As used in this chapter:
FISHING AND HUNTING
Shall mean either the taking or pursuing or attempting the taking of fish and game at lawful times and in such lawful manner as may be permitted by the State of New Jersey, or its proper departments hereof, pertaining to fish and game.
PARK
Shall refer to the public premises used for park and recreation purposes situated at the site and including all of the park area previously known as Clove Lake and the borough lands surrounding same.
PICNIC GROUNDS
Shall be such portion of the premises as may be designated by the borough for use and enjoyment, and the partaking of food and such other activities as are connected herewith generally known as picnics.
RESIDENTS
Shall mean any person either actually living in the borough designated, or maintaining a home therein and declaring such borough to constitute his home and legal residence at the time of the use or enjoyment of the privileges herein stated.
SWIMMING AREA
Shall be that section of the waters of Clove Lake, and of the beaches and lands adjoining the same, either roped off or designated by signs or otherwise as the area in which persons may swim or bathe or use in connection with the primary purpose of swimming or bathing, intending to include herein the areas of land adjoining known as the beach and the area provided for changing of clothes.

The swimming area may be used only by the following persons:
a.ย 
A borough resident.
b.ย 
A guest of a borough resident, when actually accompanied by such resident or the guest of the borough.

a.ย 
The privilege of swimming or bathing may be exercised only in the swimming area, and only when one or more lifeguards are on duty. The privilege of swimming or bathing shall not be permitted in any event later than the hour of 9:00 P.M. of any day, nor prior to 8:00 a.m. of any day.
b.ย 
No dogs shall be allowed in any swimming area.
c.ย 
No alcoholic beverages shall either be consumed, sold, used, displayed or taken on or off any swimming area.
d.ย 
Fishing shall not be allowed in any swimming area when such area is actually being used for swimming or bathing by anyone.
e.ย 
No games, conduct or activities known as horseplay shall be permitted in any swimming area at any time when such games or activities or conduct are likely to endanger or cause injuries to any person or to any property.
f.ย 
No inner tubes, or devices known as life preservers, water wings or other apparatus shall be permitted to be used in the waters of the swimming area by any person unable to swim unless actually accompanied at all times in the water by a person who is able to swim and responsible for the person using the device.
g.ย 
No boats of any type shall be permitted in the swimming area at any time when the same is in actual use by any one or more persons, except lifeguard boats.
h.ย 
No changing of clothes either to or from swimming attire shall be permitted, except in the bath houses provided for such purpose.

The privileges of fishing, hunting and boating shall be restricted to the following persons:
A borough resident.
A guest of any resident of the borough when actually accompanied by such resident or guest of the borough.
No firearms shall be used or permitted in or on the park property, or any area thereof, except the regular hunting seasons in the fall of the year, as permitted by the State of New Jersey.

The conduct or operation of any business or sales, or business activity, shall be prohibited in the park or any area thereof, unless a license therefor has first been obtained from the borough.

No papers, debris, cans, refuse or any other materials or property in the nature of debris or refuse shall be left or deposited anywhere in or on the property comprising the park, or any area thereof, except in receptacles provided by the borough for such purposes.

No trees, shrubbery or flowers or any portion thereof on or within the park shall be taken, damaged, destroyed or removed without lawful permission first being obtained from the borough.

No memorial, monument, statuary, building or structure of any type erected by the borough within the park area shall be damaged, defaced, removed or marked, without lawful permission therefor first had and obtained from the borough.

No fishing through the ice shall be permitted in any area set aside as an area for skating in the winter, which areas shall be clearly designated by signs or other indications.

No person shall operate a snowmobile, motor bike or motor vehicle on the ice on Clove Lake, without prior authorization from the chief of police.

No gas or diesel-powered watercraft of any type shall be permitted on any Borough-owned lake, pond or waterway.

As used in this section and as used in Chapter 17 of the Revised General Ordinances of the Borough of Sussex, the following term shall have the meaning as indicated:
PARK
Shall mean all public parks, playground facilities and other facilities used for recreation, all or any of which are owned by the Borough of Sussex.

The hours during which the parks shall be open to the public shall be from the hours of 7:00 a.m. to 10:00 p.m. The mayor and the borough council may, by resolution duly adopted, extend permission for an event in any park to end later than 10:00 p.m.

The following rules and regulations shall apply to all parks within the Borough of Sussex;
a.ย 
No person shall remove, deface, or damage any benches, tables, trees, shrubs, soil, plants, playground or other park equipment.
b.ย 
At no time will the sale or consumption of alcoholic beverages be permitted; the only exception shall be those circumstances where the mayor and borough council, by resolution duly adopted, agree that a special event warrants waiver of this subsection.
c.ย 
No person shall throw, discharge or otherwise place or cause to be placed or deposit or leave any paper, bottles, broken glass, boxes, cans, dirt, rubbish, trash, waste, garbage or refuse of any kind in any place other than in proper receptacles provided for the receipt thereof.
d.ย 
No person shall permit any animal to remain or run at large in the parks.
e.ย 
No person shall enter upon any portion of lawn or other cultivated ground in any borough park within the borough when forbidden to do so by an official sign or other official notification.
f.ย 
No person shall loiter in the parks after dark or between the hours of sunset and sunrise.
g.ย 
Any group consisting of more than ten people utilizing the facilities of any park in the Borough of Sussex as a picnic area is prohibited unless sanctioned by a duly adopted resolution of the mayor and borough council.

Any person who shall violate any of the provisions of this section and/or who shall fail to comply with the provisions of this section shall, upon conviction in a court of competent jurisdiction, be subject to a minimum fine of $100, and a maximum fine of $1,000; or by imprisonment for a term not exceeding 90 days, or by a period of community service not exceeding 90 days; any or all of which penalties shall be imposed in the court's discretion.
Each day that a violation of this section exists shall be deemed a separate and distinct violation of this section.

This section 17-6 shall govern the area designated as Block 165 Lots 13 and 25, in the Township of Wantage, commonly known as Lake Rutherford and the lands surrounding same, hereafter known as "the property".

No person shall be allowed on the property, for any purpose, unless said person is in compliance with the following guidelines:
a.ย 
Said person shall be a resident of the Borough of Sussex, water customer, or a guest of a resident of the Borough of Sussex. If a guest, said guest must be accompanied, so long as said guest remains on the property, by the borough resident. Each borough resident shall be entitled to a maximum of one guest per visit.
b.ย 
Residents visiting the property shall obtain access to the property by obtaining a key to the main gate of the property from the borough clerk's office, during regular business hours. Residents must post a $10 deposit to obtain the key, show identification proving residency and provide the names and addresses of any guest accompanying the resident. Keys shall be provided on a first come first serve basis. Keys must be returned by 12:00 p.m. the following business day to avoid forfeiture of the deposit. Any other means of access to the property shall be deemed a violation of this section.
c.ย 
Access shall be given for the purpose of fishing only. Picnics, swimming, hiking and any and all other activities are prohibited on the property.
d.ย 
No animals shall be allowed in the property.
e.ย 
No open fires shall be allowed in the property.
f.ย 
No food, garbage, refuse or any other items may be left on the property. All items brought into the property must be brought out.
g.ย 
No gas motors shall be allowed on any boat.
h.ย 
Hours for fishing shall be from 5:00 a.m. to 8:00 p.m.

For the first offense, a fine in an amount not to exceed $100 and/or imprisonment in a county jail for a period not to exceed 90 days or the imposition of community service not to exceed 90 days; or
b.ย 
For a second or subsequent offense, a fine not to exceed $1,000 or incarceration in the county jail for a period of time not to exceed 90 days or by a period of community service not to exceed 90 days.
