This article shall be known as the "Lower Windsor Township Residential Rental Registration Ordinance."
For the purposes of this article the following terms shall have the meaning ascribed herein:
LANDLORD
The record owner, as indicated by the records in the office of the Recorder of Deeds of York County, Pennsylvania, of real estate located within Lower Windsor Township, York County, Pennsylvania, which real estate is being rented or leased to or occupied by a tenant or tenants for residential purposes. The owner and/or operator of any mobile home park located within the confines of Lower Windsor Township shall be deemed to be a "landlord" under the provisions of this article.

TENANT
Any natural person 18 years of age or older occupying, whether or not for rent or other consideration, premises owned by a landlord as defined in this section.
A. 
Within 10 days after any tenant has moved into a landlord's premises, the landlord shall inform the Lower Windsor Township office in writing of the name and address of such tenant or tenants and the date on which the tenant or tenants moved into the premises.
B. 
Within 10 days after any tenant has vacated a landlord's premises, the landlord shall inform the Lower Windsor Township office in writing of the name and new address of such tenant or tenants and the date on which the tenant or tenants vacated the premises.
The landlord shall notify the Lower Windsor Township office, in writing, within 30 days after the effective date of this article, of the names, addresses, and approximate date of entry of the tenants currently occupying the landlord's premises; provided, however, that no such notification shall be required for any residential tenants already on file with Lower Windsor Township on the effective date of this article pursuant to the provisions of Ordinance No. 86-1.
Any person, partnership, association or corporation violating any of the provisions of this article shall be subject to a fine or penalty in an amount not exceeding $600 for each violation, which penalty may be collected by suit or by summary proceedings brought before a Magisterial District Judge.
Ordinance No. 86-1 is hereby repealed; provided, however, that the names of tenants furnished to Lower Windsor Township pursuant to Ordinance No. 86-1 shall continue to be in effect as though filed pursuant to the provisions of § 335-4 of this article.
This article shall become effective five days after enactment as provided by law.
