A. 
As used in this article, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
PERSON
Any natural person, partnership, association, corporation, or other legal entity.
STREET VENDOR
A person engaging in the sale of any goods, wares, or merchandise upon any street, alley, sidewalk, or public ground, within the Borough of Loganton.

The singular shall include the plural; the plural shall include the singular: and the masculine shall include the feminine and the neuter.
No person shall act as a street vendor within the Borough of Loganton except on days during which a parade is held in the Borough of Loganton or special events approved by Loganton Borough Council.
On days when street vendors are permitted pursuant to § 205-2, any nonprofit organization shall be allowed without obtaining a permit to sell food or merchandise from a temporary stand along a public right-of-way within the Borough of Loganton, and street vendors who retain the profits from sales for the benefit of the street vendor shall be allowed to sell food or merchandise from a temporary stand along a public right- of-way with the Borough of Loganton provided that the street vendor has obtained a permit from the Secretary of the Borough of Loganton prior to the event. There shall be no fee charged by the Borough of Loganton for any permit issued in accordance with this provision. The Mayor of the Borough of Loganton or his designee shall be authorized to enforce this article.
Upon conclusion of the event permitting sales by street vendors, any street vendor shall dispose of any garbage or refuse generated by his activities and return the site to its condition prior to the event.
Any person who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine not more than $600, and in default of payment, to imprisonment for not more than 30 days. Each day that a violation of this article continues shall constitute a separate offense.
All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed.
If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this article. It is hereby declared as the intent of the Loganton Borough Council that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
