A. 
In accordance with the New York State Clean Indoor Air Act, smoking and vaping are prohibited indoors throughout all Town facilities and properties. The term "facilities" includes Town-owned vehicles.
B. 
Smoking and vaping are permitted in certain designated outdoor areas identified by "SMOKING PERMITTED" signs.
Conflicts should be brought to the attention of the appropriate supervisory personnel. Employees may also file a formal complaint with the Broome County Commissioner of Health.
Employees found smoking or vaping outside of designated smoking areas will be considered in violation of this chapter and may be subject to penalties.

Use of tobacco and marijuana products within all publicly owned or leased swimming pools and pool grounds, public parks, playgrounds, ball fields, spectator areas and all other recreational areas leased or owned by the Town shall be prohibited within the Town of Chenango.
As used in this chapter, the following terms shall have the meanings indicated:
PUBLICLY OWNED OR LEASED SWIMMING POOLS AND POOL GROUNDS, PUBLIC PARKS, PLAYGROUNDS, BALL FIELDS, AND ALL OTHER RECREATIONAL AREAS LEASED OR OWNED BY THE TOWN
Any place or area within the Town upon which the public is invited or upon which the public is permitted and where children gather for recreational activities.
SMOKING
The burning of a lighted cigar, cigarette, pipe or any other matter or substance that contains tobacco or marijuana.

VAPING
The use of an electronic device that delivers vapor which is inhaled by the user thereof.
Any person who is found to have violated this chapter shall be subject to the following:
A. 
For an offense by any, a fine of no less than $50 and a maximum of $1,000 per offense will be issued; or
B. 
At the judge's discretion, the judge may suspend the fine in lieu of attendance by the offender, at his or her own expense, in a smoking cessation program recommended by the local health department, including the dangers of smoking, tobacco use, marijuana use, and secondhand smoke.

The Town will affix permanent signage indicating "Smoking-Free Zone" at all such publicly owned or leased playgrounds, athletic fields and spectator areas, swimming pools and pool grounds, and all other public parks and recreation areas leased or owned by the Town.
