The following costs shall be charged for copies and other requested
material from the municipality in accordance with N.J.S.A. 47:1A-5.b.
a. Basic per page copy fees, actual cost not to exceed:
1. 8 1/2 x 11 $0.05 per page.
2. 8 1/2 x 14 $0.07 per page.
3. Should the actual costs to produce paper copies exceed the $0.05
and $0.07 rates, the municipality may charge the actual cost of duplication;
4. The Borough will provide electronic records free of charge (i.e.
records sent via e-mail and fax); and
5. The Borough will charge the actual cost to provide records in another
medium (i.e computer disc, CD-ROM, DVD).
b. If the Borough demonstrates that its actual costs for duplication
of a government record exceed the foregoing rates, the Borough shall
charge the actual cost of duplicating the record. The actual cost
of duplicating the record, upon which all copy fees are based, shall
be the cost of materials and supplies used to make a copy of the record.
Access to electronic records and non-printed materials shall be provided
free of charge, but the public agency may charge for the actual costs
of any needed supplies such as computer discs. (N.J.S.A. 47:1A-5)
c. Special Services Cost. If the inspection and/or photocopying of public
records requires more than 30 minutes per day of a municipal employee's
time, a special services charge equal to the "actual cost" of that
employee's time shall be charged. The requester shall be advised of
the hourly rate of the employee and estimated time anticipated for
the work. If the requester wishes to proceed with the production of
the records, he shall provide payment for the special services fee
prior to commencement of the work. The Borough shall provide a statement
of the hours which were spent on the request. If the hours are less
than anticipated, the excess funds shall be returned to the requester.
d. Deposit. A 50% deposit will be required on all photocopy requests
estimated by the Municipal Clerk to cost $20 or more.
