Article III Stopping, Standing and Parking

No person shall park a vehicle on any street between the hours of 2:00 a.m. and 6:00 a.m. of any day except as may be provided herein. Signs shall be posted by the Department of Public Works indicating overnight parking is authorized by permit on those streets. Overnight parking will be allowed on the following streets:

Prospect Street.

Walnut Street.

Washington Terrace.

Burnet Street (Lenox–Elwood Avenue).

North and South Munn Avenue.

(f)

William Street.

(g)

14th Street–19th Street.

(h)

North and South Arlington Avenue.

Washington Street.

Chestnut Street.

Carnegie Avenue.

Parking will be prohibited on the above-referenced streets Monday through Friday from 9:00 a.m. to 12:00 noon.

Overnight parking is not authorized on the streets listed in Subsection J hereunder.

The East Orange Parking Authority shall assume the responsibilities of the issuing officer for overnight parking permits. Parking permits for overnight parking may be issued to an applicant who has provided the East Orange Parking Authority with proof of residency pursuant to the following:

Proof of residency shall be confirmed by submitting one of the following items: a valid New Jersey driver's license, a valid New Jersey motor vehicle registration, valid proof of automobile insurance, a valid lease agreement, or a property tax bill and/or deed. In addition to the foregoing, applicants can also submit two of the following secondary documents to establish residency: correspondence from the Internal Revenue Service, bank statements, utility bills and credit card statements. Items on the secondary list must be dated within 90 days of the application date.

(a)

In the case of a vehicle which is registered to a company or corporation, the items listed above shall be required to confirm residency, and a letter from the registered owner showing that the resident has control over the vehicle after business hours shall be presented.

(b)

In the case of a vehicle registered, owned and/or insured in another person's name, the resident must provide a notarized letter from the owner stating that they are authorized to operate the vehicle and park it overnight in East Orange. In addition, the certification must state that they understand that the vehicle may receive tickets for which they are responsible.

(c)

In the case of a college student, a permit may be obtained for free upon the submission of proof of enrollment in any college/university.

The resident parking permit or any temporary parking permit (see Subsection H hereunder) or a parking permit granted under special, extraordinary circumstance (see Subsection I hereunder) is to be placed on the rear-view mirror holder facing the front windshield of the vehicle.

Permit fees.

Parking permits shall be issued on an annual calendar year basis from January 1 through December 31 of each year. Except as otherwise provided herein, the annual parking permit fee shall be $150 per year for each vehicle. The amount shall be prorated on a monthly basis. Monthly prices shall be as follows:

Monthly permit amounts shall be upheld for each day of the month.

The fee for residents over the age of 65 shall be $75 per year for each vehicle, regardless of the date of purchase of such permit. The fee for residents that have been deemed to be totally disabled by United States government or the State of New Jersey shall be $75 per year for each vehicle, regardless of the date of purchase of such permit. All parking permit fees are nonrefundable. Payments must be made at the time of purchase. Permits are only transferable to a different vehicle owned by the same resident identified on the initial application.

The permit issued pursuant to this section shall entitle the holder to park on the streets, except in prohibited areas, in the manner set forth in Subsection B, subject to snow removal. Snowfalls exceeding three inches require that the vehicle be moved to allow for snow removal.

Any vehicle which is found by the East Orange Parking Authority or the Police Department to be parked without a valid permit, contrary to the provisions of this section, may be ticketed. Any such vehicle shall be towed and removed by the East Orange Parking Authority or the police, and all costs of such towing, removal and storage shall be paid by the owner of the vehicle upon the issuance of the third consecutive ticket for noncompliance with this section.

Overnight parking is not permitted for commercial vehicles, which shall include those vehicles set forth in §§ 260-15 and 260-15.1 of the City Code.

Alternate side of the street parking shall be enforced to facilitate street cleaning on streets where overnight parking is authorized on Monday, Tuesday, Wednesday, Thursday and Friday.

Single night permits will be issued from the Tax Collector or her designee. The fee for each single night permit shall be $4. Beginning January 1, 2013, the fee for each single night permit shall increase by $1 per year to a maximum amount not to exceed $6 per night.

Nonresident parking permits granted under special, extraordinary circumstances.

A parking permit for a period not to exceed 90 days from the date of issuance may be granted to a nonresident owner of a vehicle under the following special, extraordinary circumstances:

(a)

A family medical emergency; or

(b)

Other similar emergency requiring the presence of the vehicle owner.

Any applicant for such a permit allowed under this subsection must demonstrate the necessity for the issuance of such a permit by providing a statement outlining the circumstances, along with other such documentation necessary to substantiate the emergent need for parking. In the event of an emergency such as bereavement, the applicant may go to the Tax Collector or her designee and request permission to park on a prohibited street. The applicant shall complete the form designated and approved by the City. The maximum that an applicant may seek shall be no more than two cars for a period not to exceed five days. The applicant seeking said permission shall submit either a copy of the death certificate or a letter from the funeral director.

§ 260-14.2 Street sweeping schedule.

There shall be no parking on the following streets at the following times to allow for mechanical street sweeping as follows:

Essex Street: Tuesday and Thursday from 8:00 a.m. to 9:00 a.m.

North Oraton Parkway: Monday and Friday from 9:00 a.m. to 10:00 a.m.

Eaton Place: alternate side of the street 9:00 a.m. to 12:00 noon, as follows:

Monday/Wednesday/Friday.

Tuesday/Thursday.

South 17th Street: alternate side of the street 9:00 a.m. to 12:00 noon, as follows:

Monday/Wednesday/Friday.

§ 260-15 Parking of trucks, trailers, etc., on streets between 2:00 a.m. and 6:00 a.m.

Tuesday/Thursday.

Morris Street: Tuesday 9:00 a.m. to 10:00 a.m.

Hawthorne Avenue, Garfield Place, and Birchwood Avenue: Monday and Friday 9:00 a.m. to 10:00 a.m.

It shall be unlawful for any truck, truck tractor, trailer, or combination thereof, as defined in Title 39 of the Revised Statutes of New Jersey, to be parked on any City street between the hours of 2:00 a.m. and 6:00 a.m.

Violations and penalties. Any person who violates this section shall, upon conviction thereof, be punished by a fine not exceeding $2,000. The court shall impose a minimum fine of $500 for a first violation of this section and a minimum fine of $1,000 plus towing for any subsequent violation.

§ 260-15.1 Parking of trucks weighing in excess of 10,000 pounds prohibited.

No person shall park a truck, tractor, trailer, semitrailer or omnibus having registered gross weights in excess of 10,000 pounds upon any street or parts of streets within East Orange.

§ 260-16 Parking for certain purposes prohibited.

No person shall park a vehicle upon any roadway for the principal purpose of:

Displaying such vehicle for sale.

Washing, greasing or repairing such vehicle.

§ 260-17 Angle parking.

Upon those streets or sections of streets designated by ordinance of the City Council, no person shall park or stand a vehicle other than at the angle to the curb or edge of the roadway as indicated below and designated by such signs or markings on the pavement:

§ 260-21 Bus and taxi stations.

The City Council may from time to time by resolution designate bus stops, stations and stands for omnibuses and taxis on sections of streets. The driver of a bus shall not stop to unload or load passengers upon any street at any place other than at a designated station or stand.

Bus stops, taxi stands and loading zones shall be subject to the provisions of N.J.S.A. 39:4-139.

§ 260-37 Stopping, standing or parking during or after snow storms; emergency routes.

Citywide snow emergency.

A state of emergency is hereby declared to exist within the City of East Orange whenever snow has fallen and the accumulation is such that it covers the street or highway, and a snow emergency has been declared by the Mayor in conference with the Director of Public Works. Upon such declaration of emergency, there shall be no parking upon streets or sections of streets where temporary "Emergency No Parking" signs are displayed. Notification that the "Emergency No Parking" signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

In order to afford the municipality the opportunity to clear the streets of snow and to open the highways of the City of East Orange to traffic during the period of the emergency aforesaid, no vehicle, however propelled, except as herein provided, shall be allowed to stand, stop or park, whether attended or not, upon any highway of the City of East Orange, except for picking up and discharging passengers, or for picking up or delivering essential merchandise or other commodities; provided, however, that such emergency shall be terminated as to any highway when the snow, from curb to curb, has been plowed therefrom.

Such emergency shall be presumed to continue on those streets of the City from which the snow has not been removed, and no vehicle shall be allowed to stand, stop or park, whether attended or not, on such street or highway until the snow shall have been cleared therefrom, provided that signs have been placed or posted indicating that parking is prohibited along such street or highway while the City is engaged in or about to engage in the removal of snow therefrom.

§ 260-38 Towing and impoundment of illegally parked or standing vehicles; impoundment of vehicles subject to outstanding traffic warrants.

The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

Any unoccupied vehicle parked or standing in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

Vehicles subject to outstanding traffic warrants.

Any vehicle subject to outstanding traffic warrants, as set forth in N.J.S.A. 39:4-139.2 et seq., may be immobilized, moved or caused to be removed by any police officer. Immobilization shall be by use of a device or other mechanism which will cause no damage to such vehicle unless moved when such device or mechanism is in place. In any case involving immobilization of a vehicle pursuant to this section, the Chief of Police or his designee shall cause to be placed on such vehicle, in a conspicuous manner, notice sufficient to warn any individual of the fact that any attempt to move such vehicle might result in damage to such vehicle. The owner shall pay the costs of immobilization, which shall be $75, plus the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

Within 48 hours of immobilization and/or removal, the Chief of Police or his designee shall make every effort to ascertain the identity of the last registered owner and to notify him personally or by certified mail of the immobilization and/or removal of such vehicle and all charges which must be paid by the owner to redeem the vehicle.

Before the owner or person in charge of any vehicle impounded pursuant to this section shall be allowed to repossess or secure the release of said vehicle, the owner or his agent shall pay all sums legally due the City of East Orange for warrants issued and outstanding against such vehicle and all sums due for immobilization, removal and storage of the vehicle.

Any vehicle not claimed by its registered owner or someone authorized in writing to act on his behalf by midnight of the 30th day following the date on which the vehicle was impounded or immobilized may be sold at auction in accordance with N.J.S.A. 39:4-139.13. Proceeds, if any, from the sale of the vehicle shall be disbursed pursuant to N.J.S.A. 39:4-139.13.

Any unauthorized person who tampers with or removes the device or mechanism used to immobilize such vehicle shall be liable to a penalty of not more than $2,000, 90 days' imprisonment and/or 90 days of community service.

§ 260-39 Special parking zones.

Handicap parking spaces.

Except when necessary to avoid conflict with other traffic or in compliance with the directions of a traffic or police officer or traffic sign or signal, no operator of a vehicle shall stand or park the vehicle in any space on public or private property appropriately marked for vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197.5 or any other applicable law, unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or a passenger in that vehicle.

Only persons with special vehicle identification cards issued by the State Division of Motor Vehicles pursuant to the provisions of N.J.S.A. 39:4-205 shall be allowed to park their cars in restricted parking zones established for handicapped persons, except during those hours when parking is specifically prohibited. Parking in restricted parking zones for handicapped persons may further be restricted when those areas have been designated for specific residents pursuant to this section.

Upon adoption of an ordinance pursuant to N.J.S.A. 39:4-197.6, establishing an individualized restricted parking zone in front of a residence occupied by a handicapped person or persons, the Public Works Department shall issue a permit which identifies a specific motor vehicle and the location wherein it is to be parked which shall correspond to the ordinance. The permit shall be 5 1/2 inches by 8 1/2 inches in size, shall bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street. Such permits shall only be issued to persons who can prove ownership and operation of the motor vehicle and residency at the location specified thereon. The fee for each such permit shall be $50.

Each applicant for an individualized restricted parking zone in front of his or her residence shall meet and satisfy all of the requirements set forth in N.J.S.A. 39:4-197.5, N.J.S.A. 39:4-197.6, N.J.S.A. 39:4-197.7, and any other applicable state statute, rule or regulation.

No handicapped parking space shall be established within 300 feet of any other handicapped parking space, except that where handicapped parking spaces are existing in closer proximity on the effective date of this section, those spaces may remain until the permit holder dies or otherwise permanently ceases to reside in that residence, or until he or she no longer qualifies for a handicapped parking space under the terms of this section and/or the applicable state statutes.

Each applicant for an individualized restricted parking zone in front of his or her residence shall certify on a form provided by the Department of Public Works that he or she has no driveway or garage accessible for use as a parking space, unless there are extenuating circumstances necessitating a need for such restricted parking zone. The Department of Public Works shall establish the presence of any extenuating circumstances prior to adoption of an ordinance establishing a restricted parking zone in front of an applicant's residence.

Each applicant for an individualized restricted parking zone in front of his or her residence may only receive one handicapped parking space. If there is parking permitted on both sides of the street, the restricted parking zone shall be limited to that side of the street on which the applicant's residence is located.

Holders of temporary handicapped license plates must reapply annually with the Department of Public Works to maintain a restricted parking zone in front of their residence once such handicapped parking space has been issued.

Once every three years, commencing in 2015, the Public Works Department shall send a form to each recipient of an individualized handicapped parking zone containing a certification to be signed by the recipient certifying his or her continuing qualifications and needs for a handicapped parking space. Each form shall contain instructions for its completion and return within 30 days of receipt. Within 30 days after the due date for the return of the certifications, the Public Works Department shall submit a list to the City Council of all handicapped parking spaces for which certifications were not returned. The City Council may then act at a subsequent meeting to terminate approval of those handicapped parking spaces for which certifications were not received.

Before final adoption of an ordinance establishing an individualized handicapped parking zone, the Department of Public Works shall examine each proposed handicapped parking space and shall report to the City Council if the application can be granted without detriment to the welfare of the public. Factors that could lead to a finding that a proposed space is a detriment to the welfare of the public include but are not limited to the following: 1) parking is otherwise prohibited in the area; 2) the restricted space will interfere with the normal flow of traffic; 3) the number and/or nature of commercial establishments in the area make the restricted space burdensome and impractical; and 4) the existence of other restricted parking spaces in the vicinity of the proposed space is likely to create an unreasonable burden on neighboring residents. It shall be the responsibility of the City Clerk to send on the day following introduction of an ordinance establishing a handicapped parking space a written notice to the Public Works Department advising of the date for final adoption of said ordinance.

Any person parking a vehicle in a parking space reserved for the physically handicapped without a special vehicle identification card issued by the State Division of Motor Vehicles pursuant to N.J.S.A. 39:4-205 and/or a permit issued by the Department of Public Works shall be liable to a fine of $250 for the first offense and, for subsequent offenses, a fine of $250 and up to 90 days community service on such term and in such form as the Court shall deem appropriate. In addition to any fine or penalty imposed for a violation of this section, the Municipal Court shall also impose a surcharge of $6 pursuant to N.J.S.A. 39:5-41(d) through (g), which shall be collected by the Clerk of the Municipal Court and forwarded to the State Treasurer. The Court shall not suspend collection of the surcharge of $6 imposed pursuant to this section.

The City Council establishes the following individualized restricted parking zones for handicapped persons pursuant to § 260-39:

Parking in front of private driveway.

The City hereby by permit allows the parking of a private motor vehicle in front of a private driveway pursuant to N.J.S.A. 39:4- 138.3 whenever both the motor vehicle and driveway involved are owned by the same person, whenever the motor vehicle is owned by a member of the same household as the owner of the private driveway and where such parking is not otherwise prohibited by law and the permitting thereof would not interfere with the normal flow of traffic. This permit is restricted to the owners of single-family dwellings and not to owners of multifamily dwellings nor to those having shared driveways.

All qualified applicants shall apply to the Department of Public Works who shall be the designated issuance authority for the issuance of permits which authorizes the parking of motor vehicles in front of private driveways and must identify the driveway the location of the driveway in front of which the parking of the motor vehicle is permitted (N.J.S.A. 39:4-138.4).

An owner of a private driveway shall be eligible to apply for a permit for their own motor vehicles. Each member of the owner's household who owns a motor vehicle shall also be eligible to apply for a permit to be issued herein. The permit shall be 5 1/2 inches by 8 1/2 inches in size shall bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street.

This provision does not supersede the requirements of any municipal ordinance or state legislation concerning overnight parking or any other overnight parking requirements contained therein.
