Pursuant to § 24-0501 of Article 24 of the Environmental Conservation Law, in relation to the regulation, management, protection and conservation of the freshwater wetlands within the Town of Camden, the Town of Camden hereby adopts and sets forth as its ordinance for freshwater wetlands protection, the provisions of such Article 24, including the procedures and concepts contained therein, except that the provisions of such Article 24, to the extent authorized, shall be administered by the Town of Camden as provided herein.

After issuance of the official Freshwater Wetlands Map for the Town of Camden or any portion thereof, pursuant to § 24-0301 of said article, any person desiring to conduct on freshwater wetlands as so designated in such map, including any amendments thereof, and/or within any area 100 feet adjacent thereto; the regulated activities set forth in § 24-0701(2) of said article, must obtain a permit from the Town Clerk of the Town of Camden.

In granting or denying the permit, the Town Clerk shall be guided by the provisions of § 24-0705 of the Environmental Conservation Law. Any appeals from the decision of the Town Clerk shall be pursuant to Article 78 of the Civil Practice Law and Rules.
Pursuant to § 24-0701(4) of said article, a permit shall not be required for the use of land in agricultural pursuits except for certain construction of buildings and other activities not in the normal course of agribusiness as set forth in such section.
There shall be no fee for the applying for or granting of a permit, but the penalties set forth in said article for a violation thereof shall constitute a civil penalty as provided in § 71-2303 of the said article.
