[HISTORY: Adopted by the Village Board of the Village of Reeseville 10-5-2000 by Ord. No. A-26 (Title 10, Ch. 2, of the 1992 Code). Amendments noted where applicable.]
The following definitions shall be applicable in this chapter:
BICYCLE
Every device propelled by the feet acting upon pedals and having wheels, any two of which are not less than 14 inches in diameter.
BICYCLE LANE
That portion of a roadway set aside for exclusive use of bicycles and so designated by appropriate signs and markings by the responsible governing body.
BICYCLE WAY
Any path or sidewalk, or portion thereof, designated for the use of bicycles by the responsible governing body.
BIKE ROUTE
Any bicycle lane, bicycle way or highway which has been designated by the responsible governing body and identified by appropriate signs and markings.
CARRIER
Any device attached to a bicycle designed for carrying articles.
IDENTIFICATION TAG
A metal plate or sticker indicating that a bicycle is registered.
RIGHT-OF-WAY
The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other.

No person shall ride or propel any bicycle upon any public street, alley, boulevard or sidewalk of the Village in such manner as to interfere with the rights of other persons using such street, alley, boulevard, or sidewalk.
A. 
No person shall operate a bicycle upon a highway unless equipped as required in § 347.489, Wis. Stats.
B. 
Every bicycle operated upon the sidewalks, streets, alleys or public highways of the Village during any time between one-half hour before sunset and one-half hour before sunrise and at all other times when to render clearly visible any person, vehicle, or other substantial object a distance of 50 feet, shall have their lights on, and the lights shall conform to the requirements as heretofore stated. Lanterns and makeshift lights on bicycles are strictly forbidden.
A. 
No person shall leave a bicycle at such a place or in such a way as to create a hazard to pedestrians, automobile operators or to anyone else. Bicycles shall be parked either upon the roadway against the curb, in bicycle racks or, if on the sidewalk, in such a manner as to afford the least obstruction to pedestrian traffic, and not in such a manner as to obstruct the ingress and egress to buildings used by the public. If there is no bicycle rack or other facility intended to be used for the parking of bicycles in the vicinity, the operator may park a bicycle on the sidewalk in an upright position parallel to and within 24 inches of the curb.
B. 
No bicycle shall be parked upon any street or public way except in an upright position in bicycle stalls which are provided therefor.
The provisions of Chs. 346 and 347, Wis. Stats., and applicable Village ordinances shall govern the operation of bicycles where appropriate.
A. 
Rule for turning.
(1) 
The operator of a bicycle intending to turn to the right at an intersection shall approach the point of turning in the traffic lane nearest the right-hand edge or curb of the street and, in turning, shall keep as close as practicable to the right-hand edge or curb of highway.
(2) 
The operator of a bicycle intending to turn to the left of an intersection or into a private driveway shall make such turn from the traffic lane immediately to the right or next to the center of the street and pass immediately to the left of the center of the intersection, passing as closely as practicable to the left of the center of the intersection immediately to the right of the center of the intersection of the street.
(3) 
At any intersection where traffic is controlled by a traffic control signal or by a traffic officer, it shall be unlawful for any such operator of such bicycle upon any street to disobey the instructions of any official traffic sign or signal placed in accordance with the laws of the State of Wisconsin and other ordinance of the Village.
(4) 
Crosswalks shall be used when walking a bicycle through an intersection.
B. 
Trick riding. No person shall operate a bicycle upon the streets of said Village without having manual control of the handlebars or operate a bicycle in any other manner which necessitates the element of unusual extraordinary skill and involves unnecessary risk. No bicycle shall be allowed to proceed in any street in the Village by inertia or momentum with the feet of the rider removed from the bicycle pedals. No rider of a bicycle shall remove both hands from the handlebars or practice any trick or fancy riding in any street in the Village.

C. 
Tandem riding. No person shall ride or propel a bicycle on a street in said Village with another person upon said bicycle so that two persons are on the bicycle at one time unless such bicycle is so constructed as to be a tandem bicycle.

D. 
Emerging from alley or driveway. The operator of a bicycle emerging from an alley, driveway or building shall, upon approaching a sidewalk or the sidewalk area extending across any alleyway, yield the right-of-way to all pedestrians and, upon entering the roadway, shall yield the right-of-way to all vehicles approaching on said roadway.
E. 
Bicycles not to be pulled by moving vehicles. No person riding upon a bicycle shall cling or attach himself or his bicycle to any other moving vehicle upon a street or highway, nor shall the operator of any such bicycle tow or draw any coaster wagon, sled, person on roller skates, toy vehicles or any other similar vehicle on such highway.
F. 
Speed. No person shall operate a bicycle at a speed greater than is reasonable and prudent under existing conditions or in excess of any posted speed limit.
G. 
Bicycles prohibited on sidewalks. No person shall propel a bicycle or other similar vehicle upon any sidewalk of any street within the Village of Reeseville; provided, however, that this subsection shall not apply to newspaper carriers in the process of delivering newspapers, nor to police during the course of official business, nor to that portion of the sidewalk which provides ingress and egress from the owner's residence, or on bicycle ways as defined in § 191-1 in the definition of "bicycle way."
H. 
Operation on sidewalks. No person over the age of 10 shall ride or propel any bicycle upon any public sidewalk or thoroughfare of the Village set apart for pedestrians, except bicycles having wheels sized 14 inches or under. This exception shall not apply to fourteen-inch-or-under bicycles designed or modified to BMX specifications.
I. 
Bicycle operation while hearing obstructed. No person may operate a bicycle upon a highway while such operator is using any audio device attached directly to the ear or ears of such operator that materially impairs the ability of such operator to hear traffic signals or warnings.
J. 
Mopeds prohibited on bicycle ways. No person may ride a moped or motor bicycle with the power unit in operation upon a bicycle way.
K. 
Riding bicycle on bicycle lane.
(1) 
Unless two-way traffic is authorized by the Village Board on any portion of a roadway which it has set aside as a bicycle lane and appropriate traffic signs are installed, every person operating a bicycle upon a bicycle lane shall ride in the same direction in which vehicular traffic on the lane of the roadway nearest the bicycle lane is traveling.
(2) 
Entering or exiting bicycle lane.
(a) 
Unless otherwise provided under Subsection K(2)(b) below, a person operating a bicycle may enter or leave a bicycle lane only at intersections or at driveways adjoining the bicycle lane.
(b) 
A person may leave a bicycle at any point by dismounting from the bicycle and walking it out of the lane. A person may enter a bicycle lane at any point by walking his bicycle into the lane and then mounting it.
(3) 
Every person operating a bicycle upon a bicycle lane shall exercise due care and given an audible signal when passing a bicycle rider proceeding in the same direction.
(4) 
Every operator of a bicycle entering a bicycle lane shall yield the right-of-way to all bicycles in the bicycle lane. Upon leaving a bicycle lane, the operator of a bicycle shall yield the right-of-way to all vehicles and pedestrians.
L. 
Riding bicycle on bicycle way.
(1) 
Every person operating a bicycle upon a bicycle way shall:
(a) 
Exercise due care and give an audible signal when passing a bicycle rider or a pedestrian proceeding in the same direction.
(b) 
Obey each traffic signal or sign facing a roadway which runs parallel and adjacent to a bicycle way.
(2) 
Every person operating a bicycle upon a bicycle way open to two-way traffic shall ride on the right side of the bicycle way.
(3) 
Every operator of a bicycle entering a bicycle way shall yield the right-of-way to all bicycles and pedestrians in the bicycle way.
A. 
Registration required. No person shall operate a bicycle upon any street, sidewalk, public property, bicycle pathway or public highway within the Village of Reeseville, unless said bicycle shall first have been properly registered and an identification tag attached as hereinafter provided.
B. 
Form of registration.
(1) 
Identification. Every owner of a bicycle shall list and register his bicycle with the Police Department on a form as provided by the Department.
(2) 
Period of registration. All bicycle registrations shall be for the life of the applicant's ownership of the bike.
(3) 
Owner to register. The registration authority shall not register any bicycle which it knows or has reasonable grounds to believe is not owned by or lawfully in the possession of the applicant.[1]

(4) 
Registration plate or tag. On receipt of payment of the registration fee herein provided for, the Police Department shall provide a suitable identifying registration decal tag or plate, serially numbered to correspond with the registration number. The owner shall affix said registration decal or plate to a location as specified by the Police Department on the frame of the bicycle for which the registration decal or plate is issued.

C. 
Records and transmittal of fees.
(1) 
The Police Department shall keep at its office a suitable book and duplicate record of applications and registrations.
(2) 
A complete report shall be made to the Village Clerk-Treasurer by the Chief of Police of funds received for bicycle registration fees, and all such fees shall be paid to the Village-Clerk-Treasurer for deposit as Village revenues.
D. 
Bicycles to be kept in safe condition. No bicycle shall be registered which is in an unsafe mechanical condition. The Chief of Police shall have authority to suspend the registration of and remove the identification tag from any bicycle or to impound the bicycle operated contrary to any state law or Village ordinance, or which is being operated in an unsafe mechanical condition. Such suspension and removal or impounding shall continue for a period not to exceed 10 days, but the registration shall not be reinstated or such identification tag replaced while such bicycle is in unsafe condition. Such suspension and removal shall be in addition to other penalties provided for herein.
E. 
Change of ownership. Within 10 days after any bicycle registered hereunder shall have changed ownership or been dismantled and taken out of operation, such information shall be reported to the Police Department by the person in whose name the bicycle has been registered.
F. 
Registration to be displayed. The identification tag issued under this section shall be affixed to the registered bicycle so as to be plainly seen and read and shall remain so affixed until ordered removed by the Police Department for cause, or until expiration of the registration.
G. 
Exemption from registration. Any nonresident may operate a bicycle which is duly registered in any municipality without obtaining local registration if a valid identification tag is attached thereto.
H. 
Removal and alteration of identification tags.
(1) 
Removal prohibited. No person shall remove an identification tag from a bicycle during the period for which issued except upon a transfer of ownership or when the bicycle is dismantled and no longer operated upon any highway within the City.
(2) 
Alteration prohibited. No person shall alter or counterfeit any identification tag.
A. 
As used herein, "play vehicles" means a coaster, skateboard, roller skates, unicycle, or any toy vehicle upon which a person may ride, not including bicycles. As used herein, "in-line skates" means skates with wheels arranged singly in a tandem line rather than in pairs.
B. 
No person 16 years of age or older shall ride in-line skates on any public sidewalk.
C. 
Persons riding in-line skates may travel on any roadway or street within the Village of Reeseville.
D. 
No person shall ride in-line skates or a play vehicle on any roadway or street between the hours commencing one-half hour before sunset and terminating one-half hour after sunrise, unless said person is wearing reflective clothing or carries a clear light visible to the front and a red light visible to the rear or a red reflector visible to the rear.
E. 
Persons riding in-line skates or a play vehicle on a roadway or street shall obey the provisions of all ordinances and state laws applicable to the operator of any motor vehicle.
F. 
Persons riding in-line skates or a play vehicle on a roadway or street shall ride single file on all roadways or streets.
G. 
Persons riding in-line skates or a play vehicle shall, upon entering a highway, yield the right-of-way to motor vehicles.
H. 
Where the riding of in-line skates or a play vehicle on sidewalks is permitted, every person operating in-line skates or a play vehicle upon the sidewalk shall yield the right-of-way to any pedestrian and shall exercise due care when passing a pedestrian on the sidewalk.
I. 
A person riding upon in-line skates or a play vehicle shall ride as near as is practicable and/or safe to the right edge of the unobstructed traveled roadway upon any roadway carrying two-way traffic. On one-way roadways, a person riding on a play vehicle shall ride as near as is practicable to the right edge or left edge of the unobstructed traveled roadway. Every person riding in-line skates or a play vehicle in the roadway shall exercise due care when passing a standing vehicle or one proceeding in the same direction, allowing a minimum of three feet between the person riding on the in-line skates or play vehicle and the vehicle.
J. 
A person riding in-line skates or a play vehicle on the roadway shall not impede motor vehicle traffic to said person's rear. If inadequate space exists for operation of motor vehicles and the person riding on the in-line skates or play vehicle to proceed in the same direction upon any roadway in the Village, then the person riding upon the in-line skates or play vehicle shall, upon the approach of a motor vehicle from the rear, move as far to the side of the road as possible and stop if necessary, so as to permit adequate room for the motor vehicle traffic to pass said person riding on the in-line skates or play vehicle without leaving the lane in which said motor vehicle is traveling.
K. 
No parent or guardian of any child 16 years of age or under shall authorize or knowingly permit such child to violate any of the provisions of this section.
A. 
Any person 16 years of age or older who shall violate any provision of this chapter, except § 191-8, may be issued a Uniform Traffic Citation and be subject to the penalties provided by the Uniform State Traffic Deposit Schedule.
B. 
Any person 14 years of age through 15 years of age who shall violate any provisions of this chapter, except § 191-8, may be issued a citation and be subject to the penalties provided by the Deposit Schedule and, upon conviction thereof, may be required to forfeit not more than $25, together with the cost of the prosecution and, in default of such payment, the court may suspend the child's operating privileges, as defined in § 340.01, Wis. Stats., for not less than 30 days nor more than 90 days.

C. 
Any person under 14 years of age who shall violate any provision of this chapter, except § 191-8, may be issued a special bicycle violation warning notice, along with the following additional actions:

(1) 
First offense in one year: a warning letter sent to the parent or guardian requiring their signature and return of the warning notice to the Police Department.
(2) 
Second offense in the same year: a warning letter mailed to parent or guardian and a mandatory parent-child-police conference.
(3) 
Third and subsequent offense in the same year: mandatory referral to Dodge County Juvenile Court.
D. 
Any parent or guardian of any child who authorizes or knowingly permits such child to violate any of the provisions of this chapter may be subject to the provisions of §§ 346.77 and 346.82(1), Wis. Stats.
The Chief of Police shall, once a year at public auction, dispose of bicycles and other personal property in the possession of the Village which has been unclaimed for a period of 30 days. All money received from such auction, after the necessary expenses of keeping the property and conducting and locally advertising the auction, shall be paid into the Village treasury.
