This article shall be known and may be cited as the "Lower Windsor Township False Alarm Ordinance."
The purposes of this article are to:
A. 
Promote the health, safety and welfare of the inhabitants of the Township; and
B. 
Encourage the proper installation, maintenance and operation of emergency alarm equipment in the Township; and
C. 
Minimize any danger to the public and emergency organization personnel that may result from the emergency personnel's response to false emergency alarms; and
D. 
Encourage prompt responses by emergency organization personnel to emergency alarms.
For the purposes of this article, the following words shall have the meanings ascribed to them in this section:
EMERGENCY ALARM EQUIPMENT
Any equipment used to transmit an alarm regarding an emergency involving any person or property in the Township to any emergency organization, or to any person responsible for relaying such alarm to any such emergency organization, for the purpose of obtaining a response to such emergency by any personnel of any such emergency organization.
EMERGENCY ORGANIZATION
Any police, fire or medical organization, and any personnel thereof; and any organization designated by Pennsylvania Law as an emergency organization, and any personnel thereof.
FALSE ALARM
Every transmission of an alarm regarding an emergency involving any person or property in the Township from any emergency alarm equipment to any emergency organization, or to any person responsible for relaying such alarm to any emergency organization, for the purpose of obtaining a response to such emergency by any personnel of any such emergency organization, when no such emergency is occurring.
PERSON
Any individual, partnership, public or private association or corporation, firm, trust, estate, municipality, governmental unit, public utility or any other legal entity whatsoever which is recognized by law as the subject of rights and duties.
TOWNSHIP
The Township of Lower Windsor, York County, Pennsylvania.

Any person who owns or possesses, or who jointly owns or possesses with another person or persons, any emergency alarm equipment shall take such precautions and actions, or shall cause such precautions and actions to be taken, as are necessary to prevent the transmission of false alarms as set forth in § 127-5, excluding any false alarms caused by any acts of God or electrical surges beyond the control of such person to prevent, from such emergency alarm equipment.

A person that owns, uses or possesses an alarm device or automatic dialing device may not, after causing or permitting three false alarms to occur in a consecutive twelve-month period, cause or permit a subsequent false alarm to occur in the same consecutive twelve-month period. A person that violates this section commits a summary offense and shall, upon conviction, be sentenced to pay a fine of not more than $300 pursuant to 18 Pa.C.S.A. § 7511 or such other amount as established by state law.
If any section, subsection, paragraph, sentence, clause or phrase of this article shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this article, which shall remain in full force and effect, and for this purpose the provisions of this article are hereby declared to be severable.
This article shall become effective five days after adoption.
