The Lower Merion Library System, a corporation
not for profit under the laws of the Commonwealth of Pennsylvania,
be and the same is hereby designated as the agent of the Township
of Lower Merion to provide library services for the residents and
taxpayers of the Township.
The Township of Lower Merion does hereby undertake
and agree to maintain or assist in the maintenance of the Lower Merion
Library System, such assistance to be sufficient in amount to ensure
that the System will be able to qualify annually for financial aid
from the Commonwealth of Pennsylvania, in accordance with the requirements
of the Library Code.
The Board of Commissioners of the Township of
Lower Merion will appoint three of its members to serve on the Board
of Directors of the Lower Merion Library System, each of such representatives
to serve for a term of three years and the terms of such representatives
to expire in different years. Vacancies shall be filled for unexpired
terms.
The Treasurer of the Board of Directors of the
Lower Merion Library System shall give bond to the Township with satisfactory
surety in such amount as the Board of Directors of the Library System
may determine, such bond to be approved as to form by the Township
Solicitor.
The Board of Directors of the Lower Merion Library
System shall have the rights and be subject to the duties specified
in the Library Code. The Board of Directors of the Library System shall annually
present a financial report to the Township. The financial accounts
of the System shall be audited annually by the Township's auditors
and accountants, as in the case of other municipal expenditures.
The Board of Directors of the Lower Merion Library
System shall prepare and present to the Township such annual reports
as are required by Section 414 of the Library Code and shall provide
free library services for the residents and taxpayers of the Township
as required by Section 415 thereof.
It shall be unlawful for any person in a Township-owned public
library facility to drink or possess any alcoholic beverage, including
beer or other malt beverages, except at an event sponsored or sanctioned
by the Lower Merion Library System pursuant to a permit. The Lower
Merion Library System is hereby authorized to issue such permits for
the facility under their jurisdiction subject to any regulations which
the Board of Commissioners of the Township of Lower Merion may approve
and subject to the laws and statutes of the Commonwealth of Pennsylvania
and regulations of the Pennsylvania Liquor Control Board. No intoxicated
persons shall be permitted in a public library facility.
