A private garage or carport for not more than one automobile for each dwelling unit on a lot used for townhouses provided, however, that in no case shall there be permitted more than 10 automobiles per garage or carport;
(3) 
Swimming pools;
(4) 
Tennis courts;
(5) 
Tool sheds or similar storage buildings not exceeding 120 square feet;
(6) 
Outdoor barbecue structures;
(7) 
Fences as regulated by ordinance;
(8) 
Home professional offices and home occupations;
(9) 
Boat docks for pleasure craft owned or leased and operated by residents and/or their guests (No commercial boating or marine development is permitted whatsoever). Docks, bulkheads and private marine construction and operations shall comply with all applicable state and federal regulations. A building permit from the borough is required for same and shall not be issued until all State and Federal approvals are on file with the Borough Clerk.
C. 
Conditional uses subject to issuance of conditional use permit pursuant to borough ordinance:
(1) 
Private and public nonprofit educational facilities as regulated by the New Jersey State Department of Education;
(2) 
Churches and other places of public worship.
D. 
The Schedule of Area, Yard and Building Requirements of the Zoning Ordinance of the Code of the Borough of Neptune City to include the following requirements for the R-1T Single Family Residential/Townhouse Zone.[1]
E. 
Site plan approval. The Land Use Board or applicable reviewing board, in addition to its duties pursuant to law, shall be required to make the following findings of fact and conclusions prior to granting any form or type of site plan approval for townhouse development:

(1) 
That the proposed townhouse development conforms to the zoning ordinance;
(2) 
That the proposals for maintenance and conservation of the common open space are reliable, and the amount, location and purpose of the common open space are adequate;
(3) 
That provision through the physical design of the proposed development for public services, control over vehicular and pedestrian traffic, and the amenities of light and air, recreation and visual enjoyment are adequate;
(4) 
That the proposed development will not have an unreasonably adverse impact upon the area in which it is proposed to be established;
(5) 
In the case of a proposed townhouse development which contemplates construction in phases and/or over a period of years, terms and conditions shall be included to protect the interest of the public and the interest and use and enjoyment of the existing residents, occupants and owners of any existing development during construction.
All applications for townhouse multifamily development pursuant to this chapter shall acquire the approval of federal, state and county agencies, where applicable; including without limitation, compliance with all DEP and CAFRA laws and regulations that deal with or involve wetlands, marsh areas and/or environmentally sensitive areas. Under no circumstances shall any building or construction or disturbance be allowed or permitted in wetlands and marsh areas as exist in this zone or in other zones in the borough. Any construction of bulkheads or docks for boats shall be subject to the acquiring of appropriate State and Federal approvals that shall be filed with the Borough Clerk prior to issuance of any building permit for same.
F. 
In the R-1T Single Family Residential/Townhouse Zone there shall be permitted no more than 130 townhouse dwelling units and same shall comply with the standards of this ordinance and require site plan approval.

Townhouses;
(2)

Retail stores and shops such as grocery stores, delicatessens, liquor stores, hardware stores, dry good stores, meat and poultry stores, flower shops, luncheonette, haberdashery and apparel shops and shoe stores, stationery stores, book stores;
(3) 
Personal service establishments such as barber shops, beauty shops, dry cleaning shops, tailor shops, self-service laundries, appliance repair shops;
(4) 
Business and professional offices and banks.
B. 
Permitted accessory uses.
(1) 
Same as permitted forth in the R-1 Single Family Residential Zone.
(2) 
Signs advertising the business of the owner or occupant conducted on the premises and as regulated by the ordinance of the Borough of Neptune City;
(3) 
Fences as required by ordinance; and
(4) 
Storage buildings as garages essential to the operation of the principal business use permitted provided same do not exceed 1,000 square feet and comply with all provisions of this chapter.
C. 
Conditional uses subject to issuance of conditional use permit pursuant to borough ordinance:
(1) 
Same as permitted in the R-1 Single Family Residential Zone;
(2) 
Hospitals and nursing homes.
D. 
Area, yard and building requirements. As specified in the Schedule of Area, Yard and Building Requirements.[1]
E. 
Supplemental regulations. Nothing shall be erected or displayed outdoors on business properties for any purposes, except that garbage and trash awaiting collection may be stored in a rear yard in a completely enclosed container.
Persons establishing uses in this zone are required to give particular attention to esthetic considerations, particularly in conjunction with structural design and the use of landscaping to soften building lines and provide visual breaks and parking areas and as may be required and approved by the Planning Board or other appropriate authority pursuant to the Borough Site Plan Review Ordinance and Law.
A. 
No premises shall be used and no structure shall be erected, altered or occupied for any purpose except the following:
(1) 
Same as permitted in the Residential Limited Commercial (RLC) Zone;
(2) 
Restaurants;
(3) 
Motor vehicles, trailer, camper and boat and marine salesrooms;
(4) 
Motels and hotels.
B. 
Permitted accessory uses.
(1) 
Same as permitted in the Residential Limited Commercial (RLC) Zone.
(2) 
Swimming pools accessory to motels and hotels; and
(3) 
One apartment unit per commercial structure for occupancy by single family only.
C. 
Conditional uses subject to issuance of conditional use permit pursuant to borough ordinance:
(1) 
Automobile and marine repair facilities;
(2) 
Service and gasoline filling stations;
(3) 
Hospitals and nursing homes.
D. 
Area, yard and building requirements. As specified in the Schedule of Area, Yard and Building Requirements.[1]
E. 
Supplemental regulations. Nothing shall be stored or displayed outdoors for any purpose except in compliance with the following provisions:
(1) 
New or used automobiles, or new or used boats, trailer, campers, or other types of drawn or propelled vehicles or displayed for sale or awaiting delivery are permitted. All display and storage are to be conducted on the same lot as the principal use. Said vehicles shall be stored on paved parking areas constructed in accordance with the standards established by the Site Plan Review Ordinance.
(2) 
All garbage or trash awaiting collection shall be stored in a rear yard area in a completely enclosed container.
(3) 
Products and materials necessary to and supplemental to a permitted principal use and which are customarily stored out-of-doors may be stored out-of-doors in a side or rear yard area, provided that:
(a) 
The area used for such outdoors storage shall be paved in accordance with standards established by the Site Plan Review Ordinance.
(b) 
All outdoor storage shall be screened from view from any public street.
(c) 
All materials stored out-of-doors shall be arranged and maintained in an orderly and safe manner and no outdoor storage shall be permitted within 10 feet of any street line or within five feet of any side or rear lot line.
(d) 
Persons establishing uses in the zone are required to give particular attention to esthetic consideration particularly in conjunction with structural design and the use of landscaping to soften building lines and provide visual breaks and parking areas and as may be required and approved by the Planning Board or other appropriate authority pursuant to the Borough Site Plan Review Ordinance and Law.

Municipal buildings and facilities and services essential to the operation and solely intended for the needs of the Borough of Neptune City subject to the general review and recommendation of the Planning Board of the Borough of Neptune City.
B. 
Permitted accessory uses.
(1) 
Same as permitted in the Residential Commercial Zone with the exception of any use intended for residential purposes.
C. 
Conditional uses subject to the issuance of conditional use permit pursuant to borough ordinances:
(1) 
Those conditional uses set forth in the Residential Commercial Zone with the exception of any conditional uses related to residential purposes.
(2) 
Class 5 licensed cannabis retailer without a cannabis consumption area. Specific conditions for this conditional use are set forth in § 139-53. Note: Hours of operation for Class 5 retailer license shall be limited to 10:00 a.m. to 9:00 p.m., Mondays through Saturdays, and 11:00 a.m.. to 8:00 p.m. on Sundays in the HC Commercial Zone.

D.

E. 
Supplemental regulations. Those supplemental regulations set forth in the Residential Commercial Zone.
Further, there shall be no outdoors storage or display except that garbage and trash awaiting collection shall be stored only in rear yard areas in completely enclosed containers as required by local ordinance and the Site Plan Review Ordinance.
A. 
No premises shall be used and no structure shall be erected, altered or occupied for any purposes except the following:
(1) 
Those uses permitted in the Residential Limited Commercial (RLC) Zone with the exception of any uses intended for residential purposes;
(2) 
Restaurants;
(3) 
Theatre, indoor assembly halls, bowling alleys and similar public recreational activities;
(4) 
Municipal buildings, facilities and service essential to the operation of and solely intended for the needs of the Borough of Neptune City subject to the general review and recommendation of the Planning Board of the Borough of Neptune City.
(5) 
Warehousing, provided (1) that the property is adjacent to Memorial Drive, (2) storage is entirely within an enclosed building, and (3) that the area dedicated for storage does not exceed 1/3 of the total floor area of the building.[1]

Whereas, the basic intended uses for the zone are not compatible with residential uses, and whereas the intermingling of these uses with residential uses might provide inimical to the health, safety and welfare of person residing within the confines of this zone, all residential uses are hereby excluded from this zone.
A. 
Permitted principal uses. No premises shall be used and no structure shall be erected, altered or occupied for any purpose except the following:

(1) 
Industrial, manufacturing and research uses such as but not limited to storage buildings and yards not including junk or salvage yards; manufacture of light machinery such as appliances; fabrication of metal products; fabrication of wood products; laboratories; food processing; fabrication of glass products; and industrial uses, manufacturing and research that could locate in a predominantly residential suburban community without creating a loss of desirability and value to the residential sectors of the community; provided that such uses conform in all respects to performance standards established in this chapter and other ordinances of this borough and conform with any and all applicable statutes and regulations promulgated by the State of New Jersey and its regulatory agencies and provided further that such uses are not expressly prohibited by the Zoning Ordinance of this borough;
(2) 
Warehouses;
(3) 
Public utility and service activities of an industrial nature such as repair and maintenance yards, storage facilities, depots and stations;
(4) 
Municipal buildings and services essential to the operation of and solely intended for the needs of the Borough of Neptune City subject to general review and recommendation of the Planning Board of the Borough of Neptune City.
(5) 
Administration offices for the management of the above.
(6) 
Those principal uses permitted in the Commercial (C) Zone with the exception of any use intended for residential purposes.

B.

Those buildings and uses which are essential to the operation of the principal use situated on the premises; that are incidental to and subordinate to such principal use and that conform to all performance standards established in this chapter and for said borough;

Fences as regulated by ordinance.
C. 
Conditional uses subject to the issuance of a conditional use permit pursuant to borough ordinances:
(1) 
Service and gasoline filling stations and automobile repair facilities.
(2) 
Sexually oriented businesses; subject to the provisions of Sections 139-4 and 139-57 of this chapter.

D.

E. 
Supplemental regulations. Those supplemental regulations as set forth for the Highway Commercial (HC) and Commercial (C) Zones aforesaid. The following uses are specifically prohibited in this zone:
(1) 
All nonindustrial uses;
(2) 
The following industrial uses:
(a) 
The manufacture or storage of pyroxolin plastics, explosives, fireworks or matches.
(b) 
Manufacturing of acetylene gas or ammonia.
(c) 
Manufacture of acids.
(d) 
Heavy chemical manufacture.
(e) 
Refining or manufacture of animal black, bone black or lamp black.
(f) 
Refining, blending or manufacture of fertilizer or potash.
(g) 
Incinerators, garbage and refuse disposal, junk yards, disposal dumps or landfills.
(h) 
Manufacture of disinfectants, insecticides or other poisons or toxic gases.
(i) 
Rendering or refining of grease, fat or tallow.
(j) 
Manufacture of dye.
(k) 
Manufacture of glue, size or gelatins where the process includes the recovery of products from fish, animal refuse or offal.
(l) 
Storage, cleaning, curing or tanning of rawhides or skins or the pulling of wool.
(m) 
Petroleum refining or the storage of petroleum products having a flash point of under 150° F., in excess of 300,000 gallons.
(n) 
Stock yards, slaughtering or processing of animals, fish or poultry or parts thereof.
(o) 
Coke ovens.
(p) 
The manufacture, storage, handling or distribution of asphalt or asphalt products.
