The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe the other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in R.S. 39:4-138, any other New Jersey statute or as hereinafter provided.

No person shall park a vehicle at any time upon any of the streets or parts of streets thereof described in Schedule I which can be found in § 8A-1.

No person shall park a vehicle between the hours specified in Schedule II of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule II which can be found in § 8A-3.

No person shall park a vehicle at any time on the days specified in Schedule II-A (except Sundays and public holidays) upon any of the streets or parts of streets in Schedule II-A which can be found in § 8A-4.

It shall be unlawful for the owner or operator of a truck tractor, trailer, semitrailer, commuter van, school buses including Type I and Type II school vehicles as defined in N.J.S.A. 39: 1-1, omnibus vehicles (including taxis), limousines, motorized motor homes (a vehicle equipped with sleeping, kitchen, or bathroom facilities), any vehicle with commercial registration, any vehicle with business signs, business decals or any business advertisement, any vehicle that is used for commercial purposes to park such vehicles on any street in the Township of Belleville between the hours of 9:00 p.m. and 6:00 a.m. as described in Schedule II-B, attached to and made a part of this chapter. Penalty for the violation of this section shall be a fine of $50 for each violation.
Additionally, any unoccupied vehicle parked or standing in violation herein shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable cost of the removal and storage before regaining possession of the vehicle.

b. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary "EMERGENCY NO PARKING", signs are displayed. The Chief of Police, or, in his absence, the ranking police officer, is authorized to declare an emergency and to direct the posting of the "EMERGENCY NO PARKING" signs when weather conditions, accidents, fires, or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the "EMERGENCY NO PARKING" signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
c. 
Any unoccupied vehicle parked or standing in violation herein, shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable cost of the removal and storage before regaining possession of the vehicle.
d. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

No person shall park a vehicle for longer than the time limit shown in Schedule IV of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV which can be found in § 8A-8. If the vehicle remains parked in any parking space beyond the parking time limit, such vehicle shall be considered as parked overtime, and the parking of a vehicle overtime shall be deemed a violation of this chapter. It is unlawful for any person to cause or permit any vehicle registered in his name or under his control to be parked overtime in any parking space.

The Township Council further finds that one factor threatening the safety, health and attractiveness of the Township's neighborhoods is the excessive and burdensome practice of nonresidents parking their motor vehicles for extended periods of time in certain neighborhoods within the Township. This practice is caused in part by the implementation by neighboring communities of no overnight parking within their city limits. As such, the number of nonresident motor vehicles attempting to park within certain residential areas in the Township of Belleville often exceeds the number of available parking spaces. A preferential parking system for certain neighborhoods within the Township will help to reduce the burden of those excess vehicles on the residents of those neighborhoods and thus promote the general welfare of the Township.

For the purposes of this section, the following words shall have the meanings ascribed to them in this section as follows:
LEASE
Shall mean that a person pays rent or other remuneration for the use of a parcel of real property located in a designated residential parking permit area, as the person's residence or place of business.
MOTOR VEHICLE
Shall mean an automobile, truck, recreation vehicle, motorcycle, or other motor driven or self-propelled form of transportation.
OWNS
Shall mean that a person has at least one-quarter interest in a parcel of real property within a residential parking permit area.
RESIDENT VEHICLE
Shall mean a motor vehicle parked in a residential area in which it is registered with the State of New Jersey, Department of Motor Vehicles.
RESIDENTIAL PARKING PERMIT AREA
Shall mean a residential district determined by the Township Council to be such area affected by nonresident motor vehicle parking as a result of other municipalities restricting overnight parking.

The Township Council has determined that residential areas within the Township of Belleville would benefit from residential parking permits within those areas. In accordance with the provisions of this section, the areas described in Schedule A attached to and made part of this section are hereby designated residential parking permit areas. From time to time the Township Council may review the list of designated residential parking permit areas and may make changes as deemed appropriate by the Township Council. The Township Council may add or delete any areas it deems appropriate in the interest of promoting the general welfare of the Township of Belleville. In determining whether nonresident vehicle parking sufficiently impacts a residential district within the Township of Belleville, the Township Council shall consider factors including but not limited to the following:
a. 
The extent that legal on-street parking spaces are occupied by motor vehicles during the period proposed for parking restrictions.
b. 
The extent that vehicles parking in the area during the period proposed for parking restrictions are commuter vehicles.
c. 
The extent that residents cannot obtain adequate curbside parking adjacent to or near their residence because of widespread use of available curbside parking spaces by nonresident vehicles.
d. 
The effect on the safety of the residents from intensive nonresident vehicle parking.
e. 
The extent that the designation of a residential parking permit area would be likely to reduce traffic congestion and other problems related to nonresident parking.
f. 
The extent and need for parking by the general public in a residential district.
g. 
The desire of the residents in the residential parking permit areas for the institution of a residential parking permit system.
h. 
The extent that no reasonable alternative is feasible or practicable that would reduce traffic congestion and other problems related to nonresident parking without unduly impacting surrounding residential areas.

a. 
Following the Township Council's designation of a residential parking permit area, parking signs shall be erected in the designated area.
b. 
The sign shall indicate prominently that the curbside parking on the public streets and highways in the designated area is limited to not more than two consecutive hours between the hours of 2:00 a.m. and 6:00 a.m. unless the vehicle properly displays a parking permit authorized by this ordinance.

Following designation by Township Council of an area as a residential parking permit area, the Township Manager shall cause to be mailed to each resident within the residential parking permit area the following documents:
a. 
The notice of designation that shall inform the residents in the designated area of:
1. 
The existence, exact location, and numerical designation of the residential parking permit area.
2. 
The parking restrictions applicable to all vehicles in curbside parking spaces along public streets and highways in the designated area that do not properly display a parking permit authorized by this section.
3. 
The procedures to obtain a residential, visitor, or business parking permit.
4. 
An application for residential parking permit on which the applicant is to provide the following information for each vehicle to receive a residential parking permit:
(a) 
The name and residential address of the owner of the vehicle.
(b) 
The name, residential address, and driver license number of the principal operator of the vehicle.
(c) 
The make, model, license plate number and registration number of the vehicle.
(d) 
The signature of the applicant for the residential parking permit.
(e) 
The applicant shall demonstrate proof of residency and motor vehicle ownership in a manner determined by the Township Manager.

a. 
Submission of a completed and validated residential parking permit application, and fulfillment of all applicable provisions of this section controlling issuance, renewal, or transfer of residential parking permits, the applicant shall receive one residential parking permit for the vehicle described in the application. The residential parking permit shall be securely affixed to the inside bottom left corner of the front windshield of the vehicle and shall display the following information:
1. 
The license plate number and registration number of the vehicle.
2. 
The numerical designation of the residential parking permit area.
3. 
The expiration of the residential parking permit which shall be one year from date of issuance.
4. 
No residential parking permit shall be issued to a vehicle whose owner and principal operator do not reside within the designated residential parking permit area.
5. 
The applicant for, and holder of, the residential parking permit shall be the owner or principal operator of the vehicle receiving the parking permit.
6. 
A vehicle shall be issued a residential parking permit only if it displays valid State license plates.

a. 
Verification of the holder's prior submission of the completed and validated residential parking permit application, fulfillment of all applicable provisions of this section controlling issuance, renewal, or transfer of residential parking permits, on or before the expiration date of the existing residential parking permit, the holder shall receive a new residential parking permit.
b. 
The expiration date to be displayed on the new residential parking permit shall be one year following the expiration date of the existing residential parking permit.

a. 
Upon submission of a completed and validated residential parking permit application, fulfillment of all applicable provisions of this section controlling issuance, renewal, or transfer of residential parking permits, and surrender of the existing residential parking permit, the holder shall receive a new residential parking permit to be transferred to another qualifying vehicle.
b. 
Verification of the holder's prior submission of a completed and validated residential parking permit application, fulfillment of all applicable provisions of this section controlling issuance, renewal, or transfer of residential parking permits, and affirmation that the holder's permit was lost, stolen, or destroyed, the holder shall receive a new residential parking permit. The lost, stolen or destroyed permit shall be considered void and any use of a voided permit is prohibited.
c. 
The transfer or replacement of the residential parking permit shall not affect the permit's original expiration date.

Upon application of a residential parking permit area, the Township Manager or designee shall issue a visitor parking permit to the resident for the visitor's vehicle to be limited to that particular parking permit area for a period not exceeding 30 days. No more than two visitor parking permits shall be issued to any one resident at any one time. All visitor and business parking permits shall be displayed on or about the front windshield of the vehicle so as to be easily visible from outside the vehicle. Such parking permits shall contain the numerical designation of the residential parking permit area, the name and address of the resident to whom the parking permit was issued on behalf of the visitor and the expiration date of the parking permit. For the purposes of this section, the resident shall be the holder of and responsible for the use and misuse of the visitor parking permits issued to the resident.

a. 
A parking permit shall not guarantee or reserve a parking space within a designated residential parking permit area. A parking permit shall not authorize the standing or parking of any vehicle in such places and during such time when the stopping, standing or parking of vehicles is prohibited or set aside for specified types of vehicles, and shall not excuse the observance of any traffic regulation, other than the two hour parking limit enforced in the residential parking permit area.
b. 
Whenever the holder of a residential or visitor parking permit, or the vehicle for which the parking permit was issued, no longer fulfills one or more of the applicable provisions of this section controlling issuance, renewal, or transfer of parking permits, the holder shall notify the Township Manager or designee, who may then direct the holder to surrender the parking permit.
c. 
Until its expiration, surrender or revocation, a parking permit shall remain valid for such time as the holder continues to reside within the designated residential parking permit area.
d. 
A parking permit shall be valid only in the residential parking permit area for which it is issued.
e. 
It shall be a violation of this section for the holder of a parking permit to fail to surrender the permit when directed to do so.
f. 
It shall be a violation of this section for any person to represent in any fashion that a vehicle is entitled to a parking permit authorized by this section when it is not so entitled. The display of a parking permit on a vehicle not entitled to such a parking permit shall constitute such a representation.
g. 
It shall be a violation of this section for any person to duplicate, or attempt to duplicate, by any means a parking permit authorized by this section. It also shall be a violation of this section for any person to display on any vehicle such a duplicate parking permit.

The following vehicles are specifically exempted from the parking restrictions imposed by this ordinance:
a. 
A motor vehicle owned by or operated under contract to a utility when used in the construction, operation, removal or repair of utility property or facilities or engaged in authorized work in the designated residential parking permit area.
b. 
A motor vehicle identified as owned by or operated under contract to a Federal, State, or local governmental agency in being used in the course of official government business.
c. 
An authorized emergency vehicle as defined by State law.

a. 
Following the Township Council vote to withdraw the designation of an existing residential parking permit area, the Township Manager or designee shall mail to every residence within the existing residential parking permit area a notice of the council's withdrawal of the designation. Said notice shall specify the effective date of the withdrawal of the designation.
b. 
The effective date of the withdrawal of the designation of an existing residential parking permit area shall be 30 days following the date of the Township Council vote to withdraw the designation.

The director of public safety shall be responsible for the enforcement of this section.

Any person violating any provision of this section shall, upon conviction thereof by a court of competent jurisdiction, be fined not more than $50 for each violation.
In addition to the penalties provided above for the violation of this section the Township Manager or his designee may revoke the residential parking permit of any person found to be in violation of this section, and, upon written notification thereof the person shall surrender such permit to the Township Manager or designee. Failure to surrender a revoked residential parking permit when requested to do so shall constitute a separate violation of this section.

The Township Manager of the Township of Belleville is authorized to set aside and designate in each of the public parking lots of the Township of Belleville as are indicated by the following schedule certain parking spaces designated as business area permit parking spaces.

With the approval of the Governing Body, additional spaces in the above lots may be designated as permit parking spaces from time to time.

The Township Manager, from time to time, shall set aside and designate for each set permit parking space in each of the respective parking lots as provided in subsection 8-2B.1 above, such number of the parking spaces as may be reasonably necessary to accommodate the needs of the public, with due regard for the requirements of the public for metered parking spaces and the manager shall notify the Township Clerk in writing of the number of parking spaces so set aside and designated for paid permit parking. The parking spaces in the paid permit parking area shall be numbered consecutively and conspicuously designated as a paid permit parking space. The Township Manager shall receive all applications for permits on approved application forms which shall be accompanied by the prepaid permit fee. Applications shall be granted in the order by which they are received.

The Township Clerk of the Township of Belleville is hereby authorized to issue to person applying and qualifying therefor the following types of parking permits:
a. 
A-Permit. An A-Permit shall entitle the holder thereof to park a designated passenger motor vehicle (not including a truck or bus) in any available parking space in the lots set forth in subsection 8-2B.1 between the hours of 7:00 a.m. and 7:00 p.m. on weekdays and Saturdays during the entire period for which the permit is issued.
b. 
B-Permit. A B-Permit shall entitle the holder thereof to park a designated passenger motor vehicle (not including a truck or bus) in any available parking space within the permit parking area of the lots set forth in subsection 8-2B.1 in which a permit parking area has been set aside between the hours of 8:00 p.m. and 6:00 a.m. on weekdays and Saturdays during the entire period for which the permit is issued.

The issuance of any permit hereunder shall not constitute a guarantee to the person to whom issued that a space will be available for the designated motor vehicle.

Permits may be issued for a period of one year commencing on the first day of January and terminating on the 31st day of December, or semi-annual permits may be issued for six-month periods commencing January 1st or July 1st of each year and terminating on the last day of the preceding month.

As used in this section, the following terms shall have the meaning indicated.
IN-COMMUTER
Shall mean a person who is a nonresident of the Township of Belleville, but has a place of business or who is regularly employed by a business located in the Township of Belleville. The rate for an in-commuter shall be the same as a resident.
NONRESIDENT
Shall mean a person not residing or working in the Township of Belleville.
RESIDENT
Shall mean a person residing in the Township of Belleville, or a person who does not reside in Belleville but who is the owner of taxable real or personal property in the Township of Belleville.

All permits shall be in the form of a decal sticker and shall contain all essential information, including without limitation, the type of permit, the period for which issued, the registration number of the motor vehicle for which it is issued and the parking area for which it is issued.

Every permit shall be affixed as a decal to the motor vehicle for which issued upon the lower right hand corner of the rear window. Affixing such decals by use of adhesive tape or any similar tape or device is prohibited.

During the hours between 7:00 a.m. and 7:00 p.m. of each day except Sunday it shall be unlawful for any person to cause, allow, permit or suffer any vehicle registered in any paid permit parking area in the municipal parking lots in the Township of Belleville without an appropriate permit therefor properly affixed to said motor vehicle as hereinabove set forth.

Any person violating any provisions of this section shall, upon conviction thereof, be punished by a fine not exceeding $350 for each violation or by imprisonment in the County jail for a period not exceeding two days or both.

The Township Manager shall be authorized to issue the parking permits which shall be issued exclusively for the residents of the residential parking permit areas as established in subsection 8-2C.12, Areas Established.

The flashing beacon installation shall be installed in accordance with the provisions of "An Act Concerning Motor Vehicles and Traffic Regulations," subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey, and as more specifically described in the engineering design approved by the Division of Motor Vehicles, State of New Jersey, dated July 12, 1963, which engineering design is made a part of this chapter, three copies of which are on file in the Township Clerk's office.

Any person found guilty of violating the provisions of this chapter shall, upon conviction, be subject to a fine in accordance with the Local Supplemental Violations Bureau Schedule of Designated Offenses, or as otherwise determined by the Municipal Judge, not to exceed $250. Pursuant to the authority granted to this municipality by the provisions of N.J.S.A. 39:4-197.6, there are established restricted parking zones in front of the residence occupied by a handicapped person or by another occupant of the residence who is a member of the immediate family of the handicapped person residing therein, said locations described in Schedule XVI which can be found in § 8A-22. Such persons shall display a windshield placard or wheelchair symbol license plate or other special vehicle identification card or insignia issued by the Division of Motor Vehicles. No other person shall be permitted to park in these restricted parking zones.

Any person found guilty of violating the terms of this section shall be subject to a fine of $100 for the first offense and, for subsequent offenses, a fine of at least $100 and up to 90 days community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.

The restricted parking zones created by this section shall be designated as "tow away zones." Signs should read "reserved parking-tow away zone restricted to resident or authorized members of immediate family of handicapped resident." The tow away zone sign should be installed on a separate plate below the handicapped parking sign.
