There is hereby created the office of Municipal Attorney of the Borough of Bloomingdale.

The Municipal Attorney shall be an attorney at law of the State of New Jersey.

The Borough Attorney shall perform the duties of Municipal Attorney in accordance with the laws of the State of New Jersey and the ordinances of the Borough and shall be the legal adviser of the Mayor, the Council and the other officers and the various municipal boards which are not represented by their own counsel, in matters relating to their duties and business of the Borough.

Pursuant to the provisions of N.J.S.A. 40A:9-139, the governing body, by this section, provides for the appointment of the Municipal Attorney, who shall be nominated by the Mayor and with the advice and consent of the Council, and be appointed by the Mayor at the annual reorganization meeting. In the event that the Mayor shall fail to nominate a Municipal Attorney at the reorganization meeting or if the Mayor shall nominate a Municipal Attorney at the reorganization meeting and the nomination fails to receive the consent of the Council, the Council may thereupon appoint a Municipal Attorney at the reorganization meeting or at any time thereafter. The term of the Borough Attorney shall be for one year, terminating on December 31 of the year of appointment, except that he or she shall hold over until his or her successor has been appointed and qualified.

The office of Municipal Attorney shall be a part-time office, and the Municipal Attorney shall receive compensation as provided in the Salary Ordinance adopted by the Mayor and Council for his attendance at meetings of the Mayor and Council. The Municipal Attorney shall receive such other compensation for additional legal work performed as authorized by the Mayor and Council.

The position of Assistant Municipal Attorney of the Borough of Bloomingdale is hereby established.

The Assistant Municipal Attorney shall be a New Jersey Licensed Attorney practicing in the area of Municipal Law for at least five years.

The Assistant Municipal Attorney shall be appointed by the governing body at the reorganization meeting or any time thereafter, for a period of time designated by the governing body, but not to exceed 12 months.

The salary of the Assistant Municipal Attorney shall be designated by the governing body, but to not exceed the maximum salary designated by the Salary Ordinance.

The Borough Prosecutor shall be an attorney at law of the State of New Jersey.

The Borough Prosecutor shall perform the duties of Borough Prosecutor in accordance with the laws of the State of New Jersey and the ordinances of the Borough and shall be the adviser of the Mayor and Council, Municipal Court personnel and the Police Department in matters relating to their duties concerning the prosecution and preparation of all charges and complaints against every person charged with a violation of any of the laws of the State of New Jersey and the ordinances of the Borough, and shall appear in the appropriate Court in the prosecution of every person charged with a violation of any State, county or municipal law or ordinance.

The Prosecutor shall be appointed and shall hold office as prescribed by law.

The office of the Borough Prosecutor shall be a part-time office, and the Borough Prosecutor shall receive compensation as provided in the Salary Ordinance for his or her attendance at sessions of the Municipal Court. The Public Defender shall be an attorney at law of the State of New Jersey in good standing.

The Public Defender shall perform the duties of Municipal Public Defender in accordance with the laws of the State of New Jersey and the ordinances of the Borough.

The Public Defender shall be appointed by the Council and shall hold office for a term of one year from the date of appointment as prescribed by law.

The office of the Public Defender shall be a part-time office, and the Public Defender shall receive compensation as provided in the Salary Ordinance for his or her attendance at sessions of the Municipal Court. The Public Defender shall receive such other compensation for additional work performed as authorized by the Mayor and Council.

a. 
Any person entitled by law to appointment of counsel may apply to the Municipal Court for representation by a Municipal Public Defender in any action pending before the Court. Such application shall be accompanied by an application fee in the amount of $200. Upon request of the applicant, the Municipal Court may waive the application fee, in whole or in part, if the Court determines, in its discretion, upon clear and convincing showing by the applicant that the application fee represents an unreasonable burden on the person seeking representation.
b. 
Funds collected by the Borough pursuant to this section shall be deposited in a dedicated fund administered by the CFO of the Borough. Such funds shall be used exclusively to meet the costs incurred in providing the services of a public defender including, when required, expert and lay investigation and testimony.

Pursuant to N.J.S.A. 40A:9-139, there is hereby created the office of Borough Engineer of the Borough of Bloomingdale.

The Borough Engineer shall be a duly qualified licensed engineer under the provisions of the laws of the State of New Jersey.

The Borough Engineer shall:
a. 
Perform the duties as required in accordance with the laws of the State of New Jersey and the ordinances of the Borough of Bloomingdale, and shall be the adviser of the Mayor and of the Council and other officers and boards of the Borough in matters of an engineering nature relating to their duties and the business of the Borough.
b. 
Be responsible for inspecting all construction work that takes place within the Borough, exclusive of that construction which falls within the responsibility of the Code Enforcement Officer.
c. 
Establish and revise from time to time the standards that are to be maintained with respect to the construction of roads, curbs, storm drainage facilities, sanitary sewers and other Borough facilities.
d. 
Arrange to have the Tax Maps revised as directed by Council.

The Borough Engineer shall be appointed and shall hold office for a term of three years as prescribed by law.

The office of Borough Engineer shall be a part-time office and the Borough Engineer shall receive compensation as provided in the Salary Ordinance for his or her attendance at Council meetings. The Borough Engineer shall receive such other compensation for additional engineering work performed as authorized by the Mayor and Council, such compensation being in accordance with the basic fee schedule adopted by the New Jersey Society of Professional Engineers Incorporated.

There is hereby established the position of Recreation Director of the Borough of Bloomingdale.

The Recreation Director shall be computer-literate and proficient in the use of applicable computer programs.

The Recreation Director shall be responsible as follows:
a. 
For the establishment of the Borough's Summer Recreation Program and for the coordination of all aspects of all programs established and/or administered by the Borough Recreation Commission, including, but not limited to, the scheduling of programs and activities, and the hiring of assistant personnel.
b. 
For the operation of the Borough Recreation Center during the period designated by the Borough Recreation Commission for its hours of operation, which shall not be less than 10 hours per week, which operation shall include, but not be limited to, interacting with the general public in person and by telephone.
c. 
For the maintenance and keeping of all public records and files of the Borough Recreation Commission and Borough Recreation Center, including, but not limited to, the disposition of all financial obligations, budgetary matters and bookkeeping.
d. 
For the scheduling of the maintenance, and public and/or school-related use, of all recreational facilities subject to the jurisdiction of the Borough Recreation Commission.
e. 
For the posting, publication and coordination of all registration activities relating to programs and/or activities established and/or administered by the Borough Recreation Commission.
f. 
For the scheduling, planning, organization and coordination of all programs and/or activities established and/or administered by the Borough Recreation Commission.
g. 
For the maintenance and inventorying of all equipment subject to the jurisdiction of the Borough Recreation Commission.
In addition to the foregoing, the duties of the position of Recreation Director shall be the Liaison to the Vacamas Day Camp.

The position of Recreation Director shall be a part-time position, for which the Recreation Director shall receive compensation as provided in the Municipal Salary Ordinance.

The hours of operation of the Recreation Center shall be determined by the Recreation Commission. Notwithstanding the foregoing, the Recreation Center shall be closed during the following periods:
a. 
Official Municipal Holidays;
b. 
Operation of the Summer Recreation Program; and
c. 
December 24 through December 31 of each calendar year.

There is hereby created the position of Qualified Purchasing Agent ("QPA") of the Borough of Bloomingdale. The QPA shall be appointed by the Mayor and Borough Council.

The QPA shall possess a valid Qualified Purchasing Agent certificate, as issued by the New Jersey Division of Local Government Services, Department of Community Affairs.

The QPA shall have the responsibility and accountability for the purchasing activity pursuant to the Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.) to prepare public advertising for and to receive bids for the provision or performance of goods or services on behalf of the Borough of Bloomingdale and to award contracts in the name of the Borough of Bloomingdale, and to conduct any activities as may be necessary or appropriate to the purchasing function of the Borough of Bloomingdale as its contracting agent.

The Office of Code Enforcement Officer of the Borough is hereby created. The Code Enforcement Officer shall be appointed by the Mayor with the consent of the Borough Council for a term of one year. A vacancy in the office shall be filled by the Mayor with the consent of the Borough Council for the unexpired term only.

It shall be the responsibility of the Code Enforcement Officer to enforce the following enumerated ordinances as set forth in the Code of the Borough of Bloomingdale:
1. 
Chapter 3, § 3-1, Abandoned Vehicles.
2. 
Chapter 30, Flood Hazard Protection.
3. 
Chapter 15, Property Maintenance.
4. 
Chapter 92, Zoning.
5. 
Chapter 20, Streets and Sidewalks.
6. 
Chapter 19, § 19-2, Refuse Container/Dumpster Regulations.
b. 
The designation within this section of duties of the Code Enforcement Officer shall not be construed to deprive any other municipal official or employee of the power to enforce the subject ordinances where such other persons or employees are authorized either under the terms of the said ordinance or under general law to take enforcement action, nor shall anything contained herein be construed to prohibit any interested party from filing an appropriate complaint charging a violation of any of the subject ordinances.
c. 
The Code Enforcement Officer shall report to the Planning Board, Board of Adjustment, Construction Official and the Mayor and Council with respect to matters which are properly before those officials.
d. 
The Code Enforcement Officer shall maintain an accurate and complete file with respect to every alleged violation of these chapters or other matters investigated by him.
e. 
The Code Enforcement Official shall file a monthly report of his or her activities, including the complaints and cases processed by him or her and the disposition thereof, with the Mayor and Council, the Construction Official and the Borough Administrator.
f. 
Whenever an application for an occupancy permit has been made to the Construction Official, the Code Enforcement Officer shall make an inspection of the property in order to ascertain whether the premises comply with any of the ordinances over which the Code Enforcement Officer has jurisdiction under the terms of this section.

The Borough Code Enforcement Officer shall be under the supervision of the Borough Administrator.

The salary of the Code Enforcement Officer shall be as provided in the Salary Ordinance.

The Code Enforcement Officer shall be a part-time officer and shall devote a minimum of five hours per week to the performance of his or her duties.

The position of Zoning Officer is hereby created.

The term shall be for one year, expiring December 31 of the year of appointment.

The position shall be a part-time position. The salary of the Zoning Officer shall be as provided in the Salary Ordinance.

The Zoning Officer shall have the responsibility to investigate any violations of the Zoning Ordinance and to issue complaints in the Municipal Court, where appropriate, as well as take such other enforcement action as is appropriate.

Creation of Office. There is hereby created the position of Assistant Zoning Officer.
b. 
Supervision; Duties; Rights. The Assistant Zoning Officer shall work under the immediate supervision of the Zoning Officer and the general supervision of the Borough Administrator and shall perform various duties assigned by these officials which are associated with the office of the Zoning Officer. The Assistant Zoning Officer shall have the right to prosecute complaints in the Municipal Court for violations of the Zoning chapter.
c. 
Appointment; Term. The Assistant Zoning Officer shall be appointed by the Mayor with the advice and consent of the Council, and term of office shall be one year, expiring December 31 of the year of appointment.
d. 
Salary. The Assistant Zoning Officer shall be a part-time office and receive compensation as provided in the Salary Ordinance.

There is hereby created the position of Radio Dispatcher in the Borough of Bloomingdale.

The Radio Dispatcher shall possess the ability to read, write and understand the English language sufficiently to perform the duties delineated in this section.

The Radio Dispatcher shall work within the Police Department under the immediate supervision of the shift commander and the general supervision of the Chief of Police. The Dispatcher will be required to rotate shifts in the performance of assigned duties. The Dispatcher will be required to wear a uniform as prescribed by the Chief of Police, but will not be bestowed any police powers.

a. 
The Dispatcher shall receive all telephone and radio calls, obtain all the necessary information pertaining to same, make a written record of the calls and then relay the call to the proper authority.
b. 
The Dispatcher shall record all calls and complaints received, in a neat and orderly manner, on the radio call sheet and keep a radio log on all the mobile units on the network. The Dispatcher shall be aware of the status of each Bloomingdale police unit, the number, location and the operator of same, at all times.
c. 
The Dispatcher shall receive and transmit all necessary teletype messages for the Police Department and all other departments that are entitled to these services, making sure that a clear correct record is kept of the messages.
d. 
The Dispatcher shall dispatch all emergency vehicles upon request, which vehicles are police cars, fire trucks, ambulances and any tow truck or public utilities vehicle that might be needed.
e. 
The Dispatcher shall type all necessary records and file same and record all complaints received by making whatever cards may be necessary (complaint, defendant and crime card).
f. 
The Dispatcher shall, upon being relieved by another Dispatcher at the end of an assigned shift, pass on all information as to actions of the shift and any pending actions that may have to be taken by the new shift.
g. 
The Dispatcher shall inform the shift commander of all incidents that occur on the shift at the time of their occurrence.
h. 
The Dispatcher shall perform all other duties as assigned by the shift commander or the Chief of Police.

The Dispatcher shall be appointed by the Borough Administrator, considering the recommendations of the Chief of Police.

The Dispatcher is required to work an eight hour day, 40 hour week and shall receive compensation as provided in the Salary Ordinance.
