A. 
The definitions of certain words used in this article are as follows:
ASHES
The residue from the burning of coal or coke and includes accumulations of dirt and such other noncombustible materials not included in refuse, garbage or offal.
GARBAGE or OFFAL
Includes kitchen waste; the refuse of animals or vegetable matter; carrion; entrails of chickens, animals or fish; and matter of a similar nature.
HE or HIS
Male, female or neuter gender.
PERSONS
One or more individuals, male or female, partnership or partnerships, corporation or corporations.
REFUSE
Includes combustible debris, that is, paper, cardboard, rags, mattresses, discarded wearing apparel, furniture, carpets, rubber, grass cuttings, plant trimmings, leaves, bottles, broken glass, crockery, scrap metal and tin cans. It shall not include earth, sand, bricks, stone, plaster or debris of a similar substance that accumulates incidental to building construction; nor shall it include trade wastes.
B. 
Word usage. All words used in the present tense include the future tense; all words in the plural number include the singular number, and all words in the singular number include the plural number, unless the natural construction of the wording indicates otherwise.
It shall be unlawful for any person to place or cause or suffer to be placed upon any vacant lot, street, avenue, alley, driveway, areaway or public place any ashes, refuse, garbage or offal or to disturb such material when properly placed, except in compliance with the provisions of this article.

A. 
Any person desiring such ashes, refuse or garbage to be removed by the Borough of Woodlynne shall provide suitable containers and place therein all ashes, refuse or garbage which shall accumulate in, on or about his said property. Ashes, refuse or garbage shall be mixed and placed in the same container or containers. Newspapers, wastepaper, cardboard and similar materials shall be securely tied or fastened together in bundles or placed in a container so as to prevent their being distributed over any street, avenue, byway or public place. Receptacles in which ashes or refuse and garbage are placed shall be leakproof and of such material and so constructed as to properly withstand the use for which they were intended, without breaking or collapsing. Baskets, boxes or other receptacles with openings in the bottoms or sides shall not be used. Before mixing with trash or refuse, garbage shall be placed in plastic bags or bread wrappers to eliminate leakage of offensive odors. The receptacle in which garbage is placed shall be a watertight container, preferably of metal, with a lid to properly fit the said container so as to prevent the garbage from being distributed over the surface of the adjacent ground or pavement. The receptacles herein required, together with their contents, shall be of such weights and designs as to be conveniently handled by one man, and no receptacle and contents shall weigh more than 50 pounds.
B. 
No person shall place his trash and/or garbage at curbside and/or alleys for collection any earlier than 6:00 p.m. on the day immediately preceding the regular assigned collection day. Furthermore, all persons shall remove their empty trash and/or garbage containers from curbside before 10:00 p.m. on the actual day on which the containers were emptied and the contents thereof collected by the Borough trash collection service.

No person shall break into, untie or otherwise unbundle any container, bundle or package of paper, ashes, refuse, garbage or offal that has been placed on the sidewalk for collection. Nor shall any person disturb, remove, untie, unbundle or otherwise scatter any ashes, refuse, garbage or offal when such material has been placed in the open on any street, sidewalk or alley for collection or removal by the Borough of Woodlynne, except:
A. 
By the employees of said Borough of Woodlynne in the line of duty.
B. 
By persons specifically authorized to remove same by the occupant of the premises from which it is being taken.
C. 
By persons duly authorized by resolution of the Mayor or Borough Council of said Borough of Woodlynne.

No person shall place or deposit ashes, refuse, garbage or offal or other waste materials upon any open lot or lots within the limits of the Borough of Woodlynne without first obtaining the permission of the Public Works Department.

No person shall place his/her trash and/or garbage at the curbside, front alleys and/or front of any residential property/house. All trash and/or garbage shall be placed at the rear of the residential property/house.

Any person who shall violate any of the provisions of this article shall, upon conviction of a violation, be subject to a fine of not more than $500 or to imprisonment for any term not exceeding 90 days, or both.
