Pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-6.a, the Mayor and Borough Council of the Borough ("Governing Body") adopted a Resolution on July 26, 2006, directing the Planning Board (the "Board") to conduct a preliminary investigation of certain blocks and lots shown and designated on the tax map of the Borough, which properties were enumerated in the July 26 Resolution, to determine whether they exhibited the criteria of an area in need of redevelopment; and the Board caused to be prepared a map showing the boundaries of the properties to be considered and the location of the various parcels of property included therein, and have appended to the map a statement setting forth the basis of the investigation, which statement was prepared by Robert C. Cotter, P.P. (the "Report").
The Board set November 8, 2006, as the date for a public hearing and provided timely notice of the hearing to the general public and the property owners of record. The Governing Body adopted a Resolution on November 8, 2006, modifying its July 26, 2006, Resolution by directing the Board to proceed with the preliminary investigation of only Block 12, Lot 1, and Block 17, Lot 1 and Block 2, Lots 1, and 7 through 9. At the hearing on November 8, 2006, the Board considered evidence regarding whether Block 12, Lot 1, and Block 17, Lot 1 and Block 2, Lots 1, and 7 through 9 met the criteria set forth in N.J.S.A. 40A:12A-5, and received a revised version of the Report dated November 8, 2006, that focused only on the properties in those areas. The November 8, 2006, hearing was opened to the public and afforded the opportunity to be heard to all persons who were interested in or would be affected by a determination that the delineated areas are redevelopment area, but no objectors appeared. The Board recommended that the designated areas be determined to be in need of redevelopment based on the conditions set forth in the Board Resolution and as supported by the evidence in the record before the Board.
The Governing Body, upon the recommendation of the Board, determined, by Resolution dated November 30, 2006, that the designated areas, Block 12, Lot 1, and Block 17, Lot 1 and Block 2, Lots 1, and 7 through 9 (Areas 1 & 2), evidenced criteria set forth in N.J.S.A. 40A:12A-5. Pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 4A:12A-14, the Mayor and Borough Council are empowered to designate specified lands within the Borough as being in need of rehabilitation if the Governing Body of the municipality determines by resolution that certain conditions exist in that area. The Governing Body, upon the recommendation of the Board, determined by Resolution dated January 10, 2007, that the area of the Borough comprising Lots 22, 24, 25, 26 and 27 in Block 8, Lots 9, 10 and 11 in Block 4, and Lot 44 in Block 10, as shown on the official tax maps of the Borough (the "Rehabilitation Area") is an area in need of rehabilitation pursuant to N.J.S.A. 40A:12A-14, and the Borough Clerk would transmit the Resolution to the Commissioner of Community Affairs for review.
N.J.S.A. 40A:12A-7 provides for the redevelopment of areas in need of redevelopment to be undertaken in accordance with a redevelopment plan and N.J.S.A. 40A:12A-15 provides for the rehabilitation of areas in need of rehabilitation to be undertaken in accordance with a redevelopment plan.
The Governing Body, pursuant to N.J.S.A. 40A:12A-4(a)(3), is empowered to adopt a redevelopment plan pursuant to N.J.S.A. 40A:12A-7; and the Governing Body directed in its November 30, 2006, Resolution that a redevelopment plan for the designated area be developed by Robert D. Cotter, AICP, PP, for consideration by the Governing Body, which plan dated February 20, 2007 is on file with the Borough Clerk and which plan is incorporated herein by reference (the "Redevelopment Plan").
In accordance with N.J.S.A. 40A:12A-7(e), the Planning Board has reviewed the proposed Redevelopment Plan and by Resolution has submitted its recommendation to the Governing Body with respect to the Plan; and the Governing Body reviewed and considered the Redevelopment Plan submitted by Mr. Cotter at its meetings on March 14, 2007.

The Redevelopment Plan prepared by Robert D. Cotter, AICP, PP, on file with the Borough Clerk and incorporated herein by reference is hereby adopted as the redevelopment plan for the Areas in Need of Redevelopment and Area in Need of Rehabilitation in the Borough of East Newark which areas are referenced above and in the Redevelopment Plan.
Be it ordained by the Mayor and Council that the amended Redevelopment Plan prepared by Robert D. Cotter, FAICP, PP, dated as of July 27, 2017, on file with the Borough Clerk and incorporated herein by reference, is hereby adopted as the amended redevelopment plan.

The Governing Body desires to amend the Redevelopment Plan, with regards to the Riverside District, Block 17, Lot 1, to clarify the Borough's intention that a Hotel use is a permitted use in the Riverside District.
Pursuant to Ordinance No. 01-14, an amended Redevelopment Plan, providing for a Hotel use as a permitted use in the Riverside District, which plan is incorporated herein by reference. The amended Redevelopment Plan prepared by Robert D. Cotter, FAICP, PP, on file with the Borough Clerk and incorporated herein by reference is hereby adopted as the redevelopment plan for the Areas in Need of Redevelopment and Area in Need of Rehabilitation in the Borough of East Newark which areas are referenced above and in the Redevelopment Plan.
