The harboring of certain dangerous wild animals within the limits of the township is considered to be a nuisance because of the possibility of the animal escaping from confinement and because of the disturbing and unusual noises produced by them, and because nauseous and disagreeable orders arise from the premises where such animals are harbored, all of which are inimical to the proper and usual enjoyment of private property, and constitute a potential menace to the health, safety and welfare of the inhabitants of the community.

No person, firm or corporation shall harbor nor keep within the limits of the township, any lions, tigers, elephants, monkeys, or any other species or kind of dangerous wild animals, either singly or in collections provided that this chapter is not intended to prohibit and does not prohibit the harboring of any native wild animals, either singly or in collections within the limits of the township in accordance with the provisions of section BH9-3.

No person shall keep or maintain within the limits of the township any collection of native wild animals unless a permit for the keeping of the same shall have first been obtained from the board of health of the township.

Application for such permit shall be made to the clerk of the board and shall be granted upon resolution of the board; it being hereby intended that the board shall have the power to grant or refuse the issuance of such permit in the discretion of its members having regard for the safety, health and general welfare of the inhabitants who may be affected thereby, the nature of the premises whereon the collection of animals is sought to be kept, and the adequacy of the provisions for confinement of the animals. The board shall also have the power, in the discretion of its members, after issuing the permit, to revoke the same if the holder thereof fails to maintain the premises whereon the collection of animals is kept in accordance with the requirements of public health.

The permit shall apply only to the premises described therein and shall be valid for a term of one year from its date of issue.

The fee for each permit shall be $1, which shall be payable at the time of issuing the permit.
