Code § 81-1]
Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.
Whenever certain hours are named in this chapter, they shall
mean either Eastern standard time or Eastern daylight saving time
as may be in current use.
a. The
Mayor, or, in the event of his absence, disability or inability to
act, then the Chief of Police or the ranking police officer is hereby
authorized to provide by regulation for the closing of any street
or portion thereof to motor vehicle traffic on any day or days during
specified hours whenever he finds that such closing is necessary for
the preservation of the public safety, health or welfare.
b. Any
regulations promulgated by the Mayor and in accordance with paragraph
a above, shall provide for the posting of proper warning signs of
such closing on any street or portion thereof during the time the
same is closed in pursuance thereof.
c. Any
violation of this regulation promulgated hereunder shall be punished
by a fine not to exceed $50.
d. Any
regulation adopted that mandates the closing of any street for a period
greater than 48 consecutive hours shall not become effective unless
and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.
Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any police officer may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.
Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $50 or imprisonment for a term not exceeding 15 days or both.
If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.
All former traffic ordinances of the Borough of Spring Lake
that are contained in this chapter are hereby repealed, and all ordinances
or parts of ordinances in conflict with or inconsistent with the provisions
of this chapter are hereby repealed, except that this repeal shall
not affect or prevent the prosecution or punishment of any person
for any act done or committed in violation of any ordinance hereby
repealed prior to the taking effect of this chapter.
The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other, more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
statute or as hereinafter provided.
a. Upon
the declaration of an emergency, there shall be no parking upon streets
or sections of streets where temporary EMERGENCY NO PARKING signs
are displayed. The Chief of Police or, in his absence, the ranking
police office is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the sings.
b. The
effectiveness of this subsection is contingent upon the signs being
erected as required by law.
a. Whenever
snow has fallen and the accumulation is such that it covers the streets
or highways, an emergency shall exist and no vehicle shall be parked
on the streets or highways or portions thereof indicated.
The above parking prohibitions shall remain in effect after
the snow has ceased until the streets have been plowed sufficiently
and to the extent that parking will not interfere with the normal
flow of traffic.
b. Any
unoccupied vehicle parked or standing in violation shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic
and any police officer may provide for the removal of such vehicle.
The owner shall pay the reasonable costs of the removal and storage
which may result from such removal before regaining possession of
the vehicle.

The owners and drivers of any hack, carriage or motor vehicle
engaged in the business of carrying passengers shall not use or occupy
any other place in the streets, avenues or public places of this Borough
as a place or stand for the purpose of soliciting business, except
the place hereinbefore designated.

Pursuant to the authority granted to this municipality by N.J.S.A.
39:4-197, the following locations are hereby designated as restricted
parking spaces for use by persons who have been issued special handicapped
license plates, identification cards, wheelchair symbol license plates
or windshield place cards by the Motor Vehicle Commission. No other
person shall be permitted to park in these spaces.
Penalties. Any person parking a motor vehicle in a restricted
parking space without a special vehicle identification card shall
be liable to a fine of at least $250 and up to 90 days of community
service on such terms and in such form as the Court shall deem appropriate,
or any combination thereof.
The spaces shall be identified by the wheelchair sign approved
by the New Jersey Department of Transportation, and in addition, there
shall be a second sign indicating the penalty.
No person shall cause or permit to be parked any motor vehicle
in a parking space reserved for physically handicapped persons between
the hours of 3:00 a.m. and 6:00 a.m.

The Borough of Spring Lake has limited parking facilities at
its beachfront and the Borough's First Aid has many calls during the
months of June, July and August for its volunteer First Aid Squad
to respond to its beachfront area. There is a need for first aid parking
on an emergent and standby basis.
Therefore, be it ordained, by the authority vested in the Municipality
under N.J.S. 39:4-197.3 as follows:
A. Going north from Tuttle Avenue behind the Pavilion on the easterly
side of Ocean Avenue, special parking shall be designated as follows:
(1) Beach Manager parking space.
(2) Spring Lake First Aid parking space.
(3) Life Guard/EMT parking space.
(4) Beach maintenance parking space.
(5) Volunteer fireman parking space for members of the Spring Lake Fire
Company #1 and Spring Lake Goodwill Fire Company #2.

Penalty. Any violation of this traffic parking designation shall
be punishable by a minimum fine of $50 up to a maximum fine of $100.
In addition, the cars will be subject to being towed away and
the owners shall be responsible for any towing charges.

As utilized in this section the term "autobus" or "bus" shall
mean any motor vehicle or motor bus operated over public highways
or public places for the transportation of passengers for hire, whether
in a regular route, charter or special bus operation, with a carrying
capacity of more than 12 passengers.

No autobus or bus shall be permitted to park, or stand with
its motor running, for a period of time greater than 30 minutes on
either the east or west sides of Ocean Avenue along the Spring Lake
beachfront, from June 15 to September 15.

No autobus or bus shall be permitted to park or stand with its
motor running for a period of time greater than 30 minutes along any
residential street west of Ocean Avenue in the Borough.

Autobus or bus parking shall be permitted at the parking area
adjacent to the Spring Lake Railroad Station and the parking lot located
at Marucci Park off Third Avenue. During the period from September
16th through June 14th, parking of an autobus or bus may be permitted
at designated areas along Ocean Avenue. The designated parking areas
shall be established by the Chief of Police of the Borough of Spring
Lake or his authorized agent.
Any person violating this traffic parking designation shall
be subject to a maximum penalty upon conviction of one or more of
the following:
Imprisonment in the county jail or in any place provided by
the municipality for the retention of prisoners, for any term not
exceeding 90 days; or a fine not exceeding $1,250; or by a period
of community service not exceeding 90 days.
In addition, the autobus or bus will be subject to being towed
away and the owner shall be responsible for any and all towing charges.

This §
7-32 is adopted for the purpose of providing a suitable location in the Borough for the parking of certain commercial and oversized vehicles by Borough residents and promoting the orderly and safe parking of those motor vehicles on Lot 8, Block 49 and Lot 2, Block 61, owned by the Borough.
The provisions, rules and regulations of this §
7-32 apply to the properties identified as Block 49, Lot 8 and Block 61, Lot 2 on the Tax Maps of the Borough of Spring Lake, being the railroad parking areas situated between Sussex and Warren Avenues adjacent to the New Jersey Department of Transportation Railroad line, hereafter referred to as the " Railroad Parking Lot."
As used in this §
7-32, the following terms shall have the following meanings:
COMMERCIAL AND OVERSIZED VEHICLE
Any commercially registered vehicle or any vehicle having
a gross vehicle weight rating (GVWR) in excess of 12,000 pounds but
excluding Recreational Vehicles as defined herein.
GROSS VEHICLE WEIGHT RATING OR GVWR
The value specified by a manufacturer as the loaded weight
of a single or a combination (articulated) vehicle. The GVWR of a
combination (articulated) vehicle, commonly referred to as the "gross
combination weight rating" or "GCWR," is the GVWR of the power unit
plus the GVWR of the towed unit or units. In the absence of a value
specified for the towed unit or units by the manufacturer, the GVWR
of a combination (articulated) vehicle is the GVWR of the power unit
plus the total weight of the towed unit, including the loads on them.
PASSENGER VEHICLE
Any motorized vehicle registered in the State of New Jersey
principally designed for the transport of persons and excluding commercial
and oversized vehicles and recreational vehicles as defined herein.
RECREATIONAL VEHICLE OR RV
All motor homes, campers, travel trailers, tent trailers,
"pop-up" trailers, boats, boat trailers, utility trailers, snowmobile
trailers or any similar vehicle primarily used for noncommercial recreational
purposes.
A. Parking in the Railroad Parking Lot shall be permitted only as set
forth herein.
B. "Permit Only Parking" in designated areas and spaces.
(1)
The Borough shall designate a specific area or areas in the
Railroad Parking Lot as "Permit Parking Only," which areas shall be
marked by signs indicating that parking will be by permit only and
that vehicles must bear the required permit; such signs may state
"Parking For Vehicles With Permits Only."
(2)
The parking, including overnight parking, of commercial and
oversized vehicles, as defined herein, is permitted only in specifically
designated "Permit Parking Only" areas within designated spaces, subject
to the further regulations set forth herein.
(3)
The parking of recreational vehicles is prohibited in the Railroad
Parking Lot.
(4)
Commercial and oversized vehicles which meet any of the following
criteria shall not be eligible for issuance of a permit and the parking
of such vehicles in the Railroad Parking Lot is prohibited:
(a)
Vehicles having more than two axles.
(b)
Vehicles more than 84 inches in width or 30 feet in length,
inclusive of any trailer attached thereto.
(c)
Vehicles having more than two wheels on any single axle.
(d)
Vehicles used in the transport of chemicals, petroleum products,
or hazardous waste.
(e)
Vehicles loaded with any materials which are not fully enclosed
within the body of the vehicle or any compartment forming a part thereof.
(5)
The parking of unattached trailers of any kind is prohibited.
The parking of boat, snowmobile, ATV or other recreational trailers
is prohibited. The parking of trailers directly associated with the
use of the permitted commercial or oversized vehicle is permitted
only while attached to the permitted vehicle, subject to all other
regulations herein.
C. Permit required.
(1)
No vehicle shall be parked in any designated "Permit Only Parking"
area unless it displays a current and valid permit decal issued by
the Borough of Spring Lake as herein provided.
(2)
A vehicle displaying a valid permit decal shall be permitted
to park in a designated space for a maximum of 72 consecutive hours
after which it must be removed from the designated area for a period
not less than four hours.
(3)
All vehicles must be parked with the front of the vehicle facing
the control sign which designates the parking space therefor and shall
have the permit decal permanently affixed to the rear bumper of the
vehicle, plainly visible from the parking lot.
D. Non-permit parking only areas of Railroad Parking Lot. Parking in
all areas in the Railroad Parking Lot not designated as "Permit Parking
Only" shall be permitted as follows:
(1)
The parking of commercial and oversized vehicles and recreational
vehicles is prohibited.
(2)
Passenger vehicles are permitted to park only in designated
parking spaces.
The application and issuance of permits shall be in accordance
with the following provisions:
a. Parking permits shall be issued by the Borough Clerk during the regular
hours which his or her office is open. Each applicant must provide
the Borough Clerk with a copy of a current and valid New Jersey driver's
license showing the name and address of the applicant as a resident
of the Borough of Spring Lake, along with the current and valid New
Jersey motor vehicle registration certificate for the vehicle sought
to be permitted, demonstrating that the vehicle is qualified for such
permit and that the vehicle is registered in the name of and at the
same address as the applicant who is a resident of the Borough of
Spring Lake.
b. The Borough Clerk shall issue no more permits than the number of
designated permit only parking spaces provided. Permits shall be issued
to residents of the Borough of Spring Lake on a first-come-first-served
basis until the maximum number shall have been issued, after which
no further permits shall be issued. The Borough Clerk shall maintain
a waiting list of residents who request but are not issued permits
to be utilized in reissuing permits upon the revocation, forfeiture,
surrender or nonrenewal of any existing permit.
c. The Borough Clerk shall not issue more than one permit to any one
resident, household, or address.
d. Permits shall be valid from January 1 through 12:00 midnight on December
31 of the year in which issued.
e. Fees.
(1)
There shall be a fee collected by the Borough Clerk in the amount
of $10 for each permit and annual renewal thereof.
(2)
Replacement fee for lost permit. Upon application for a replacement
permit and the filing of a proper certification, the Borough Clerk
may issue a replacement permit, for which an additional fee of $10
shall be imposed.
f. Said permits shall have written thereon "Spring Lake Borough Parking
Permit," together with the number of the permit, the date of expiration
of the permit and the license plate number of the vehicle registered.
The Borough Clerk shall also issue a parking permit decal which is
to be affixed to the permitted vehicle.
g. The Borough Clerk shall make and keep a record of all permits issued,
including therein the number of the permit, the date of issuance,
the name and address of the person to whom issued, the license plate
number(s) and the make, model and color of the motor vehicle(s) for
which each permit is issued.
h. The applicant shall be responsible to apply for renewal of any validly
issued permit prior to the expiration of said permit, and in connection
therewith shall provide the same information, documentation and fees
as required for initial issuance.
i. In the event that a validly issued permit is not renewed, or is otherwise
revoked, forfeited or surrendered, the Borough Clerk shall utilize
the waiting list to notify the first and successive eligible applicants
until such permit is reissued.
Further rules and regulations pertaining to such parking areas
and to parking of motor vehicles therein may be made from time to
time by resolution of the Borough Council.
No person shall park or place any disabled vehicle in any such
parking area, nor undertake repairs or allow such vehicle to be in
a state of disassembly in such parking area without the express permission
of the Borough Police, which permission shall be limited in duration
to the reasonable amount of time to have the disabled vehicle removed
or repaired. In no instance shall such permission exceed 24 hours.
a. In the case of a violation of any provision of this §
7-32, the person so parking and the owner of the vehicle shall be liable to a fine of not more than $500 or 90 days in the county jail, or both, and each day the violation continues shall be a separate and distinct violation.
b. Any vehicle parked in a parking area in violation of this §
7-32 may be removed from the parking area upon order of any police officer, and the owner thereof shall pay the reasonable cost of such removal and storage which may result from such removal before being allowed to regain possession of the vehicle, and such costs of removal and storage shall be in addition to any penalty or fine hereinbefore provided.
This §
7-32 shall not apply to any municipal vehicles registered to the Borough of Spring Lake or to any vehicles engaged in police work or emergency services.

Parking in the lot adjacent to Brown and First Avenues shall
be prohibited during the hours between 9:00 p.m. and 5:00 a.m. from
Memorial Day to Labor Day. The police may restrict complete access
to the lot during that time and take all other necessary actions to
enforce this prohibition.
