There is hereby created the office of Deputy Tax Collector in
and for the Borough of Tinton Falls.

The Deputy Tax Collector shall be appointed from among other
full-time salaried Borough officers or employees and shall be nominated
by the Mayor and the appointment confirmed by the Borough Council.

The Deputy Tax Collector shall serve without additional compensation
for a term expiring on December 31 annually until a successor is appointed
and qualified.

The duty of the Deputy Tax Collector shall be to aid and assist
the Borough Tax Collector under the direction and supervision of the
Borough Tax Collector, to do and perform such duties as may be assigned
by the Tax Collector the Mayor/Administrator and to have all the powers
and perform all the duties of the Tax Collector during such times
and for such specific periods as the Borough Tax Collector shall be
either absent or disabled.

There is hereby established the position of Deputy Municipal
Court Clerk.

The duties of Deputy Municipal Court Clerk shall be to assist
the Municipal Court Clerk in the performance of all the duties incumbent
upon that office in the absence, disability or incapacity of the Municipal
Court Clerk.

There exists a need in this Borough for a more coordinated,
consistent and thorough enforcement of the laws, codes and ordinances
duly enacted by the Borough Council, and in order to more adequately
protect persons and property and for the preservation of the public
health, safety and welfare of the Borough and its inhabitants, there
is hereby created the position of Code Enforcement Officer for the
Borough.

The Director shall designate a Code Enforcement Officer in accordance
with the provisions established by state law. The Code Enforcement
Officer shall not be required to be a resident of the Borough. The
Code Enforcement Officer shall be assigned to the Administrative Department
of the Borough and in day-to-day activities shall be assigned to and
be a part of the Building Department. The position shall be either
full-time or part-time as determined at the time of appointment.

It shall be the duty and responsibility of the Code Enforcement
Officer to see to it that all applicable municipal laws, codes and
ordinances of this Borough are duly enforced in a coordinated, consistent
and thorough manner. In that connection, the Code Enforcement Officer shall
have the power and duty to investigate, issue warnings, post notices,
issue stop-work orders, sign complaints and prosecute and testify
in the Municipal Court in regard to violations of any of the laws,
codes and ordinances in force in this Borough, including but not limited
to the following areas:
a. Repair, closing and demolition of buildings unfit for human habitation
regulations.
b. Housing Code regulations essential to making dwellings safe, sanitary
and fit for human habitation.
d. Removal of brush, weeds, dead and dying trees, stumps, roots, obnoxious
growths, filth, garbage, trash and debris regulations.

The Code Enforcement Officer shall be obliged to follow the
procedures set forth in the various ordinances adopted by this Borough
with respect to all actions taken in connection with alleged violations.
Whenever, in a particular case, the applicable ordinance does not
set forth procedures to be followed, then and in that event the Code
Enforcement Officer shall follow legally accepted procedures to guarantee
that any alleged violation and any charges in connection herewith
shall follow due process of law. In appropriate cases the Code Enforcement
Officer may issue warning notices prior to service of summons and
complaint against an alleged violator. The Code Enforcement Officer
shall, at all times, recognize the interrelationship of his duties
with the duties of the various other departments in the Borough. In
that regard, the Code Enforcement Officer shall seek the advice of,
maintain communication and cooperate with other officers and employees
of the Borough and the various departments. Whenever the duties and
responsibilities of the Code Enforcement Officer may overlap with
the duties of others, the Code Enforcement Officer shall see to it
that any other department which may be involved shall be kept fully
informed. The Code Enforcement Officer is hereby authorized to seek
the advice and assistance of the Borough Attorney in all matters wherein
legal advice and assistance shall be deemed necessary.

Upon request, the Code Enforcement Officer shall attend meetings
of the Mayor and Council, the Planning Board, the Board of Adjustment
and the Board of Health.

The Code Enforcement Officer shall prepare and render to the
head of his department, in writing, monthly reports in proper form,
with a copy to the Mayor and Council. Each monthly report shall include
information on all investigations, complaints of violations and the
determination of the Municipal Court for any prosecuted matters.

The Code Enforcement Officer shall be qualified for the position
by reason of education or experience or both. He shall make himself
thoroughly familiar with all areas of the Borough and shall have a
thorough knowledge of all of the laws, codes and ordinances within
his jurisdiction. He shall have a thorough knowledge of the proper
procedures used in making inspections and reinspections for compliance,
and a thorough knowledge of legal procedures involved in the prosecution
of violations. He shall be familiar with building construction and
maintenance. The Code Enforcement Officer must have the ability to
recognize hazardous conditions and an ability to analyze and interpret
ordinances and building plans and shall have the ability to prepare
clear, concise and accurate reports and to maintain records in connection
with all of the activities of his office.

a. Section 3 of an ordinance relating to the repair, closing and demolition
of buildings unfit for human habitation or occupancy or use, etc.,
adopted May 15, 1958, is hereby amended to read as follows:
The Public Officer shall be the Code Enforcement Officer of
the Borough of Tinton Falls and he shall exercise the powers prescribed
by this chapter.
b. All other ordinances in force and effect in this Borough at the time
of the adoption of this Article are hereby amended to include the
Code Enforcement Officer as an officer designated to enforce such
existing ordinances in addition to the official previously assigned.

The Mayor and Borough Council by resolution adopted from time
to time, may require that supplemental assignments be assumed and
carried out by the Code Enforcement Officer.

The Director shall designate a Zoning Officer in accordance
with the provisions established by state law. The Zoning Officer shall
not be required to be a resident of the Borough. The Zoning Officer
shall be assigned to the Administrative Department of the Borough.
The position shall be either full time or part time as determined
at the time of appointment.
The Zoning Officer shall be responsible for administering and enforcing zoning ordinances under the Borough Code, Chapter
40, Land Use Regulations. The Zoning Officer has overall responsibility for the administrative oversight of all applications for land development and zoning permits including:
a. Review all Master Plan and zoning ordinance revisions.
b. Review all plot plans, subdivision layouts, surveys, site plans and
building plans of new structures and additions for compliance with
land use regulations.
c. Review proposed projects for compliance with Municipal Land Use Law and consult with the applicants, their professionals and
board members and professionals regarding all development within the
Borough.
d. Send a representative to attend Zoning Board of Adjustment and Planning
Board meetings as needed.
e. Enforcement of Borough zoning laws through the Zoning Officer and
Code Enforcement Officer.
