(a) 
Chapter 7, Code of General Ordinances, is hereby adopted and shall be the guidelines for code relating to building and construction within the City entitled, "Building Code."
(b) 
Violations of the City of Butler Building Code are punishable as provided in Section 1-7, Butler City Code.
(a) 
Chapter 7, Buildings and Building Regulations, shall also be known as the Building Code. Unless otherwise indicated by its use and context the term "this Code" shall refer to Chapter 7, Buildings and Building Regulations.
(b) 
The term "this Section" shall refer to the Article in which the term is used.
(c) 
The term "Building Official," when used throughout this Chapter shall refer to the officer or other designated authority charged with the administration and enforcement of this Code. Further, whenever the term or title "Administrator," "Responsible Official," "Authority Having Jurisdiction." "Director of Codes Administration," or other similar designation is used throughout this Chapter, shall be construed to mean the Building Official.
(d) 
Purpose.
(1) 
This Code shall be construed to secure its expressed intent, which is to benefit the public health, safety, and welfare insofar as they are affected by building construction.
(e) 
Required Fees. No person, firm, partnership, association, or corporation shall initiate or perform any work under the provisions of this Chapter without first having obtained a permit. There shall be charged and collected from the applicant a fee for each permit in accordance with the fee schedule that is currently adopted by the Butler City Council. Provided, however, that where work for which a permit is required is initiated prior to obtaining said permit, the fee specified for said permit may be doubled; provided, further, however, the payment of such double fee shall not relieve any person, firm, partnership, association, or corporation from fully complying with the requirements of the permit in the execution of any work nor any other penalties required herein.
(f) 
Liability. Requirements of this Chapter and all existing codes and ordinances in force shall not be construed as imposing any liability on the City, it's officers, agents, or employees and liability or responsibility for damages to any property or injury to any person due to defective installations. The City or any official, employee, or agent thereof shall not assume any liability or responsibility whatsoever by reason of inspection or approval of installation.
(g) 
Severability. If any part or parts of this Article shall be held invalid, such invalidity shall not affect the remaining parts of this Article. The City Council hereby declares that it would have passed the remaining parts of this Article if it had known that such part or parts would be declared invalid.
(h) 
Violations — Penalties. Violators of this Code shall be subject to penalties provided in the penalty provision of the Butler City Code, § 1-7, a fine not exceeding five hundred dollars ($500.00), or imprisonment for a term not exceeding ninety (90) days or both such fine and imprisonment. With respect to violations of this Code that are continuous with respect to time, each day the violation continues is a separate offense.
(i) 
Appeals. Appeals to this Chapter will be forwarded to the Zoning Board of Adjustment, the process of which is adopted in §§ 26-51 to 26-55, and 7-39 of the Butler City Code.
(j) 
Application Of Other Laws. The provisions of this Code shall not be deemed to nullify any provisions of local, state, or federal law. The provisions of this Code shall not be deemed to nullify any provisions of the zoning ordinance or any other ordinance of the City of Butler pertaining to location, or use of buildings, except as may be specifically required by the provisions of this Code.

There is incorporated by reference, for the purpose of adopting regulations, provisions, conditions, terms, and specifications, for the control of buildings and structures within the City: the issuing, suspension, and revocation of permits; the collection of fees; the making of inspections; the execution of plans reviews; and the fixing of penalties for violations thereof, the NFPA 70, National Electric Code, 2023 Edition, as published by the National Fire Prevention Association, Inc., and is hereby adopted by reference by the City of Butler, Missouri.
(b)

(a) 
Licensing Required.
(1) 
A license is the authority granted a person, firm, partnership, company, corporation, agency, or political institute to whom it is issued to engage in the business of performing certain work and is not transferable. A license shall be required for all types of work hereinafter classified and described:
a. 
Plumbing Contractors.
b. 
Electrical Contractors.
c. 
Mechanical Contractors.
d. 
Fire Sprinkler Contractors.
(b) 
All work in the above classifications for which a permit has been issued shall be required to have a qualified license and full-time employees to perform or supervise the work. The licensee shall have the responsibility for work requiring a permit under the provision of the Building Code without limitations, for the terms listed herein:
(1) 
Report all accidents to the Building Official.
(2) 
Provide minimum safety measures and equipment to protect workmen and the public.
(3) 
To observe any other City ordinances.
(4) 
To complete work only as authorized on the permit issued.
(5) 
To obtain inspections as required by the Building Code or the AHJ.
(6) 
Pay any fee assessed under the authority of the Building Code.
(7) 
To obey any order issued under the authority of the Building Code.
(8) 
To maintain satisfactory levels of competence, integrity, workmanship, and recognized factors.
(c) 
Renewal. Licenses shall be renewed each year. Any work performed after the expiration of the license shall be in violation of this Article. The Building Official may recommend the suspension or revocation of a license when the licensee commits any violation of this Article.
(d) 
Examination Required.
(1) 
Each person initially requesting a license as required in Section 7.11.002 will be required to score seventy percent (70%) or better on a written examination administered and prepared by the Building Official. If the applicant fails the examination, they are entitled to retake it after seven (7) days. If the applicant fails a second time, they must wait an additional thirty (30) days before reapplying.
(2) 
Testing may be waived by the Building Official if the applicant is licensed in another jurisdiction, or has passed an examination that is the equivalent or is of a standard equal to or higher than the City of Butler examination.
(e) 
License Fee. License fees shall be in accordance with the fee schedule adopted by the Butler City Council.
