As used in this article, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Includes all beverages requiring licenses for sale, including, by way of example, beverages such as beer, wine, ale, liquors and liqueurs, in their original containers; and all mixtures of such beverages in mixed drinks or highballs containing 5% alcohol content by volume.
OPEN CONTAINER
Shall be defined as including all containers which, in the original form sold, contain less than one liter. It shall also include any larger container without a tightly affixed cap or cork capable of preventing leakage. It shall also include all glasses, cups or other types of containers made without cap or top or with a cap or top through which a straw may be inserted.
POSSESSION
Shall be defined as having the alcoholic beverage in hand, within arm's length, or within the same vehicle.

Any violation of this article shall constitute a municipal infraction, subject to a fine for the first infraction of $25, and for subsequent infractions a fine of $50. Citations and proceedings involving municipal infractions shall be governed by Chapter 51, Article I, of the Town Code, and Local Government Article of the Annotated Code of Maryland, § 6-102, and all amendments thereto.
