This Part shall be known as the "Montour Township Dog Barking Ordinance."

For the purposes of this Ordinance, the word "owner" when applied to the proprietorship of a dog, shall include every person having a right of property in such dog, and every person who keeps or harbors such dog or has it in his care, and every person who permits such dog to remain on or about any premises occupied by him.

It shall be unlawful for the owner of any dog to cause or permit such dog to bark or otherwise make any noise or disturbance which results in a nuisance as hereinafter defined.

The nuisance as contemplated by this Part shall be the unreasonable barking or making of noise by dogs, which noise interferes with or deprives any person of the peace, quiet, rest, sleep or legitimate enjoyment of their property within the Township.

Any unreasonable barking or other noise making by dogs shall be presumed by the proof of the continuous barking or making of such noise for two periods, each of which is in excess of 15 minutes, and both of which periods occur within 24 hours of each other.

Anyone found in violation of any of the provisions of this Part shall, upon conviction thereof by a Magisterial District Judge, be ordered to pay a penalty in the amount of $600. Each day a violation of any of the provisions of this Part occurs shall constitute a separate violation and shall be subject and distinct penalties.

The provisions of this Part shall be severable, and if any provision hereof shall be held to be unconstitutional, invalid or illegal, by any court of competent jurisdiction, such decision shall not affect the validity of any of the remaining provisions of this Part. It is hereby declared as legislative intent that this Part would have been enacted had such unconstitutional, invalid or illegal provision not been included herein.
