A.
No owner, operator or other person shall occupy or let to another
person any dwelling, rooming house, dwelling unit or rooming unit
which does not comply with the following minimum standards for space,
use, and location, and no dwelling, rooming house, dwelling unit or
rooming unit or any premises containing such areas shall fail to comply
with the following minimum standards for space, use and location.
B.
For purposes of this section, a person under one year of age shall
not be considered an occupant.

Every dwelling unit shall contain at least 250 square feet of
habitable floor area for the first occupant, at least 100 square feet
of additional habitable floor area for each additional occupant.

In every dwelling unit, every room occupied for sleeping purposes by one occupant shall contain at least 70 square feet of floor area, and every dwelling unit room occupied for sleeping purposes by more than one occupant shall contain an additional 45 square feet of floor area for each occupant 12 years of age and over, and 35 square feet of floor area for each occupant under 12 years of age in addition thereto subject to the limits of § 455-56, Calculation of floor area.
Every rooming unit shall contain a minimum of 150 square feet
of floor area and may be occupied by one person. In every rooming
unit, the bedroom thereof shall contain at least 70 square feet of
floor area.
Floor area shall be calculated on the basis of habitable room
area. However, closet area and hall area within the dwelling unit,
or rooming unit, where provided, may count for not more than 10% of
the required floor area. At least 1/2 of the floor area of every habitable
room shall have a ceiling height of at least seven feet and the floor
area of any part of any room where the ceiling height is less than
4 1/2 feet shall not be considered as part of the floor area
in computing the total floor area of the room to determine maximum
permissible occupancy.
In any dwelling in which water closet, lavatory basins, bathtubs
or shower facilities are shared by the occupants of more than one
rooming unit, such facilities shall be so located within the dwelling
as to be accessible without going through another dwelling unit or
rooming unit.

No basement or cellar shall be used as a habitable room without
meeting all applicable requirements of this code.
