A. 
Definitions. For the purpose of this article, the following terms, phrases, words and their derivatives shall have the meanings given herein:
BOROUGH
The Borough of Woodlynne.
GOVERNING BODY
The Mayor and Council of the Borough of Woodlynne.
PARK
A park, playground, recreation area, green, square or any other area in the Borough, owned and used by the Borough and devoted to active and passive recreation.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
RECREATION AREA
A park, recreation area, green, square or any other area in the Borough, owned and used by the Borough and devoted to active and/or passive recreation.
B. 
Word usage. When not inconsistent with the context, words used in the present tense shall include the future; words in the plural number shall include the singular number and words in the singular number shall include the plural number. The word "shall" is always mandatory and not merely directory.
Within any park or recreation area, no person shall dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or other trash. No such refuse or trash shall be placed in any water in or contiguous to any park or left anywhere on the grounds thereof, but shall be placed in the proper receptacles where these are provided. Where receptacles are not so provided, all such rubbish or waste shall be carried away from the park by the person responsible for its presence, and the same shall be properly disposed of elsewhere.
No person shall within a park or recreation area:
A. 
Bring alcoholic beverages, nor shall any person drink alcoholic beverages or have said alcoholic beverages in his possession at any time except where a permit therefor is obtained from the governing body, as herein provided.
B. 
Bring in or have in his possession or set off or otherwise cause to explode, discharge or burn any firecrackers or other fireworks, explosives or flammable material, or discharge or throw them into any such area from land or highway adjacent thereto. This prohibition includes any substance, compound, mixture or article that in conjunction with any other substance or compound would be dangerous from any of the foregoing standpoints; provided, however, that this prohibition shall not make it unlawful for those persons who have specifically received a permit from the governing body, as herein provided for such purpose, to conduct a fireworks display.

Parks and recreation areas shall be open to the public between the hours of 9:00 a.m. and 9:00 p.m. These hours shall be posted at an entrance to each park and recreation area within the Borough. Notwithstanding anything herein to the contrary, the hours of opening and closing may be extended by resolution of the governing body. No person shall remain or stay in any park or recreation area except during the open hours specified above, except with the express written permission of the governing body.
A. 
The governing body may from time to time, by resolution, designate certain parks or recreation areas that may be utilized only by the holder of a park permit. The parks or recreation areas so designated shall be posted accordingly.
B. 
Persons seeking issuance of a park permit hereunder shall file an application with the governing body. The application shall state the name and address of the applicant or the names and addresses of the person, persons, corporation or association seeking the permit and any other information which the governing body shall find reasonably necessary to make a fair determination as to whether a permit should be issued hereunder.
C. 
The governing body may issue a permit hereunder when it finds that the proposed activity or use of the park by such an organization or association:
(1) 
Will not unreasonably interfere with or detract from the general enjoyment of the park.
(2) 
Will not unreasonably interfere with or detract from the promotion of the public health, welfare, safety and recreation.
(3) 
Is not reasonably anticipated to incite violent crime or disorderly conduct.
(4) 
Will not entail unusual, extraordinary or burdensome expense or police operation for the Borough.
D. 
A permit may be granted to a person, provided that within one year of the application such person has not been held in violation of any provision of this article.
E. 
A permittee shall be bound by all park rules and regulations and applicable ordinances as fully as though the same were inserted in said permits, except for those exemptions specifically allowed and any violation thereof shall be cause for revocation of the permit.

The fees for the use of recreation facilities, including Green Acres, shall be as follows:
A. 
Tennis and basketball courts: $2 per hour per person for nonresidents; no charge for residents.
B. 
Playground. Depositor will sign contract and pay a $50 cleanup deposit. The deposit to be returned if the depositor cleans park after use. Public Works Department will inspect grounds after use.

Exemptions from any terms or provisions of this article may be granted only upon written application to the governing body whereupon the same shall be referred to the Director of Public Safety for his examination. If the Director of Public Safety finds that the exemption is warranted and will not hinder the enjoyment of parks and recreation areas by the public, he may issue written authorization to the applicant for the same, specifying the nature of the exemption, its terms and conditions and the requirement that the written authorization be carried on the person of a representative of the association, organization or person while acting under the exemption.
No person shall fail to produce and exhibit any permit or written authorization from the Borough upon the request of any police officer or other authorized person who shall desire to inspect the same with respect to enforcing compliance with the terms of this article.
The police and others authorized by the governing body of the Borough of Woodlynne shall enforce the provisions of this article. The enforcement officials above described shall have the authority to eject from the park any person acting in violation of this article.
A. 
Any adult who shall violate any of the provisions of this article or any rule promulgated hereunder shall, upon conviction, be punished by a fine not to exceed $500 or by imprisonment in the county jail for a period not to exceed 90 days, or both such fine and penalty.
B. 
Upon violation of any of the provisions of this article, a juvenile shall be issued a verbal warning of the nature of the violation. Upon a second and subsequent offense, a formal complaint shall be lodged against the juvenile in accordance with the laws of the State of New Jersey and the Borough of Woodlynne.

It shall be unlawful and a violation of this article for any person, firm, corporation or other entity to perform or permit to be performed any of the following acts within any park, playground or open space of the Borough:
A. 
Mark, deface, disfigure, injure, tamper with or displace or remove any building, bridges, tables, benches or other structures or equipment facilities of a park, playground or open space property or parts thereof whatsoever, either real or personal, or any trees, lawn shrubbery or other natural resource or part thereof.
B. 
Throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pond, lake, stream or other body of water in or adjacent to any park or open space area or any tributary, stream or storm sewer or drain flowing into such waters any substance, matter or liquid which will or is likely to result in pollution of said water.
C. 
Bring in or dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans or other trash. No such refuse or trash shall be placed in any waters in or contiguous to any park, playground or open space area or left anywhere on the grounds thereof, but shall be placed in the proper receptacles where same are provided; and where receptacles are not so provided, such rubbish or waste shall be carried away from the park or open space area by the person responsible for its presence and properly disposed of elsewhere.
D. 
Endanger the safety of any person by any conduct or act, including disturbing the peace or committing any assault, battery or fighting.
E. 
Possess or consume any narcotics or drugs in any park or open space or possess or consume any alcoholic beverage without the permission of the Borough, which permission shall designate the limited time and place of such permission.
F. 
Prevent any person from using park, playground or open space area or any of its facilities or interfere with such use in compliance with this article and the rules applicable to said use.
G. 
Operate, drive or park any automobile except on a street, driveway or parking lot in any park, playground or open space area or to park or leave any such vehicle any place other than the areas established for public parking. No two-wheeled motor vehicles shall be permitted in any park, playground or open space area except in specific locations provided for said use, if any.
H. 
Sell, vend, peddle or offer for sale any commodity or article within any park, playground or open space area without prior written permission from the Borough.
I. 
Use or cause to be used any loudspeakers, public address systems or amplifiers without first having obtained written permission from the Borough.
J. 
Hold, possess or use any firearm or weapon in or within 300 feet of any park, playground or open space area.
K. 
Molest, trap, capture or hunt, remove, injure or kill any animal or disturb its habitat except in portions of any park or open space area designated as open for fishing.
L. 
Swim in any pond, lake, stream or other body of water except for areas designated and posted as approved for swimming.
M. 
Operate or cause to be operated any motorboat or motored canoe on any stream, lake or body of water.
Any person, firm, corporation or other entity convicted of a violation of this article or any section hereof shall be punished by fine not to exceed $50 if said conviction constitutes a first offense. For any second or subsequent offense, said person, firm, corporation or other entity shall be sentenced to a fine not to exceed $500 or a term of imprisonment not to exceed 90 days, or both, at the discretion of the sentencing court.
