Certain documents, three copies of which are on file in the office of the Code Enforcement Officer of the Town of Delmar, being marked and designated as the International Residential Code, including Appendixes, as published by the International Code Council, Inc., be and hereby is adopted as the Code of the Town of Delmar, Delaware, for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of townhouses and one- and two-family dwellings not more than three stories in height in the Town of Delmar, and providing for the issuance of permits and collection of fees therefor, and each and all of the regulations, provisions, conditions and terms of such International Residential Code, 2012 edition, published by the International Code Council on file in the office of the Town of Delmar, are hereby referred to, adopted and made a part hereof as if fully set out in this article.
The foregoing 2012 Edition of the International Residential Code is adopted with the following exceptions, deletions and amendments:
A. 
IRC Section 309.2, Carports. Carports are excluded from inspections.
B. 
IRC Section 311.3, Landings. A landing will not be required on the exterior of a sliding door.
C. 
IRC Section 311.7.5.1, Riser Height. Maximum riser height shall be 8 1/4 inches.
D. 
IRC Section 311.7.5.2, Tread Depth. Minimum tread depth shall be nine inches, including winders.
E. 
IRC Section 403.1.6, Foundation Anchorage. No anchor bolts will be required at the end of each plate section, excluding corners.
F. 
IRC Section 313, Automatic Fire Sprinkler Systems. No automatic residential fire sprinkler system will be required in townhouses and one- and two-family dwellings under four stories.
G. 
All other references to the "Board of Appeals" or "Board" in Section 112 or elsewhere in the International Residential Code shall be deemed to be references to the said Board of Adjustment.
If any section, subsection, sentence, clause or phrase of this article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this article. The Town Council of the Town of Delmar, Delaware, hereby declares that it would have passed this article and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional.
The Town Manager is hereby ordered and directed to cause this article to be published on one occasion in a newspaper of general circulation in the Town.
This article and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect from the date of passage.
