Whenever any words and phrases are used in this Chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this Chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the City.

The provisions of this Chapter imposing a limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in R.S. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING SIGNS when weather conditions, accidents, fires or public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification the EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I which can be found in Chapter 7A.

No person shall park a vehicle between the hours specified in Schedule II of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule II which can be found in Chapter 7A.

No person shall stop or stand a vehicle at any time of any day upon any of the streets or parts of streets described in Schedule III which can be found in Chapter 7A.

No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV of any day upon any of the streets or parts of streets described in Schedule IV which can be found in Chapter 7A.

No person shall park a vehicle at any time of any day at other than the angle to the curb as indicated by the signs or marking upon any of the streets or parts thereof described in Schedule V which can be found in Chapter 7A.

a. 
No vehicle, as defined in N.J.S.A. 39:1-1 et seq., exceeding twenty-two (22') feet in length, or commercial vehicle likewise defined in N.J.S.A. 39:1-1 et seq. weighing more than ten thousand (10,000) pounds GVWR shall be permitted to be parked upon any street, alley or right-of-way at any time within the City of Ocean City.
b. 
Vehicles not exceeding twenty-two (22') feet in length and not weighing more than ten thousand (10,000) pounds GVWR may park upon the street, alley or right-of-way in Ocean City only in accordance with § 4-32 and 23-501 of these Revised General Ordinances.
a. 
Whenever snow has fallen and the accumulation is such that it covers the streets or highways, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof indicated.

The above parking prohibitions shall remain in effect after the specified hours on any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Mayor and in accordance with Section "a" above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed fifty ($50.00) dollars.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.
a. 
The Mayor or, in the event of his absence, disability or inability to act, then the Chief of Police of the City of Ocean City, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hour son any day or days whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Mayor and in accordance with Section "a" above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed fifty ($50.00) dollars.
d.

Pursuant to N.J.S.A. 40:67-16.1, the streets or parts of streets as described in Schedule VI which can be found in Chapter 7A are hereby designated as Route for Trucks Over Four (4) Tons. All trucks having a total combined gross weight of vehicle plus load in excess of four (4) tons shall be excluded from all streets except from those streets which form a part of the system of truck routes. Fines for violation of this ordinance shall be as follows:
a. 
For a first violation a fine of not less than $50.00 or more than $500.00; and
b. 
For second or subsequent violations, a fine of not less than $500.00 or more than $1,000.00.

a. 
No person(s) shall park buses, trucks, house cars, campers, mobile homes, recreation vehicles, trailers, semi-trailers or pole trailers upon any of the streets, alleys or public rights-of-way described in SCHEDULE XXIV which can be found in Chapter 7A.
b. 
The provisions of this subsection shall not apply to any vehicle which is parked upon any street, alley or public right-of-way for the purpose of loading or unloading supplies, materials, food stuffs or other such items. The operator or person in possession of said vehicle shall be responsible for any violation of this subsection. In the event that the operator or person in possession is unknown, it shall be presumed that the owner is operating said vehicle or the operator or person in possession is operating the vehicle with the consent of the owner.
c. 
In addition, no person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I which can be found in Chapter 7A.

The streets or parts of streets described in Schedule VII which can be found in Chapter 7A are hereby designated as One-Way streets in the direction indicated.

No person shall park a vehicle other than in the direction of travel on both sides of the One-Way Streets as listed in Schedule VII B (which can be found in Chapter 7A) pursuant to the provisions of R.S. 39:4-135, as a supplement to the existing right-hand side parking.

Pursuant to the provisions of N.J.S. 39:4-140, the streets or parts of streets described in Schedule VIII which can be found in Chapter 7A are hereby designated as Through Streets. STOP signs shall be installed on the near right side of each street intersecting the Through Street except where YIELD signs having sides thirty-six (36") inches in length are provided for in the designations.

Pursuant to the provisions of N.J.S. 39:4-140, the intersections described in Schedule IXA which can be found in Chapter 7A are hereby designated as multiway stop intersections. Speed limits shall be established for both directions of traffic along the streets or parts of streets described in Schedule XIX which can be found in Chapter 7A.

The traffic signal installation shall be in accordance with the provision of an Act Concerning Motor Vehicles and Traffic Regulations, Subtitle 1 of Title 39 of the New Jersey Statutes; shall conform to the design and shall be maintained in operation, as authorized by the Department of Transportation.

No other person shall park any vehicle in a parking space designated for use by persons who have been issued special Handicapped Vehicle Identification by the N.J. Motor Vehicle Commission as described in Schedule XXII (which can be found in Chapter 7A ) for those locations whose regulation is governed by N.J.S. 40:48-2.46 and in Schedule XXIIA (which can be found in Chapter 7A) for those locations whose regulation is governed by N.J.S. 39:4-138(o).

The purpose of this section is to identify and create the criteria for the issuance of residential handicapped parking spaces within the City of Ocean City, consistent with the provisions of New Jersey Statutes, N.J.S.A. 39:4-204, et seq. The section recognizes there may be times when residents of Ocean City are in need of handicapped parking spaces in the vicinity of their homes to accommodate a disability.

THE TERM "HANDICAPPED PERSON"
As defined herein shall include any person who has lost the use of one (1) or more limbs as a consequence of paralysis, amputation or other permanent disability or who is permanently disabled as to be unable to ambulate without the aid of an assisting device or whose mobility is otherwise limited as certified by a physician with a plenary license to practice medicine and surgery; a podiatrist licensed to practice in this State or a bordering state; a physician stationed at a military or naval installation located in the State who is licensed to practice in any state; or a chiropractic physician licensed to practice in this State or a bordering state.

If an individual desires a residential handicapped parking designation, he or she shall apply to the Department of Public Safety, Division of Police on forms prepared by that Division. The applicant shall present to the City:
a. 
A handicapped person identification card issued by the Director of the Division of Motor Vehicles of the State of New Jersey, or a motor vehicle with a special license plate placard or parking permit issued to a handicapped person as defined herein by another state, district or territory of the United States or Canada; and
b. 
A placard likewise issued by the Director of the Division of Motor Vehicles of the State of New Jersey, or a motor vehicle with a special placard or parking permit issued to a handicapped person as defined herein by another state, district or territory of the United States or Canada, indicating that a handicapped person card has been issued to the person designated therein.
The handicapped identification card and placard shall be issued by the Director of the Division of Motor Vehicles in accordance with N.J.S.A. 39:4-205 and 39:4-206, respectively.

Upon completion of the application and forwarding of the handicapped identification card and placard as described above, the Police Division shall investigate the applicant's residence to determine the need for the installation of a handicapped parking space in front of or in the vicinity of the applicant's home. The applicant shall not be entitled to a residential handicapped parking space if the applicant's property is served by off-street parking, such as a driveway, or if the applicant's property may be accessed through an alley. In the event the applicant's home does not provide off street parking or does not provide alley access, a handicapped parking space shall be created in front or in close proximity to the applicant's home.
Additionally, if the applicant's home provides off-street parking or alley access, but because of particular topography, location, design or other characteristics of the property, it is difficult or infeasible for the applicant to gain access to their home, the applicant shall be entitled to the residential handicapped parking space. The Division of Police shall evaluate these criteria and recommend to the Mayor whether the handicapped parking space shall be issued. The Mayor or his designee shall be the final decision-maker on the issuance of the handicapped parking space.

The City of Ocean City shall review the residential handicapped parking signs annually to determine if the factors continue to exist to justify their location. In the event these factors do not exist, the signs shall be removed.

The locations described in Schedule XXIII which can be found in Chapter 7A are hereby designated as locations where pedestrians may cross a roadway other than at an intersection. These locations shall be signed with appropriate MUTCD warning signs and the no parking provisions of R.S. 39:4-138(b) and (e) shall apply.
Unless another penalty is expressed provided by New Jersey Statute, every person convicted of a violation of a provision of this Chapter or any supplement thereto shall be liable to a penalty of not more than fifty ($50.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.
If any part or parts of this ordinance are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance.
All former traffic ordinances of the City of Ocean City are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance.

The lane locations described in Schedule XXV which can be found in Chapter 7A are designated as "Lane Use Reservations" and traffic shall move only as indicated.

Between September 1st and June 30th, and during the time that the Ocean City High School is in session, the following traffic regulations shall apply to Atlantic Avenue from 5th Street to 6th Street:
a. 
The street shall be closed to vehicular traffic, with the exception of student buses between the hours of 2:00 p.m. and 3:00 p.m.
b. 
Parking shall not be permitted on the west side of Atlantic Avenue between 8:00 a.m. and 5:00 p.m. on weekdays.
c. 
School buses shall be parked on Atlantic Avenue from 5th Street to 6th Street for the purpose of loading and transporting students during this period of time.
d. 
Traffic barricades shall be posted by the Ocean City Board of Education at the intersections of 6th and Atlantic Avenue and 5th and Atlantic Avenue during those periods of time that the street is closed for vehicular traffic as set forth herein. In addition to placing the barricades the Ocean City Board of Education shall be responsible for posting a person at each intersection to direct traffic.
e. 
The vehicle lane closest to the school on Atlantic Avenue between 5th Street and 6th Street shall be left open for emergency vehicles.
f. 
No stopping no standing zones shall be established at the following locations:

No person(s) shall park buses, trucks, campers, mobile homes, recreational vehicles, trailers, or semi-trailers upon any of the municipally owned parking lots of Ocean City, set forth in Schedule A below, unless they have obtained a parking permit from the Division of Parking Regulation, or received emergency permission from the Chief of Police or his designee.
b. 
No person(s) shall use any vehicle, trailer, or other personal property, in any of the municipally owned parking lots of Ocean City set forth in Schedule B, below, for the purpose of displaying any signage to indicate that the vehicle, trailer, or any other personal property, is for sale, or for the purpose of advertising any business establishment.
c. 
No person(s) shall park any vehicle overnight in any of the municipal parking lots of Ocean City set forth in Schedule C below unless they have obtained a parking permit from the Division of Parking Regulation, or has paid the appropriate fee for gated lots.
