Permit issuance and special use exemption. All permits and/or special
use exemptions from any rules and regulations set forth in this chapter
shall be issued by the Director. All permits and special use exemptions
shall be signed by the Director.
Application. A person seeking issuance of a permit or special use
exemption shall file the appropriate application with the Essex County
Department of Parks, Recreation and Cultural Affairs.
That the proposed activity or use of the County property will not
unreasonably interfere with or detract from the general public enjoyment
of the County property;
That the proposed activity or use will not unreasonably interfere
with or detract from the promotion of public health, welfare, safety
and recreation, or adversely impact natural resources;
Appeal. Within five days after receipt of an application, the Director shall apprise an applicant, in writing, of his reasons for refusing a permit. Any person aggrieved by the refusal of a permit by the Director shall have the right to appeal same, in writing, within five business days of the receipt thereof to the County Administrator who shall consider the application under the standards set forth in Subsection C hereof and sustain or overrule the Director's decision within 10 business days. The decision of the County Administrator shall have final force and effect.
Effect of permit. A permittee shall be bound by all County rules
and regulations and all applicable ordinances as though same were
fully inserted in said permits.
Liability of permittee. The person or persons to whom a permit is
issued shall be liable for any loss, damage or injury sustained by
any person whatever by reason of the negligence of the person or persons
to whom such permit shall have been issued.
