Whenever a position shall become vacant and the Mayor shall fail to nominate a qualified and suitable person to fill such position within 30 days of the date when the office becomes vacant, or if the Council should fail to confirm a nominee of the Mayor within 30 days of the date when such office becomes vacant, then the power to nominate and fill the position shall vest in the Borough Council, which shall make the appointment by resolution.

Whenever any position set forth in paragraph a shall become vacant, it shall be filled by nomination of the Mayor. Should the Mayor fail to nominate a person to fill the position, or should any nominee of the Mayor fail to be confirmed by the Borough Council within 30 days of the date the office becomes vacant, then the position shall be filled by the Borough Council by resolution.

The following unclassified positions shall exist within the Borough of Woodbine. The appointments to such positions shall be made by the Mayor, with the advice and the consent of the Borough Council, except for the Secretary of the Zoning Board of Adjustment and the Secretary of the Planning Board, which appointments shall be made by the Zoning Board of Adjustment and the Planning Board, respectively. The person so appointed shall have all of the qualifications required by law and shall be appointed for the term prescribed by law, ordinance or resolution:

a. 
The following positions shall exist within the Borough of Woodbine and the appointments to such positions shall be made by the Mayor, with the advice and consent of the Borough Council, provided, however, that the person exercising the duties of such office shall do so without additional salary and such person shall also hold another position within the Borough of Woodbine:

b. 
Whenever a position shall become vacant, it shall be filled by nomination of the Mayor. Should the Mayor fail to nominate a qualified and suitable person to fill such position within 30 days of the date when the office becomes vacant, or if the Council should fail to confirm a nominee of the Mayor within 30 days of the date when such office becomes vacant, then the power to nominate and fill the position shall vest in the Borough Council, which shall make the appointment by resolution.
c. 
The offices or positions created pursuant to this section shall be in addition to those officers created or mandated by State Statute and the failure to include in this section any reference to such office or position shall not be construed in any way as affecting such position or the exercise of the powers and duties of such office by the incumbent thereof. Included in this category and by way of illustration would be the Zoning Board of Adjustment, the Planning Board, Recreation Committee, Public Assistance Board, Board of Health and other similar Boards and Commissions.

Pursuant to N.J.S.A. 40A:9-1.4, the Borough hereby limits the eligibility of applicants for positions and employments in the classified service of the Borough of Woodbine to residents of the Borough. A resident for the purpose of this section shall be defined as a person having a permanent domicile within the Borough and one which has not been adopted with the intention of again taking up or claiming a previous residence acquired outside of the boundaries of the Borough.

All non-residents subsequently appointed to positions or employments shall become bona fide residents of the Borough within one year of their appointment, except as otherwise provided in subsections 8-3.3, 8-3.4 and 8-3.6 of this section. It shall be the duty of the hiring authority to ensure that all such employees hired remain bona fide residents of the Borough. Failure of any such employee to maintain residency in the Borough shall be cause for removal or discharge from service. The procedure set forth in N.J.S.A. 40A:9-1.5 shall govern.

Whenever the appointing authority shall determine that there cannot be recruited a sufficient number of qualified residents for available specific positions or employments, the Borough shall advertise for other qualified applicants. In such case, the hiring authority shall thereupon classify all qualified applicants for such positions or employments in the following manner: (1) other residents of Cape May County; (2) other residents of Cumberland and Atlantic Counties; (3) other residents of New Jersey; (4) all other applicants.
The hiring authority shall first appoint all those in class (1) and then those in each succeeding class in the order above listed and shall appoint a person or persons in any such class only to a position or positions, or employment or employments, remaining after all qualified applicants in the preceding class or classes have been appointed or have declined an offer of appointment.
The preference herein established shall in no way diminish, reduce or affect the preference granted pursuant to any provision of law.
Any officers and employees hired pursuant hereto, who are not residents of the Borough of Woodbine, shall, as a condition of their continued employment, become bona fide residents of the Borough, within such reasonable period of time as is specified at the time of employment.

Whenever the hiring authority of the Borough of Woodbine shall determine that there are certain specific positions and employments requiring special talents or skills which are necessary for the operations of the Borough and which are not likely to be found among the residents of the Borough, such positions or employments shall be filled without reference to residency. The hiring authority shall determine, and set forth in writing, the formal criteria for such positions and employments at the time of determination of the need to fill such positions or employments, giving due regard to experience, qualifications, formal training, proximity to the Borough, availability, specialization, and similar matters directly related to the specific positions and employments involved.

Preference in promotion to positions and employments in the classified service of the Borough shall be given to officers and employees who are bona fide residents of the Borough. When promotions are based on merit, the Borough shall employ, inter alia, ratings received by the officers and employees as set forth through the Borough's performance evaluation system, if any, as an objective criteria of merit. In such cases of merit promotions, a resident of the Borough shall be given preference over a nonresident in any instance where the other criteria are equal.
No preference herein granted shall in any way diminish, reduce or affect the preference granted pursuant to any provision of law.

Notwithstanding anything contained in this section to the contrary, this section shall not be applicable to officers, employees or positions of the Borough who, or which, are (1) in the unclassified civil service, (2) are employed pursuant to professional service contracts authorized by resolution or ordinance, or (3) are employed to perform extraordinary, unspecifiable services as defined by the Local Public Contracts Law pursuant to contracts authorized by resolution. Without in any way intending to limit the foregoing, this section shall not apply to the positions of Municipal Judge, Municipal Prosecutor, Solicitor, Engineer, Borough Auditor, Municipal Planner, Solicitor for the Zoning Board of Adjustment, Solicitor for the Planning Board.

As used in this section, the following definitions shall apply:
BOROUGH
Shall mean the Borough of Woodbine, in the County of Cape May.
DEPENDENTS
Shall mean and be defined by N.J.S.A. 52:14-17.26(d)(1).
EMPLOYEES
Shall mean an appointive or elective officer, a full-time employee of the Borough who began employment prior to June 1, 2012 who appears on a regular payroll and receives a salary or wages for an average of the number of hours per week as prescribed by the governing body of the participating employer which number of hours worked shall be considered full-time, determined by resolution, and not less than 20.
After June 1, 2012, "Employee" shall mean a full-time appointive or elective officer whose hours of work are fixed at 35 or more per week, or a full-time employee who began employment subsequent to June 1, 2012, who appears on a regular payroll and receives a salary or wages for an average of 32.5 hours per week which number of hours worked shall be considered full-time, determined by resolution or an appointive or elective officer, or an employee of the Borough who has or is eligible for health benefits coverage provided under P.L. 1961, c. 49 (C. 52:14-17.25 et seq.) or sections 31 through 41 of P.L. 2007, c. 103 (C. 52:14-17.46.1 et seq.) on that effective date and continuously thereafter provided the officer or employee is covered by the definition in the first paragraph of this subsection.
For the purposes of this act the term "employee" shall not include persons employed on a short-term, seasonal, intermittent or emergency basis, persons compensated on a fee basis, persons having less than two months of continuous service or persons whose compensation from the Borough is limited to reimbursement of necessary expenses actually incurred in the discharge of their official duties. The term "employee" shall also not include retired persons who are otherwise eligible for benefits under this act but who, although they meet the age of disability eligibility requirement of Medicare, are not covered by Medicare Hospital Insurance, also known as Medicare Part A [FN2] and Medicare Medical Insurance, also known as Medicare Part B [FN3].

In accordance with Resolution 35-3-92, the Borough shall adopt the provisions of Chapter 54 P.L. 1979, as amended, so as to permit the Borough to pay a portion of the premium charges for certain eligible pensioners and their dependents and to pay a portion of Medicare charges for such retirants covered by the New Jersey State Health Benefits.

For all employees who have commenced employment after June 1, 2012, the premium or periodic charges provided in accordance with 8-3.1A shall be paid if such employee retired and reached the age of 65 years or older with 25 years or more of non-concurrent service credit in one or more State or locally administered retirement systems, excluding service credited under the Defined Contribution Retirement Program, and a period of service of not less than 25 years with the Borough of Woodbine at the time of retirement.

In accordance with Resolution 36-3-92, the Borough shall adopt the provisions of Chapter 88, P.L. 1974, as amended by Chapter 436, P.L. 1981 so as to permit the Borough to pay the premium charges for certain eligible pensioners and their dependents and to pay Medicare charges for such retirees and their spouses/eligible partners covered by the New Jersey State Health Benefits Program.

The effective date of the terms of this section shall be in accordance with Resolutions 35-3-92 and 36-3-92.

The Woodbine Borough Council shall adopt and amend the Borough employment practices and procedures from time to time via a resolution in accordance with the laws of New Jersey, and such changes shall be reflected in the Borough employment manual setting forth the personnel procedures and practices to be followed and adopted by Borough employees. The practices and procedures manual shall include, but is not limited to, rules concerning hiring and termination of employees; terms and conditions of employment related law. The personnel policies and procedures shall apply to all officials, appointees, employees, prospective employees, volunteers, and independent contractors of the Borough.

The Borough shall provide municipal employees notice of changes to employment practices and procedures, when applicable and appropriate, as provided by law and/or contractual agreements between the Borough and any collective bargaining units.

The purpose of this section is to expedite the procedure of effectuating changes and providing notice of changes to the employment handbook that are required by law, suggested by the Joint Insurance Fund, or otherwise deemed appropriate by the Borough Council. This section shall assist the Borough in implementing and guiding municipal employees in proper conduct, in promotion of government function and efficiency.

The Borough Clerk shall be responsible to implement and enforce the personnel practices and procedures adopted by the Borough, whether by ordinance or resolution. In the event of a conflict between Borough personnel practices and procedures and any duly adopted and lawful collective bargaining agreement, professional services contract, or Federal or State law, the terms and conditions of that law or contract shall prevail. In all other cases, the practices adopted pursuant to this ordinance shall prevail.
