The following regulations shall be applicable to all construction
projects undertaken in the City of Ocean City.

a. No materials, trailers and/or vehicles or construction dumpster shall
be parked overnight on any street or alley without prior issuance
of a permit for such activity. The permit shall be issued by the Chief
of Police or his designee following the filing of an application for
same, indicating the exact location and the length of time required
for parking. After satisfying himself as to the safety and appropriate
nature of the location, the Chief of Police or his designee may issue
a permit for a specific space for a maximum of thirty (30) days for
Metered Parking and one hundred eighty (180) days for Un-Metered Parking.
The permit may be renewed for an additional thirty (30) day period
up to a maximum of one hundred eighty (180) days for metered parking.
Any person requiring more than one hundred eighty (180) days for such
a permit shall justify said need in writing thirty (30) days prior
to the expiration of his permit. Upon receipt of said notice, the
Chief of Police or his designee may issue a permit for additional
thirty (30) day periods as he deems necessary.
b. Any person who controls, whether owned, leased, or operated, a construction
dumpster must ensure that it is covered when not in use, including
overnight, unless it is empty, and shall prevent refuse from spilling
out or overflowing.
c. Any person who owns, leases or otherwise uses a construction dumpster
must ensure that such dumpster does not leak or otherwise discharge
liquids, semi-liquids or solids to the municipal separate storm sewer
system(s) operated by the City of Ocean City.
d. Recyclable material shall not be placed in construction dumpsters.
e. The owner or lessor of a dumpster shall ensure that public streets
are protected during the loading/unloading operations and placement
and use of the refuse container.
f. The maximum length for a construction dumpster placed on a public
street shall be twenty-two feet (22').
g. Every construction dumpster placed on a public street shall have
plywood under each contact point with the street so as to protect
the street.
h. Construction dumpsters, construction trailers, construction vehicles
and related construction materials are not permitted on the public
street or alley in the Central Business Zone or Central Business 1
Zone from May 1st through October 31st without written approval from
the Mayor or his designee.
i. Portable storage units shall not be permitted to be placed in the
public right-of-way in any zone.
j. Construction dumpsters, construction trailers, construction vehicles
and related constructions materials shall be promptly moved or removed
from public property upon the direction of the Mayor or his designee.

Following construction of any improvement, no occupancy permit
for any use shall be issued until the Construction Official certifies
that all streets and public sidewalks abutting the subject property
are in good repair and free from any construction-related damage.

Any project containing more than five thousand (5,000) square
feet of floor area in new construction, shall have a construction
type, temporary fence, at least eight (8') feet in height enclosing
the full perimeter of the property.

No material resulting from demolition of any structure shall
be dumped or buried in the City of Ocean City with the exception of
brick, concrete, concrete block or asphalt. Those allowable materials
shall be covered by at least twelve (12") inches of earth or gravel
and may only be deposited in a location approved by the City Engineer.

Any project containing more than three thousand (3,000) square
feet of floor area shall be required to have an approved schedule
of material deliveries and designated routes for delivery trucks.
Upon application for a building permit, the developer shall produce
such a schedule for review by the Construction Official, the police
and Engineering Department. Recognizing that certain streets in the
City of Ocean City have greater load capacities than others, the City
Engineer shall designate in writing the exact route which all delivery
trucks shall follow and shall issue a permit indicating same.
Recognizing that certain hours are more conducive to the orderly
flow of traffic and therefore to the scheduling of delivery of construction
materials and/or equipment, the Chief of Police shall approve such
times for the delivery of materials in advance by at least one week,
providing that no deliveries shall be made on weekends or before the
hour of 8:00 a.m. or after 5:00 p.m. on any day of the week.

Any movement or relocation of a structure requiring use of the
streets of Ocean City shall be required to have an approved schedule
and route in a written permit issued by the City Engineer's Office.
Upon application for such a permit, the applicant shall file
a moving plan and schedule. Said plan shall be reviewed by the City
Engineer for routing and by the Chief of Police for traffic scheduling.
The plan shall be submitted at least seven (7) days prior to the actual
move. In no case shall any structure be moved on Saturdays or Sundays.
No movement or relocation shall be permitted between Memorial Day
and Labor Day except in case of emergency.

No piling, for any purpose, shall be driven before 9:00 a.m.
or after 5:00 p.m., and in no case shall any piling be driven on Sundays.
