The Village may, by resolution of its governing body, levy and collect
special assessments upon property in a limited and determinable area
for special benefits conferred upon the property by any municipal
work or improvement; and may provide for the payment of all or any
part of the cost of the work or improvement out of the proceeds of
the special assessments.
The procedures of § 66.0703, Wis. Stats., and as from time
to time amended, are hereby adopted into this Code by reference as
if set forth fully herein.
Notwithstanding Village Code § 13-1, the Village may at any time, by ordinance, provide that the cost of installing or constructing any public work or improvement shall be charged in whole or in part to the property benefited, and make an assessment against the property benefited in the manner that the Village Board determines. Such a special assessment is a lien against the property from the date of the levy.
Every ordinance under this section shall contain provisions for reasonable
notice and hearing. Any person against whose land a special assessment
is levied under the ordinance may appeal in the manner prescribed
in § 66.0703(12), Wis. Stats., except that such appeal must
be made within 40 days of the date of the final determination of the
Village Board.
In addition to all other methods provided by law, special charges
for current services may be imposed by the Village Board by allocating
all or part of the cost of the service to the property served. Such
services may include, but are not limited by way of enumeration herein
to, snow and ice removal, weed elimination, street sprinkling, oiling
and tarring, repair of sidewalks or curb and gutter, garbage and refuse
disposal, recycling, stormwater management, including construction
of stormwater management facilities, tree care, removal and disposition
of dead animals, loan repayment under § 70.57(4)(b), Wis.
Stats., soil conservation work under § 92.115, Wis. Stats.,
and snow removal under § 86.105, Wis. Stats.
The Village Board may determine the manner of providing notice of
a special charge. However, before a special charge for street tarring
or the repair of sidewalks, curbs or gutters may be imposed, the Village
Board shall conduct a hearing on whether the service in question shall
be funded in whole or in part by a special charge. Notice of the hearing
shall be given as provided in § 66.0627(3)(b), Wis. Stats.
The procedures of § 66.0627, Wis. Stats., and as from time
to time amended, are hereby adopted into this Code by reference as
if set forth fully herein.
The Village of Stratford Water and Electric Utility shall be authorized
to collect for arrearages for services provided by such Utility, together
with any penalty assessed or added thereon, and directs the Utility
to use the procedures set forth in § 66.0809, Wis. Stats.,
for these purposes.
