Editor's Note: The power of the municipality to adopt ordinances concerning traffic and parking is contained in N.J.S.A. 39:4-197. Various statutory provisions throughout Title 39 control the manner in which municipalities may regulate parking and traffic.

Whenever any words and phrases are used in this Chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this Chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a.
The Director of Public Safety or, in his/her absence, disability or inability to act, the Mayor and, in the event of his/her absence, disability or inability to act, then the Chief of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b.
Any regulations promulgated by the Director of Public Safety and in accordance with Subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c.
Any violation of this regulation promulgated there-under shall be punished by a fine not to exceed $50.
d.
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this Chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, otherwise regulated by a specific ordinance section, every person, firm or corporation convicted of a violation of a provision of this Chapter or any supplement thereto shall be liable to a penalty of $50 plus costs. Each and every day in which the violation exists shall constitute a separate violation.

If any part or parts of this Chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this Chapter.

All former traffic ordinances of the Borough are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this Chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Chapter.

The Governing Body finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations and utility work, above or below ground which requires blocking the street and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through and around construction and maintenance zones and to provide safety for the work forces performing these operations.
The Borough of Belmar, in the County of Monmouth, State of New Jersey does hereby adopt the current Manual on Uniform Control Devices for Streets and Highways hereafter known as the M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility who fails to comply with the provisions of the M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility, wishing to conduct work on, under or above the street to contact the Police Department of the Borough in order to arrange a preconstruction meeting and submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work, or whose plans are not approved by the Police Department of the Borough of Belmar is in violation of this section.

The person, contractor or utility shall provide at least two emergency contact telephone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If, for any reason, emergency contact must be made, or if the emergency contact person does not respond to a call from the Police Department to correct such hazardous condition, the Borough may respond to correct the hazardous condition(s). The reasonable fees for such emergency services by the Borough shall be charged to the person, contractor, or utility responsible for the condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. The officer in charge of the Borough Police Department may adjust this time limit permit work prior to 9:00 a.m. or after 4:00 p.m. If the officer in charge determines that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. or after 4:00 p.m.

Road closings and/or traffic detours shall not be permitted unless approved by the Borough Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safe and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County Jail for a term not exceeding 90 days. For a second offense, the person, contractor or utility shall, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County jail for a term not exceeding 90 days. A separate offense shall be deemed committed on each day during or on which violation occurs or continues.

The provisions of this Chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b.
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a.
Whenever snow is anticipated and the accumulation is such that it would cover the streets or highways, the Mayor may make a determination that no vehicle shall be parked on the streets or highways or portions thereof. Residents shall be given 12 hour notice of said determination by way of reverse 911 phone notification (e.g. Code Red) and posting on the Borough's web-site.

All vehicles shall be parked off-street in driveways or in other permissible off-street parking areas until both sides of the street have been plowed sufficiently and to the extent that parking will not interfere with normal flow of traffic.
2.
If there is insufficient driveway space or insufficient space in other permissible off street parking areas, then all vehicles shall be parked on the side of the street containing even numbered properties; then within 24 hours after the side of the street containing odd numbered properties has been plowed sufficiently and to the extent that parking will not interfere with normal flow of traffic, all vehicles shall be moved to the side of the street containing odd numbered properties until the streets have been plowed sufficiently and to the extent that parking will not interfere with normal flow of traffic.
b.
Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police or Code Enforcement Officer may ticket that vehicle. In the event of a state of emergency declared by the Governor of the State of New Jersey and the Mayor of Belmar, any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
c.
Any person, firm or corporation violating any of the provisions of this section shall, upon conviction thereof, shall be subject to a penalty not to exceed $150. Each and every day in which the violation exists shall constitute a separate violation.

No person shall stop or stand a vehicle between the hours specified on any day (except Sundays and public holidays) upon any of the streets or parts of streets described.

No person shall park any vehicle with six or more wheels, dump trucks, box trucks (which shall mean any vehicle with a separate cab and box-type structure), vehicles over 18,000 pounds, or vehicles greater than eight feet in height, a school bus, any type of bus, recreational vehicle, camper, boat or trailer, however not including six-wheel pickup trucks or trucks utilized for the purpose of making deliveries or moving furniture, and not including any vehicle with handicap license plates or properly issued and displayed handicap placard, between the hours specified, upon any of the streets or parts of streets described.

a.
The parking or standing of any vehicle, motor vehicle, motorcycle, or similar conveyance, hereinafter a "vehicle" on the streets within the areas, during such times and for such vehicles as designated from time to time by resolution of the Mayor and Council shall only be permitted by vehicles to which are affixed a Borough-issued parking permit authorizing the vehicle to park in that zone in accordance with this section.
b.
Permit parking shall be effective and will be enforced only within such areas of each Permit Parking Zone approved by resolution of the Mayor and Borough Council, and as shall be designated by appropriate signage on each street on which the applicable permit parking restrictions as authorized herein shall be in effect.
c.
During all times that streets are not subject to permit parking restrictions, all other applicable parking and related laws, rules and regulations shall apply.

a.
A vehicle parking in a Permit Parking Zone during the time designated for permit parking must display a valid parking permit decal or hang-tag issued by the Borough of Belmar Police Department. Parking permit decals shall be affixed to the driver's side of the windshield and shall be clearly visible from outside the vehicle at all times. Permit parking hang-tags shall be hung from the vehicle's interior rear view mirror or other conspicuous place in the front windshield and shall be clearly visible from outside the vehicle at all times.
b.
Parking permit decals may be obtained through the Belmar Police Department during normal business hours. Applicants for a parking permit shall complete and submit a parking permit application form, which shall require the license plate number of the vehicle and the Belmar address at which the permittee resides, and such other information as the Chief of Police may reasonably require to effect the purposes of this section. No parking permit shall be issued except upon the submission of identification or other reliable documentation reasonably satisfactory to the Belmar Police Department establishing that the owner, lessee or regular user of the vehicle in question lawfully resides at a residence located in the Permit Parking Zone to which the permit applies.

a.
It shall be unlawful and a violation of the provisions of this section for any person to cause or allow any vehicle to be parked or to stand in any permit parking area without having a permit to do so and without displaying the same on the vehicle as provided herein.
b.
In addition to the imposition of a violation pursuant to Subsection 19-18.3a, any vehicle, without having a permit to do so and without displaying the same as provided herein, that occupies any parking space in a permit parking area for more than 24 hours may be towed and the owner shall pay the costs of any unpaid tickets, as provided for in § 19-3, before regaining possession of the vehicle.
c.
It shall be unlawful and a violation of the provisions of this section for any person to falsify, alter or reproduce a parking permit decal or hang-tag.

Subject to other restrictions contained in this Chapter, the parking of vehicles is permitted at a 45° angle to the curbs as indicated by marks and signs on the streets, parts of streets, and other areas described.
b.
All vehicles parked in such angle parking spaces shall be parked head-on in the space, such that the rear of the vehicle is closer to the lane of travel from which entry to the parking space is made than the front of the vehicle. The phrase "lane of travel from which entry to the parking space is made" means that lane of travel or street providing access to the parking space without requiring a vehicle to cross over or pass through any other designated parking space or any area on which vehicular traffic is prohibited.

No taxicab shall discharge or pick up passengers during the hours set forth in Subsection 19-39.1 and within 300 feet of a taxicab stand, unless the area designated as a taxicab stand is occupied, in such a case the taxicab shall discharge or pick up passengers at the next closest and available parking space.

It shall be unlawful and a violation of the provisions of this section for any person to cause or allow any vehicle to be parked or to stand in any designated taxicab stand during the times set forth in Subsection 19-39.1. Every person violating the provisions of this section shall upon conviction thereof, be subject to a fine of:

Upon the issuance of a ticket to a taxicab operator pursuant to Subsection 19-39.3a, the owner of the taxicab shall receive a written notice, from the Belmar Police Department, of the issuance of the ticket. If an individual taxicab operator is found, or pleads, guilty to three tickets within a twelve-month period the taxicab owner shall receive a ticket and shall, upon conviction thereof, be subject to a fine of $300 plus costs.

The provisions of this subsection shall regulate the parking of vehicles within paid parking zones as hereinafter designated; the designation, use and operation of mobile parking application platforms; and the payment of fees prescribed herein.
a.
Designation of paid parking zones. The streets or parts of streets described to be designated as parking zones shall be set by resolution of the governing body.
b. MOBILE PARKING APPLICATION PLATFORM
Definitions. As used in this subsection:
Any mobile platform software available for paid parking to be used via telephone, mobile app on a smartphone or tablet, or via the internet on a computer, tablet or smartphone.
c.
Parking fees and time limitations: shall be set by resolution of the governing body.
d.
Hours of operation: shall be set by resolution of the governing body.
e.
Marking of spaces; legal parking periods. The parking zones established by this section shall be designated by appropriate markings outlining individual parking spaces.
f.
General regulations and prohibitions.
1.
It shall be unlawful for any person to cause, allow, permit or suffer any vehicle registered in his, her or its name to be parked in any parking space herein designated or to be hereafter designated in violation of the provisions of this subsection.
2.
It shall be unlawful to park any vehicle across any line or marking designating a parking space or to park any vehicle in any way that the same will not be wholly within a parking space as designated by the lines or markings.
g.
Enforcement. It shall be the duty of the members of the Belmar Parking Authority and Belmar Police Department to enforce the provisions of this section.
h.
Penalties. In addition to any other penalty provided in this chapter, any vehicle which has been ticketed for a violation of this section, and which remains continuously in the same paid parking space for more than 24 hours, will be towed at the vehicle owner's expense.

This section shall apply to the operation of all ride-share services within the Borough of Belmar, County of Monmouth, State of New Jersey. "Ride-share service" shall be defined as those participating in any arrangement in which a passenger travels in a private vehicle driven by its owner or its owner's duly authorized representative for a fee, regardless of whether arranged by means of a website or mobile-based application or internet-based application. This section shall not be applicable to taxicabs, autocabs, livery services, or livery vans possessing a license pursuant to Chapter 21 of the Borough's Revised General Ordinances.

The following areas are designated as ride-share pick-up/drop-off zones and shall be used only for the pick-up or discharge of passengers by ride-share services and like businesses by whatever name employed (hereinafter, "ride-share services"). During the times specified, all other vehicles shall be towed and subject to the penalties set forth below.
a.
From 7:00 p.m. to 3:00 a.m. the following areas shall be used only by ride-share services for the pick-up or discharge of passengers:

Belmar Marina Entrance at the intersection of Route 35 and Tenth Avenue, five parking spots on the north side of the marina entrance island shall be designated as ride-share pick-up/drop-off zones and shall be delineated by appropriate signage.
2.
Main Street, westside, beginning at the southwest corner of Main Street and Fifteenth Avenue along the westerly curbline 20 feet south and continuing 102 feet south.
3.
Ocean Avenue, westside, beginning at the northwest corner of Ocean Avenue and Nineteenth Avenue along the westerly curbline 20 feet north and continuing 127 feet north.
4.
Eighth Avenue, southside, beginning at the southwest corner of Main Street and Eighth Avenue along the southerly curbline 20 feet west and continuing 60 feet west.

Subject to other restrictions contained in this Chapter, the parking of vehicles is permitted at a 45° angle to the curbs as indicated by marks and signs on the areas described.
b.
All vehicles parking in such angle parking spaces shall be parked head-on in the space, such that the rear of the vehicle is closer to the lane of travel from which entry to the parking space is made than the front of the vehicle.

In accordance with the provisions of N.J.S.A. 40:48-2.46, on the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the regulations listed herein. No person shall operate or park a vehicle in violation of the following regulations.

Parking Prohibited During Certain Hours at Certain Locations. No person should park a vehicle between the hours specified any day (except Sundays and public holidays) in any of the locations described.

No person shall park a vehicle in a designated fire lane in any of the locations described:
a.
The alleyway of Bel Haven condominiums property, located at 109-111 Second Avenue, which starts at a point on "A" Street continuing to the easterly border of the property and then northerly to Second Avenue shall be designated as a fire lane.

No Parking Anytime. No person shall park a vehicle at any time upon any of the following described areas shown as Area A on the attached site plan.

Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, fire hydrants, oil fills, any grass area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle, at the owner's or operator's expense.
i.
Speed Limits. Speed limits shall be established for the entire Marine Basin at 15 miles per hour. Regulatory and warning signs shall be erected and maintained as required in § 19-30, Speed Limits.
j.
Stop Signs. No streets within the Marine Basin are designated as through streets. Stop signs shall be installed as follows:
Marine Avenue and Ninth Avenue: A STOP sign shall be installed on Ninth Avenue.

k.

The governing body of any municipality may, by ordinance, authorize the Mayor or other chief executive officer of the municipality, or the officer in charge of streets in any municipality not having a chief executive officer, if he shall find that a safety problem exists for ingress and egress to any public or private school or for the provision of recreational facilities for children attending such school, or both, due to a lack of a suitable area surrounding the school, to close by regulation any portion of any street within the block upon which such school is located to the use of through traffic during such time as he shall determine, not to exceed one hour between 7:30 and 10:00 a.m., two hours between 11:00 a.m. and 2:00 p.m., and one hour between 2:30 p.m. and 4:30 p.m., on any days upon which such school is in session, and to permit the use of said portion of said street, during said hours, for ingress and egress to such school and for the use by the pupils of such school for recreational purposes under proper supervision, and to provide adequate police facilities for such supervision and for the control of traffic upon such portion of said street, which ordinance shall provide for the posting of proper warning signs in said street, indicating that said street is so closed and the purpose thereof, during the time when the same is so closed, and shall provide penalties for the violation of terms of such ordinance or of any regulation promulgated thereunder.

A two- or three-wheeled vehicle with fully operable pedals and an electric motor of less than 750 watts, that meets the requirements of one of the following classifications: "class 1 low-speed electric bicycle" which means a low-speed electric bicycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour; or "class 2 low-speed electric bicycle" which means a low-speed electric bicycle equipped with a motor that may be used exclusively to propel the bicycle, and that is not capable of providing assistance when the bicycle reaches the speed of 20 miles per hour. "Low-speed electric scooter" means a scooter with a floorboard that can be stood upon by the operator, with handlebars, and an electric motor that is capable of propelling the device with or without human propulsion at a maximum speed of less than 19 miles per hour.
Any vehicle being operated for or on behalf of the municipality so as to provide police, fire, medical, security, code enforcement or other services for the municipality.

The operation of any motorized vehicle or means of conveyance including but not limited to any motorized bicycle, tricycle, scooter, skateboard, ball or single wheel apparatus shall be prohibited on the streets, sidewalks, boardwalk, paths and public properties located in the Borough of Belmar except as provided herein or as specifically permitted under Title 39 of the Statutes of the State of New Jersey, N.J.S.A. 39:1-1 et seq. Nothing herein shall be deemed to apply to any public safety vehicle.

The operation of a low-speed electronic bicycle (LSEB) shall be permitted in the Borough of Belmar subject to the following rules and regulations:
a.
Observance of traffic controls. All persons operating an LSEB in the Borough of Belmar shall be subject to all of the duties applicable to the driver of a vehicle by chapter four of Title 39 of the Revised Statutes and all supplements thereto including the obligation to obey the instructions of official traffic control signals, signs and other control devices applicable to motor vehicles, unless otherwise directed by a police officer.
b.
Helmet. Persons are not permitted to operate or ride upon an LSEB unless they wear a protective helmet. Any helmet shall be of a type acceptable for use pursuant to N.J.S.A. 39:4-10.1
c.
Passengers. No LSEB shall be used to carry more persons at one time than the number for which it is designed and equipped.
d.
Lights and reflectors.
1.
All LSEB shall be equipped with a working front headlight, a working rear taillight and a red reflector mounted on the rear of the bicycle.
2.
The front headlamp, at minimum, shall emit a white light visible from a distance of at least 500 feet to the front; and the rear taillight, at a minimum, shall emit a red light visible from a distance of at least 500 feet to the rear.
3.
No person shall operate or ride upon any LSEB during nighttime without having lighted headlights and lighted taillights.
e.
Audible signal. An LSEB must be equipped with a bell or other audible device that can be heard at least 100 feet away. However, the LSEB shall not be equipped with a siren or whistle.
f.
Hitching on vehicle prohibited. No person operating an LSEB shall attach themselves by any means to any automobile, truck, or any other form of motorized vehicle or form of conveyance. Nor shall the operator of the LSEB knowingly permit any person who is not a lawful passenger to attach themselves by any means to the LSEB or persons riding thereon.
g.
Feet and hands on pedals and handlebars. All operators of an LSEB shall keep their feet on the pedals and both hands on the handlebars at all times. It shall be prohibited to practice or perform any trick, stunts or fancy driving while operating an electric bicycle on public property including all public streets and roadways located in the Borough.
h.
Operating regulations. Every person operating an LSEB on a roadway shall ride as near to the right side as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction. An operator of an LSEB may move left under any of the following conditions:
i.
Prohibited locations. No person shall ride an LSEB upon a sidewalk, boardwalk path, or other walkway; or upon any other public property not specifically designed for use by motor vehicles within the Borough of Belmar.
j.
Carrying items. No person operating an LSEB shall carry any package, bundle or article which prevents the rider from keeping both hands upon the handlebars.
k.
Parking. No person shall park an LSEB upon a street except where an appropriate rack or spots are provided. All LSEB, when parked on sidewalks, shall be parked only in such manner as not to obstruct or impede the normal movement of pedestrian or other traffic or access to adjacent buildings.
l.
Speed. No person shall operate an LSEB at a speed in excess of 20 miles per hour except where necessary to do so for the safety of the operator or other members of the public.
m.
Reckless or careless riding. No person shall ride an LSEB in a reckless or careless manner which endangers or is likely to endanger the safety or welfare of other persons or property.

Enforcement of this section shall be under the jurisdiction of the Belmar Police Department.

Each person violating any provision of this section shall, upon first conviction, be liable to a penalty of $50, and upon a second conviction or subsequent alleged offense shall be liable to a penalty of $100. No court appearance shall be required for first, second or subsequent alleged offenses.
