As used in this section:
ALUMINUM
Shall mean recyclable aluminum beverage cans, rinsed.
DESIGNATED RECYCLING CENTER
Shall mean the specific place designated by the Mayor and Council for disposal by residences of recyclable materials as set forth in the chapter.
GLASS
Shall mean products made from silica or sand, soda ash and limestone which are transparent or translucent and clear, green or brown in color and used for packaging or bottling of various matter and other materials commonly known as glass, excluding blue and flat glass commonly known as window glass.
METAL CANS
Shall mean metal and bi-metal cans.
PLASTIC JUGS
Shall mean white plastic jugs used for milk or water products, with caps removed, rinsed.
PLASTIC SODA BOTTLES
Shall mean clear or green plastic soda bottles with caps and rings removed, rinsed.
REGULATIONS
Shall mean and include such rules, implementation date, schedule of times and such other requirements promulgated and approved by the Mayor and Council as may be necessary to carry out the purposes and objectives of this section.
USED NEWSPAPER
Shall mean to include paper of the type commonly referred to as newsprint and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Expressly excluded, however, are all magazines or similar periodicals as well as all other paper periodicals of any nature whatsoever.

All persons, except those physically disabled or handicapped, who are owners, leasees, or occupant/tenants of residential properties in the Borough shall separate used newspapers, aluminum cans, plastic jugs, plastic soda bottles and metal cans from any other trash and garbage that is generated or produced by any such residences and shall separately bundle same for disposal at the designated recycling center in the Borough at a time when such designated recycling center is open to accommodate the public. Schedule of hours when the recycling center is open shall be determined by the Mayor and Council and promulgated by the regulations as set forth according to the terms of this section.

When feasible, limited curbside pickup of certain designated recyclable materials shall be conducted by the Borough and a schedule of dates and times, along with announcement as to specific recyclable materials designated for pickup, shall be determined by the Mayor and Council and so advertised in advance of pickup dates. Property owners, lessees, occupants or tenants of residential properties shall not be required to place recyclable materials curbside. The purpose of conducting limited curbside pickup of recyclable materials is for the convenience of residents. However, those residences who choose to place recyclable materials at curbside for pickup shall do so in the following form and manner:
a. 
Used Newspapers. Used newspapers shall be separated and secured in brown paper bags not to exceed 12 inches in height. Such bundles shall not be contained in plastic bags or bound by string, wire or other binding material. Wet newspapers will not be picked up.
b. 
Aluminum Cans. Aluminum cans shall be rinsed, separated and secured in suitable reusable containers supplied by the resident.
c. 
Glass. Glass shall be separated by color, clear, green and brown, rinsed, and secured in suitable reusable containers supplied by resident. Containers constructed of paper or cardboard shall be deemed unsuitable for this purpose. Caps must be removed from all bottles and jars.
d. 
Plastic Jugs. White plastic jugs shall be rinsed, with caps removed, and secured in suitable reusable containers supplied by the resident.
e. 
Plastic Soda Bottles. All clear plastic soda bottles shall be separated from green plastic soda bottles, caps and rings removed, rinsed, and secured in suitable reusable containers supplied by the resident.

All commercial, industrial and nonresidential property owners shall be required to recycle used newspapers, aluminum cans, glass, plastic jugs, and plastic soda bottles as defined in this section.

a. 
From the time of disposal by the resident at the designated recycling center, or the time of placement at curbside for pickup of any recyclable materials, the materials shall be the property of the Borough.
b. 
No person shall collect or pickup or cause to be collected or picked up any such recyclables left by residences at curbside.
c. 
No provision herein shall be construed to prohibit groups or individuals who shall be authorized by the Mayor and Council from collecting or picking up recycling at curbside or otherwise in such manner or under such terms and conditions as shall be prescribed by the Mayor and Council. No such collection or pickup shall conflict or interfere with pickup and collection in the Borough.

a. 
Any person, firm or corporation who shall violate or fail to comply with any provision of this section or any regulation promulgated pursuant thereto, shall, upon conviction thereof, be liable to the penalty stated in Chapter 1, Section 1-5.
b. 
Any residential garbage or trash placed at curbside for pickup by the Borough contractor that contains any recyclable material as described in subsection 17-1.1 shall not be picked up by the Borough Contractor.
