A.
For the purposes of this Chapter, the term "garage sale," shall include, but not be limited to, yard sales, patio sales and any other sales from a residence, business or organization, provided, however, that such business or organization are properly licensed for retail sales by Ozark County and recognized by the Village of Theodosia Council are exempted from the provisions of this Chapter.

Sales as defined in Subsection (A) of this Section are restricted in duration to no more than four (4) consecutive days and shall not be held on the same premises more than twice in one (1) calendar year.

Any person conducting a sale pursuant to this Chapter shall first be required to obtain a permit through the Village office the same week of the sale. Each person applying for a permit shall be required to give his or her name, address, telephone number, location and any other information as is reasonably necessary for the proper regulation of garage sales as provided in this Chapter. No fee shall be required for said permit.
D.
Each person obtaining a permit pursuant to this Chapter shall be required to display the permit in a conspicuous place on the premises at which the sale is conducted. Permits issued under this Chapter shall be prepared in duplicate and one (1) copy going to the Village office and one (1) going to the person obtaining the permit. Copies of the permits will be filed by the Village office. The permits shall contain the specified dates of the sale.

Each person conducting a sale regulated by this Chapter shall not post any signs advertising said sale more than two (2) days prior to the sale and shall remove all signs pertaining to that sale at the end of the final sale day. Sale items must be a minimum thirty (30) feet from State highways and cannot be sat on (State, County or Village rights-of-way, easements, or land owned by such). Sales must be held on private property. Signs cannot be posted on trees, street signs, stop signs, light poles, telephone poles, or any utility pole, or in such a manner as to impede the vision of drivers at intersections. All signs must be removed on the same day as the sale ends. Additionally, for the purpose of enforcing the provisions of this Chapter and prosecuting violations of same, the fact that an address is posted on a sign advertising a garage sale shall create a rebuttable presumption that the sign was placed by anyone at that address. It is the responsibility of the owner of the property that all rules are followed as laid out in this Section. A fine not to exceed one hundred dollars ($100.00) may be imposed on any person or persons not abiding by this Section.
