A Code entitled "New Jersey State Housing Code," promulgated
by the New Jersey Department of Community Affairs and establishing
standards for use in determining the fitness of a building for human
habitation or occupancy or use, is hereby adopted pursuant to N.J.S.A.
26:3-69.1 et seq. A copy of the Code is annexed to this section and
made a part herein.

Three copies of the New Jersey State Housing Code have been
placed on file in the office of the Secretary of the Board of Health
and the Borough Clerk and will remain on file in those offices for
the use and examination of the public.

Whenever the Board of Health of the Borough shall determine that a building or any part thereof fails to meet the standards established by the New Jersey State Housing Code hereby adopted, the Board shall cause notice thereof to be served personally or by registered mail upon the owner and any occupant of such building or part thereof. Every such notice shall set forth the specific conditions complained of and shall require the correction of such conditions within a reasonable time specified in the notice. The notice shall also state that unless conditions complained of are corrected within the time specified the Board may declare the building or any part thereof unfit for human habitation or occupancy or use pursuant to the provisions of Section
BH7-3.2, which declaration may subject the owner or occupant to penalties pursuant to Section
BH7-4, a copy of which shall be attached to the notice.

In the event that the specific conditions complained of in any notice served pursuant to subsection
BH7-3.1 above are not corrected within the time specified in the notice, the Board may adopt a resolution declaring that the building or any part thereof is unfit for human habitation or occupancy or use. Every such resolution shall set forth the specific conditions upon which the determination is based.
Copies of every resolution adopted pursuant to the provisions of this subsection
BH7-3.2 shall be served personally or by registered mail upon the owner and any occupant of the building or part thereof subject to the declaration of unfitness.
A copy of every Resolution adopted pursuant to the provisions
of this subsection shall be forwarded to the Housing Officer of the
Borough of Victory Gardens as a complaint pursuant to the provisions
of Ordinance 16-61 entitled "An Ordinance of the Borough of Victory
Gardens to the Repair, Closing and Demolition of Buildings Unfit for
Human Procedures in Connection Therewith" adopted by the Borough of
Victory Gardens on March 26, 1980, as may be amended and supplemented.
The Health Officer of the Board of Health shall appear before the
Housing Officer in all proceedings pursuant to Ordinance 16-61 concerning
any building or part thereof of which has been declared by the Board
of Health to be unfit for human habitation or occupancy, or use.

No person shall maintain, inhabit, occupy, or use, or permit another person to inhabit, occupy, or use any part thereof which has been declared by the Board of Health to be unfit for human habitation or occupancy or use pursuant to the provisions of Section
BH7-3.2. Any person convicted of a violation of this section shall be subject to a penalty as set forth in BH1-2.

No provision of this section shall be construed as precluding
the enforcement of other ordinances adopted by the Board of Health
or as precluding the exercise of other powers of the Board of Health
to correct or abate nuisances or conditions adversely affecting the
public health, safety and general welfare.
