It shall be unlawful for any owner, occupants, tenants or other parties responsible for the care and upkeep of property situated within the Borough of Woodlynne to permit or maintain upon any such property dead, dying, unstable or overgrown trees that could be injurious to the public health, safety and general welfare.

A.
Upon the failure of any owner, occupants, tenants or other parties responsible for the care and upkeep of property situated within the Borough of Woodlynne to remove or otherwise abate a dangerous condition within 10 days after notice to remove same has been received from the Borough of Woodlynne, which notice may be effected by personal service or by certified and registered mail, return receipt requested, the Borough of Woodlynne shall or may cause the same to be removed under the direction of the Borough Administrator, and such Administrator shall certify the cost thereof to the governing body which shall examine the certification and if found correct shall cause the cost as shown thereon to be charged against said lands;

The amount so charged forthwith would become a lien upon such lands and shall be added to and form part of the taxes next to be assessed and levied upon such lands with the same to bear interest at the same rate as the taxes and shall be collected and enforced in the same manner as taxes and by the same officer as provided in N.J.S.A. 40:48-2.14, as amended.
In the event of an extreme emergency as declared by an official proclamation by the Director of Public Safety or the Mayor of Woodlynne, it shall be lawful for the Borough Administrator or his lawfully designated substitute to enter upon the private lands in the Borough to abate or otherwise remove the dangerous tree as is necessary to protect the public, health, safety and general welfare.
Any owners, occupants, tenants or other responsible parties who shall neglect to remove or otherwise abate the aforesaid dangerous trees shall be punishable by a fine or not more than $500 and imprisonment for 90 days, or both.
The collection of the fines or sentence imposed by this chapter shall not be construed to bar any lien of the Borough of Woodlynne to collect the cost as certified for the removal as such items as set forth herein in the manner herein authorized.
