There shall be in and for this Borough a Board of Health in accordance with "An Act to establish in this state, Boards of Health and a Bureau of Vital Statistics, and to define their respective powers and duties," as amended, in accordance with N.J.S.A. 26:3-1, et seq. Pursuant to N.J.S.A. 26:1A-15 and 26:3A2-1, et seq., a local Board of Health may either provide all of the requisite activities itself or contract with another local Board of Health or County Health Department.
The said Board of Health shall consist of five members appointed by the Mayor with the approval of the Council, which members of said Board shall hold said office for the term of three years, except in the case of vacancies; vacancies shall be filled for the unexpired terms. The initial Board shall be appointed as follows:
A. 
Two members to serve for three years.
B. 
Two members to serve for two years.
C. 
One member to serve for one year.

Said Board of Health shall appoint a Registrar of Vital Statistics, Clerk and health officer; and may also appoint such other agents, officers or assistants as said Board of Health shall deem necessary, and said officers and assistants shall be governed by the rules of said Board. The police officers of the Borough are authorized as special health officers and they shall promptly report to the Board of Health every violation of the Health Ordinance of the Borough which may occur within their observation or knowledge.
Said Board of Health shall not contract any debts of any kind beyond the amount of the appropriations as made for its use by the Borough Council.

As used in this Chapter, unless the context otherwise requires:
CODE
Printed code regulations or set of regulations, standards or set of standards concerning, affecting or relating to the subject matter of any such ordinance of substantially uniform character, approved by the State Department of Health.
ENFORCING OFFICIAL
The Health Officer or other official authorized by the Board of Health to enforce this ordinance.
LOCAL BOARD OF HEALTH
A county or municipal Board of Health, or the board of health of any regional, local or special health district, having power to regulate, by ordinance, public health or sanitation.
PERSON
An individual, firm, corporation, association, society, partnership, and their agents or employees.
PRINTED
Includes lithographing and any other method of duplicating.
RELATED DOCUMENT
Any printed document or part thereof adopted by reference in a code directly, or by successive adoptions by reference through other printed documents.

Codes defining and prohibiting certain matters, things, conditions or acts and each of them as a nuisance, prohibiting certain noises or sounds, requiring the proper heating of apartments, prohibiting lease or rental of certain buildings, prohibiting spitting in or upon public buildings, conveyances or sidewalks, authorizing the inspection of premises by an enforcing official; and providing standards consistent with minimum health and safety requirements and covering, but not limited to, matters such as water supply, plumbing, garbage storage, lighting, ventilation, heating, egress, maintenance and use and occupancy, and providing for the removal or abatement of certain nuisances and recovery of expenses incurred by the Board of Health in removing or abating such nuisances and prescribing penalties for violations are hereby established. A copy of said codes are annexed hereto and made a part hereof without the inclusion of the text thereof herein.
The said codes established and adopted by this ordinance are described and commonly known as the "Public Health Nuisance Code of New Jersey (1953)" and "The New Jersey State Housing Code," N.J.S.A. 2A:42-76, et seq. Three copies of the said "Public Health Nuisance Code of New Jersey (1953)" and "The New Jersey State Housing Code", N.J.S.A. 2A:42-76, et seq., have been placed on file in the office of the Borough Clerk upon the introduction of this ordinance and will remain on file there for the use and examination of the public.

Any person who violates, or neglects to comply with any provision of this ordinance or code established herein or notice issued pursuant thereto, shall upon conviction thereof, be liable to a penalty of not less than $25 nor more than $250 for each violation; and or a period of community service not to exceed 10 days. Whenever such person shall have been officially notified or by service of a summons in a prosecution, or in any other official manner, that said person is committing a violation, each day's continuance of such violation after such notification shall constitute a separate offense, and punishable by a like fine or penalty.

Should any section, clause, sentence, phrase or provision of this ordinance be declared unconstitutional or invalid by a Court of competent jurisdiction, such decision shall not affect the remaining portions of this ordinance.

All prior ordinances or parts of ordinances inconsistent with this ordinance be and the same are hereby repealed to the extent of such inconsistencies.

This ordinance shall take effect immediately upon its final passage and publication in accordance with law.
