The Borough of Sussex hereby determines to regulate the parking
of vehicles upon land owned or leased by the borough through the issuance
of permits for parking in lots designated as municipal parking lots.

MUNICIPAL PARKING LOT
Shall mean land which is owned or leased by the Borough of
Sussex and which is used exclusively for the parking of vehicles issued
permits by the Borough of Sussex.
VEHICLE
Shall mean every device in, upon or by which a person or
property is or may be transported upon a highway, excepting devices
moved by human power or used exclusively upon stationary rails or
tracks or motorized bicycles. For the purposes of this chapter, "vehicle"
shall exclude commercial motor vehicles, which are defined as every
type of motor driven vehicle used for commercial purposes on the highways,
such as the transportation of goods, wares and merchandise.

There are hereby established municipal parking lots at the following
locations which shall be known by the following respective designations:
a. "Harrison Street Lot," along Harrison Street between Main Street
and Liberty Street, containing 19 parking spaces.
1. There shall be designated seven overnight parking spaces by permit
only.
2. The other spaces in the lot may be used by the public during the
daytime from 6:00 a.m. to 6:00 p.m. provided that the Theater does
not have an event. When the parking spaces are needed by the Theater,
the Theater shall be permitted to post notices at the entrances to
the parking area at least 24 hours in advance and restrict parking
to Theater patrons two hours before an event and two hours after.
b. "Mill Street Lot," along Mill Street at the intersection of Newton
Avenue.
c. "Walling Avenue Lot," along Walling Avenue.

The above municipal parking lots may be diminished or enlarged,
and municipal parking lots at additional locations may be created
hereafter as conditions require.

Parking in municipal parking lots designated in section
10-3, shall be limited to vehicles for which the Borough of Sussex has issued a valid permit and have such permit properly displayed.

Vehicles shall at all times be parked wholly within the assigned
parking space, which space shall be kept clearly marked at all times,
and it shall be unlawful to park vehicles in a way that the same shall
not be wholly within the area designated by the lines for parking
for such spaces.

a. Permit shall be attached to the rear view mirror of the vehicle in
plain sight from outside the vehicle.
b. If an applicant for a municipal parking permit owns more than one
vehicle and is assigned one parking space, permit decals shall be
issued for each vehicle, and the permit decal shall indicate the number
of the assigned parking space.
c. If an applicant rents more than one parking space, permit decals
will be issued for each vehicle indicating the inclusive numbers of
the parking spaces assigned.
d. If an applicant rents more than one parking space and it is anticipated
that there will be several changes of vehicles, permit decals will
be issued for the number of spaces rented indicating the inclusive
numbers of the parking spaces. The permit decals will be applied to
a six inch by six inch sheet of plexiglass or like material and shall
be positioned in the rear window of the vehicle directly behind the
driver.

It shall be unlawful for any person to permit a vehicle registered
in his or her name to remain or be placed in any parking space without
a properly displayed current permit decal. The registered owner of
an unlawfully parked vehicle will be issued a summons and the vehicle
will be towed and stored at the owner's expense.

All ordinances or parts of ordinances inconsistent herewith
are hereby repealed as to such inconsistencies only.

In the event that any word, phrase, clause, section or provision
of this chapter is found by any court of competent jurisdiction to
be unenforceable, illegal or unconstitutional, such word, phrase,
clause, section or provision shall be severable from the balance of
this chapter and the remainder of this chapter shall remain in full
force and effect.

This chapter shall take effect upon passage and publication
as provided by law.
