
A. Application for a dumpster permit shall be made by submission of
the following information to the Woodstown Police Department:
(1) Name and address of the applicant and the owner of the property to
be constructed, renovated, rehabilitated and/or reconstructed, if
different.
(2) Name and address of the dumpster company.
(3) Size of the dumpster to be placed and the proposed location of the
dumpster.
(4) Anticipated length of time the dumpster will be located at the site.
B. The permit shall be valid for a period of seven days and may be renewed
upon application to the Police Department for an additional seven-day
period.
C. A permit may be revoked at any time during its term if the placement
or use of the dumpster constitutes a hazard to the health, safety
or welfare of the citizens of the Borough or for any other reason
that constitutes a nuisance.
D. No permit shall be issued if the Police Department determines that
the issuance of a permit will constitute a danger to public safety
or an unwarranted interference with the efficient movement of traffic.
A. No dumpster shall be placed in a public area unless it is determined
by the Police Department that there is sufficient room for the dumpster.
No dumpster shall impede the flow of pedestrian or vehicular traffic
or safety site lines.
B. The dumpster shall be equipped with markers consisting of reflective
diamond-shaped panels measuring a minimum of 18 inches by 18 inches.
These panels shall be mounted at the edge of the dumpster at both
ends nearest the path of passing vehicles and facing the direction
of oncoming traffic. The required markers shall have a minimum height
of three feet from the bottom of the panels to the surface of the
roadway. An additional two traffic cones shall be placed at the rear
of the dumpster.
C. Dumpsters shall at all times be kept in good repair and shall be
structurally sound and leakproof and shall be painted as to prevent
the show of rust or deterioration and shall be constructed to stand
firmly upright.
D. Upon removal of the dumpster, the area shall be swept clean of all
loose debris and restored to its former condition in accordance with
the standards of the Public Works Supervisor.
E. The applicant shall be responsible for any damage to the roadway
or other property caused by the placement of the container.
F. The waste or refuse to be placed in a dumpster shall be only the
waste or refuse generated by construction, reconstruction and/or rehabilitation
of structure(s) at the property site for which the application is
submitted or approved.
G. No dumpster shall be overfilled with debris whereby the contents
exceed the top of the container. Any full container shall be removed
within two business days of becoming full, unless for the purposes
of the health, safety and welfare of the community an earlier removal
is warranted.
If the dumpster is not removed at the expiration of the time
allowed by the permit, the Woodstown Police Department shall notify
the owner that he/she has three days in which to have the dumpster
removed. In the event the owner fails to comply, the dumpster shall
be deemed to have been abandoned and the Police Department may arrange
for its removal and the disposal of its contents. The costs associated
with the removal of the dumpster and the disposal of its contents
shall be a municipal lien against the property in which the dumpster
is being used. A detailed statement of the aforesaid costs shall be
certified by the Police Department and forwarded to the Borough Council,
which shall examine the certification and, if found correct, shall
cause the same to be filed with the Tax Collector and a copy forwarded
to the property owner. This amount shall be charged against the land
and shall become a lien upon such lands and shall bear interest at
the same rate as taxes and shall be collected and enforced by the
Tax Collector.
All dumpsters and other refuse containers that are outdoors
or exposed to stormwater shall be covered at all times to prohibit
the spilling, dumping, leaking, or otherwise discharge of liquids,
semi liquids or solids from the containers to the municipal storm
sewer system operated by the Borough of Woodstown and/or the waters
of the state so as to protect public health, safety and welfare, and
to prescribe penalties for the failure to comply.
For the purposes of this article, the following definitions
shall apply:
DUMPSTER
A container used on a temporary basis for the disposal of
waste or refuse generated by the construction, reconstruction and/or
rehabilitation of buildings and structures in private areas located
within the Borough of Woodstown. Dumpsters shall include any metal
container, including, but not limited to, containers commonly known
as "front-loading, rear-loading or roll-off containers," used for
bulk carting or hauling of garbage, ashes, offal, refuse or debris
of whatever kind, having a capacity in excess of one cubic yard. "Dumpster"
shall not include a metal container used for such purpose, which can
be easily handled by one person without the aid of hydraulic or similar
lifting devices.
PUBLIC AREA
All streets, roads, highways, sidewalks, rights-of-way, easements
in favor of the Borough of Woodstown, public parks, parking areas
owned by the Borough of Woodstown, playgrounds, trails, paths and
other recreational areas, public open spaces and sites for schools
and other public buildings and structures.
The processing fee for the initial application and permit and
any renewal permits shall be $10 for each seven-calendar-day period.
All violations and penalties under this Article
II shall be handled in accordance with §
60-9 of this chapter.
